BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Mayor and City Clerk be and they are hereby
authorized and directed to execute a construction agreement with
the Arkansas State Highway Department for_street striping under
the TOPICS Program A copy of the conSti:Uttion agreement is
attached hereto, marked Exhibit "A", and made a part hereof.

Tayetteville • Arkansas Party of the 2nd Part, hereinafter
•called Lessee, WITNESS:
The Lessor hereby agrees to rent to the Lessee the following
equipment: •Truck ?Wonted Striping Madbine
1/2 Ten Pick 110 Tarn
Tractor Truck with Van Type Trailer
Tor use in striping City Streets in Fayetteville. Job No. 9618.
That in consideration thereof, Lessee agrees to pay to Lessor the
following rentals for the use of said equipment:

The Lessor agrees to bear the coat of repairs due to normal wear .
and tear on non -tractor equipment and the Lessee agrees to bear all other
cost. On tractor equipment and rubber tired healing equipment, Lessee
agrees to bear all cost for maintenance and repair.
The equipment rented shall be delivered to the Lessee in good
operating condition and is to be returned to the Lessor in same condition
as delivered less normal wear.
The rental rates set out above are all F.O.B. Lessor warehouse or

shipping point. Lessee agrees to pay the freight of drayage charges and
transportation charges from shipping or transportation point to destination
and return,. When loading, unloading, dismantling or assembling is necessary,
Lessee agrees to pay for this additional cost. The rental rates above start
when the equipment leaves the Lessor's warehouse or place of storage and
stops when it irtreturned to point of destination.

This Contract is entered into between the Arkansas State Highway
Department and the City of layette/villa Arkansas,
authorized by Minute Order No. 262 adopted by the Arkansas State Highway
Commission on October 29, 1953.
