A RESOLUTION AUTHORIZING AND•DIRECTING THE CONDEMNA-
TION OF RIGHTS OF WAY AND EASEMENTS FOR CONSTRUCTION,
INSTALLATION AND MAINTAINANCE OF COLLEGE AVENUE(0. S.
HIGHWAY NO. 71).
WHEREAS, the City of Fayetteville, Arkansas, is in
the process of_obtaining the easements and rights of way
for proposed ihprovements of College Avenue (U. S. Highway
No. 71) necessitating rights of way and easements over
certain lands in Washington County, Arkansas, for construction,
installation, and maintainance of said avenue being con-
structed under said project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That for the purpose of constructing,
installing, operating and maintaining ( as more fully set
forth in the, contract documents pertaining to said project)
a roadway -,),necessary easements and rights of way are
requiredto be entered upon and taken, and the City Attorney
is hereby authorized and directed to institute condemnation
proceedings to acquire said easements and rights of way in
the manner required by law.
Section Z. That the questions in controversy in such
proceedings are likely to retard the progress of such con-
struction, and the City Attorney is further authorized and
directed to petition the Court for permission to make
appropriate deposits with the registry of the Court for
making compensation and payment of damages in order that
an immediate possession to said lands may be secured and
construction proceed prior to assessment and payment of
damages.
Section 3. This resolution shall be in full force
and effect from and after its passage and approval.
