RESOLUTION NO. A -11
•
WHEREAS, the Board of Directors of the City of. Fayetteville,
Arkansas, a municipal corporation, did cause studies to be made
of the needs for street improvement to Lawson Street from Oakland
Avenue to Leverett Avenue, and
WHEREAS, pursuant to the above-described studies the Board
of Directors of the City of Fayetteville, Arkansas, has received
from the City Manager certain findings and determinations, which
findings and determinations are as follows, to -wit:
REPORT ON IMPROVEMENT OF LAWSON STREET
FROM OAKLAND AVENUE TO LEVERETT AVENUE
1. In accordance with Resolution No. 3-71 passed and
approved by the Board of Directors on February 1, 1971, the City
Manager was authorized to perform studies for the improvement of
Lawson Street from Oakland Avenue to Leverett Avenue.
These instructions required a report to be made to the Board
of Directors containing the following listed data:
A. Determination of necessary improvements.
B. Determination of the approximate cost of said improve-
ments.
C. The available means for financing same.
D. The portion thereof which the municipality is willing
and•able to pay.

E. The approximate'•assessment which would be made against
each lot or parcel of property. -
2. The proposed street improvement project should include
complete street reconstruction on Lawson Street from Oakland
Avenue to Leverett Avenue. Necessary improvements include
reconstruction of base to meet current City standards, and repaving
with two (2) inches of hot mix asphaltic materials. Because of
an existing contract with a developer, it is proposed that the
property owners be given a choice of (A) paving Lawson Street
between Oakland Avenue and Leverett Avenue to a width of twenty
eight (28) feet from flow line to flow line with the installation
of a four (4) foot concrete sidewalk in lieu of curb and gutter
on the south side of said street and installation of a concrete
curb and gutter on the north side of said street or (B) paving
Lawson Street between Oakland Avenue and Leverett Avenue to a

width of 22 feet with barrow ditch drainage. If a majority of
the property owners petition for option (A) above, this is the
recommended and preferred alternative. If, however, less than
a majority petition for option (A) and a majority petition for
option (B), the improvements outlined in option (B) should be
accomplished.
3. The approximate assessments which would be made against
each lot or parcel of property if option (A) is approved by a
majority of the property owners:

Range 30 West of the 5th P.M., being more partic-
ularly described as follows, to -wit: Beginning
at a point thirteen hundred and ten feet (1310)
North and two hundred thirty two (232) feet West
of the Southeast corner of said eighty (80) acre
tract; running thence West seventy eight (78)
feet to an iron pin; thence North one hundred
and ninety (190) feet to an iron pin; thence
East one hundred and ten (110) feet to an iron
pin; thence South one hundred and fifteen (115)
feet; thence West thirty two (32) feet; thence.r?
South seventy five (75) feet to the point of $ 544.50

Also, a part of the West half (W 1/2) of the
Northwest Quarter (NW 1/4) of Section 9, Town-
ship 16 North, Range 30 West of the 5th P.M.,
being more particularly described as follows,
to -wit: Beginning at a. point Thirteen hundred
e ighty five (1385) feet North and twenty (20)
feet West of the Southeast corner of said eighty
(80) acre tract and running thence North one
hundred fifteen (115) feet; thence West one hun-
dred eighty (180) feet to an iron pin; thence
South one hundred fifteen (115) feet; thence
East one hundred eighty (180) feet to the point 891.00

Part of the West half of the Northwest quarter of
Section nine (9) in Township sixteen (16) North
o f Range thirty (30) West, described as begin-
ning thirteen hundred ten (1310) feet North and
two hundred (200) feet West of the South East
corner of said eighty (80) acre tract, and run-
n ing, thence West one hundred ten (110) feet;

Beginning at the Northeast corner of said eighty
acre tract, running thence South 1140 feet,
thence West 420 feet for the point of beginning
for the land to be conveyed, thence South 220
feet, thence West 95 feet, thence North 220
feet, thence East 95 feet to the place of
beginning. (TRACT D)
Part of the Northwest Quarter of the Northwest
Quarter of Section Nine (9) in Township sixteen
(16) North, Range thirty (30) West of the 5th
P.M., being more particularly described as begin-
ning at a point two hundred twenty (220) feet
North and three hundred thirty (330) feet West of
the South East corner of said forty acre tract,
and running, thence North one hundred (100) feet;
thence West ninety (90) feet; thence South one
hundred (100) feet; thence East ninety (90) feet
to the place of beginning, being situated at the
North West corner of Lawson Street and Storer
Avenue in the City of Fayetteville, Washington
County, Arkansas. (TRACT E)
A part of the Northwest Quarter (NW 1/4) of the
Northwest Quarter (NW 1/4) of Section Nine (9) in
Township Sixteen (16)' North, Range Thirty (30)
West, being more particularly described as follows,
to -wit: Beginning at a point on the North line of
Lawson Street, which point is Two hundred twenty
(220) feet North and Two hundred (200) feet West
of the South East corner of said forty (40) acre
tract, and running thence West with the North line
of said street Ninety (90) feet to the East line of
Storer Avenue, thence North with the East line of
said avenue One hundred (100) feet, thence East
Ninety (90) feet, thence South One hundred (100)
feet to the point of beginning. (TRACT F)

quarter of Section Nine (9) in Township Sixteen (16)
North, Range Thirty (30) West, being more particu-
larly described as beginning at a point two hundred

4. The approximate assessments which would be made against

5. The total estimated project cost, the share that the
City could pay and the assessments that would be levied against
the real property benefited by the proposed improvement to reim-
burse the City for the cost of the improvements is as follows:

6. It is proposed that the property owner(s) be given a
choice of paying the assessment levied in a lump sum payable
within thirty days after the completion of the proposed improve-
ments, or in ten (10) equal annual installments bearing interest
at the rate of ten per cent per annum. If the property owner(s)
choose(s) the installment method of payment, the first installment
shall be collected on or before October 1, 1971. Second and sub-
sequent installments shall be paid at the time provided by law for
paying the first installment of general taxes on the property.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
the City of Fayetteville, Arkansas, that said municipality indicates
the desire to undertake the above described improvements provided
the owners of a majority in value of the real estate to be assessed
agree to repay said municipality the portion of the cost described
above through uniform benefits upon each lot or parcel of property
described above.
