WHEREAS, the Board of Directors of the City of Fayetteville, Arkansas, a municipal corporation, did cause studies to be made of the needs for street improvements to Sycamore Street from Highway 71 (College Avenue) to Gregg Avenue and, WHEREAS, the report on improvement of Sycamore Street from Highway 71 (College Avenue) to Gregg Avenue was contained in Resolution No. 29-71, passed and approved by the Board of Directors of the City of Fayette- ville, Arkansas, on the third day of May, 1971; and, WHEREAS, it appears that the petition for the improvement of Sycamore Street from Highway 71 (College Avenue) to Gregg Avenue will not receive the signatures of a majority of the property owners, and, WHEREAS, it appears that a petition for the improvement of Sycamore Street from Highway 71 (College Avenue) to Woolsey Avenue might receive the signatures of the necessary majority and, r WHEREAS, the Board of Directors deems it desirable to amend the report on improvement of Sycamore Street from Highway 71 (College Avenue) to Gregg Avenue to include only that portion of Sycamore Street from Highway 71 (College Avenue) to Woolsey Avenue, and, WHEREAS, the City Manager has presented to the Board of Directors certain findings and determinations with regard to the paving of SycaLl more Street from Highway 71 (College Avenue) to Woolsey Avenue, which findings and determinations are as follows, to -wit: REPORT ON IMPROVEMENT OF SYCAMORE STREET FROM HIGHWAY 71 (COLLEGE AVENUE) TO WOOLSEY AVENUE 1. A street improvement District is recommended for the improvement of Sycamore Street from Highway 71 (College Avenue) to Woolsey Avenue, 2. The proposed street improvement project should include complete street reconstruction. Necessary improvements include: A. Construction of base to meet current city standards; B. Paving with two inches of hot -mix asphaltic materials twenty- eight (28) feet wide from flow line to flow line; 2 C. Installation of a curb and gutter on the south side of said street; D. installation of a four (4) foot sidewalk on the north side of said street in lieu of curb and gutter. 3. The total estimated project cost for said street reconstruction program is $42,976,00, 4. It is proposed that the City would pay $25,517.00 of the project cost with an assessment of $17,459.00 being levied against the real prop- erty benefited by the proposed improvements to reimburse the City for a portion of the cost of the improvements. The City's share is shown below as an assessment on Tract 16 held by the City for park purposes. 5. It is proposed that the property owner(s) be given a choice of paying the assessments levied in a lump sum payable within thirty (30) days after the completion of the proposed improvements, or in ten (10) equal annual installments bearing interest at the rate of ten per cent per annum. If the property owner(s) choose(s) the installment method of payment, the first installment shall be collected on or before October 1, 1972. Second and subsequent installments shall be paid at the time provided by law for paying the first installment of general taxes on the property. 6. The approximate assessment which would be made against each lot or parcel of property are as follows: TRACT APPROXIMATE ASSESSMENT Part of the SW 1/4 of the SW 1/4 of Section 3, Township 16 North, Range 30 West, being more particularly described as beginning 237 feet and 1 inch East of the Southwest corner of said 40 acre tract, and running, thence North 200 feet and 2 inches; thence East 295 feet and 2 inches; thence West 295 feet and 2 inches to the point of beginning, except that portion of said tract along the East side em- braced in the present right=of-way of U.S. High- way No. 71. (TRACT 1) $ 11888,00 Part of the SW 1/4 of the SW 1/4 of Section 3, Township 16 North, Range 30 West, more partic- ularly described as follows, to -wit: Beginning at , a point which is 125 feet North of the Southwest .f 3 TRACT APPROXIMATE ASSESSMENT corner of said 40 acre tract ,•.and running, thence East 50 feet; thence South 44 feet, thence East 37 feet, thence South 26 feet, thence East 68 feet, thence South 55 feet, thence East 82 feet 1 inch, thence North 295 feet 2 inches, thence West 237 feet 1 inch, thence South 170 feet to the point of beginning; and A part of the SW 1/4 of the SW 1/r of Section 3, Township 16 North, Range 30 West more particularly described as follows, to - wit: Beginning 50 feet East of the South- west corner of said 40 acre tract, and running, thence East 105 feet, thence North 55 feet, thence West 68 feet, thence North 26 feet, thence West 37 feet, thence South 81 feet to the point of beginning; and, a part of the SW 1/4 of the SW 1/4 of Section 3, Township 16 North, Range 30 West, more particularly described as follows: Beginning at the SW corner of said 40 acre tract; thence East 50 feet; thence North 125 feet; thence West 50 feet; thence South 125 feet to the point of beginning. (TRACT 2, 3 and 4) A part of the southeast quarter of the Southeast quarter of Section four (4) in Township Sixteen (16) North of Range thirty (30) West, described as follows: Beginning at the South East corner of said forty acre tract, and running, thence North two hundred ninety seven (297) feet; thence West one hundred forty six (146) feet and eight (8) inches; thence South two hundred ninety seven (297) feet; thence East one hundred forty six (146) feet and eight (8) inches to the place of beginning, containing one acre (1), more or less, (TRACT 5) Lot numbered One (1) and Nine (9) feet of equal and uniform width off of the South side of Lot Numbered Two (2) Woodland Heights Addition to the City of Fayetteville, as designated upon the recorded plat of said addition.
