WHEREAS, B. A. Shamblin, Trustee, has heretofore filed with the
City Clerk of the City of Fayetteville, Arkansas, a petition to vacate
and abandon a public alleyway ten (10) feet in width and three hundred
four (304) feet in length, and running East and West between the West
boundary line of College Avenue and the East boundary line of a public
alleyway ten (10) feet in width and running North and South between the
South boundary line of East Mountain Street and the North boundary
line of East Rock Street inblocknumbered twenty-nine (29) in the City
of Fayetteville, Arkansas, as designated upon the original plat of
said town; and
WHEREAS, pursuant to Resolution No. _/l/ adopted by the Board
of Directors of the City of Fayetteville, Arkansas, the 20th day of
September, 1971, was fixed as the date for hearing on said petition;
and
WHEREAS, notice of said hearing was published in the Northwest
Arkansas Times on September 13, 1971 and on September 20, 1971; and
WHEREAS, no person, firm, or corporation owning property in the
vicinity of said alley sought to be vacated has appeared before the
Board of Directors to oppose the vacation of said alley; and
WHEREAS, it appears that all persons, firms, and/or corporations
which have erected or installed any conduit, pipe, cable, pole, or
overhead wire along or across said alley have consented in writing
to the closing of said alley; -
NOW, THEREFORE, BE IT RESOLVED:
1. That said alley is not needed for highway or alley purposes
but is needed for the construction and erection of a United States
Courthouse and office building thereon.
2. That the welfare of the City of,Fayetteville, Arkansas will
therefore be enhanced and promoted by the closing and abandoning of
said alley.
3. That the Mayor and City Clerk be, and they are hereby, authorized
to enter into a written agreement with the owners of all the real estate
of said block in which said alley is located to close and abandon said
alley.
