RESOLUTION NO. '2:74-772.
A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION
OF RIGHTS OF WAY AND EASEMENTS FOR CONSTRUCTION, INSTALLATION
AND MAINTENANCE OF WATER LINES RELOCATED NEAR HIGHWAY 71 NORTH.
WHEREAS, The City of Fayetteville, Arkansas, is in the
process of obtaining the easements and rights of way for a
proposed water line relocation in the area of Highway No. 71
North necessitating rights of way and easements over certain
lands in Washington County, Arkansas, for construction, installation,
and maintenance of said water lines being constructed under
said project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. For the purpose of constructing, installing
operating and maintaining (as morefully set, forth in the
contract documents pertaining to said project) a water
line, the necessary easements and rights of way in the
lands of the owners designated in exhibit (a) to this
resolution be entered upon and taken, and the City
Attorney is hereby authorized and directed to institute
condemnation proceedings to acquire said easements and
rights of way in the manner required by law.
Section 2. That the questions in controversy in such
proceedings are likely to retard the progress of such
construction, and the City Attorney is further authorized
and directed to petition the court for permission to
provide appropriate deposits with the registry of the
courtcfor making compensation and payment of damages in
order that an immediate possession of said land may be
secured and construction proceed prior to assessment and
payment of damages.
Section 3. That this resolution shall be in full force
and effect from .and after its passage and approval.
