RESOLUTION NO. 63-73

BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That $1,276.51 be allocated from the 1973 Revenue Sharing
Contingency. Balance to be expended for the Highway. 71 North "traffic
island" beautification project; that Resolution No. 59-73 be hereby
amended to conform to the provisions of this resolution; and that
the City Manager or the Mayor be and they are hereby authorized and
directedto enter into a contract with the Arkansas State Highway
Department guaranteeing the maintenance of the traffic islands involved
in said project.

WHEREAS, the members of the Board
o f Directors of the City of Fayetteville,

authorized and directed the Mayor to enter an agreement wherein the City of
;Fayetteville, Arkansas, assumes full' responsibility for the maintenance of the
island planters constructed in accordance with Change Order No. 14, Job No. 9584,
North Street - North Fayetteville Loop (Fayetteville), State Job, Washington
County..
NOW, THEREFORE, We, Russell Purdy, Mayor of the City of Fayetteville,
Arkansas, a municipal corporation organized and existing under the laws of the
State of Arkansas, acting in behalf of the City of Fayetteville, Arkansas, and
Curtis G. Parole, District 9 Engineer
acting in behalf of the Arkansas
State Highway Department, do hereby.agree that the City'of Fayetteville, Ark -
:anus, assumes full responsibility for the maintenance of the'island planters

constructed in accordance with Change Order No. 14, Job -No. 9584, North Street

North Fayetteville Loop (Fayetteville), State Job,.Washington-County.
We fully understand that if;;in the opinion of the:proper Arkansas State
Highway Department officials, the island planters are not satisfactorily main-
tained, the Department retains the full right to modify these islands'with.a
maintenance free surface.
IN WITNESS WHEREOF, the City of Fayetteville, Washington County, Arkansas,
has caused this agreement to be signed by its Mayor, attested by its clerk and
its corporate seal to be herewith affixed, all in accordance with and pursuant
to a Resolution of its City Council, duly and regularly adopted on the
