HomeMy WebLinkAbout56-72 RESOLUTION77 RESOLUTION N0, �6-%.2 A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF RIGHTS OF WAY AND EASEMENTS FOR CONSTRUCTION, INSTALLATION, AND MAINTENANCE OF WATER AND SEWER LINES ON HIGHWAY 265 AT HIGHWAY 16. WHEREAS, the City of Fayetteville, Arkansas, is in the process of obtaining the easements and rights of way for a proposed extension of water and sewer lines and appurtenances thereto on Highway 265 at Highway 16, necessitating rights of way and easements over certain lands in Washington County, Arkansas, for construction, installation, and main- tenance of said "Water and sewer lines and appurtenances thereto being constructed under said project. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That for the purpose of constructing, installing, operating and maintaining Cas more fully set forth in the contract document pertaining to said project) water and sewer lines and appurtenances thereto, it is necessary that easements and rights of way in the lands of certain property owners designated on the official plans on file in the office of the City Engineer, being entered upon and taken, the City Attorney is hereby authorized and directed to institute condemnation proceedings to acquire said easements and right of way in the manner required by law. Section 2. That the questions in controversy in such proceedings are likely to retard the progress of said construction, the City Attorney is therefore, further authorized and directed to petition the Court for permission to provide appropriate deposits with the Registry of the Court for making compensation and payment of damages in order that immediate possession of said lands may be secured and construction proceed prior to assessment and payment of damages. Section 3. That this Resolution shall be in full force and effect from and after its passage and approval.
