RESOLUTION NO. 75-73
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be, and they hereby are,
authorized and directed to execute one certain agreement by
and between the City of Fayetteville, Arkansas, and Rene
Diaz pursuant to which the City of Fayetteville, Arkansas,
agrees to approve the large scale development plan submitted
by Rene Diaz for the proposed construction of a single-
family dwelling on Halsell Road, and Rene Diaz agrees to
dedicate a 25 -foot right of way from the centerline of Halsell
Road. A copy of this Agreement marked Exhibit "A" is attached
hereto and made a part hereof.

AGREEMENT
In consideration of the mutual

WITNESSETH:
1. That the City of Fayetteville

a municipal corporation,
agrees to approve the
Large Scale Development Plan submitted by Rene Diaz for the
proposed construction of a single-family dwelling on Halsell
Road.
2. That Rene Diaz agrees to dedicate up
to 25 feet of
right of way from the centerline of Halsell Road when requested
to do so by the City of Fayetteville.?
3. That before the City of Fayetteville requests Rene
Diaz to dedicate the aforesaid right of way, it agrees to have
the centerline of Halsell Road determined by survey and to bear
the expense of said survey.
