RESOLUTION' NO. IL:20

A RESOLUTION AUTHORIZING THE CONDEMNATION OF EASEMENTS AND
CERTAIN LANDS IN WASHINGTON COUNTY, ARKANSAS FOR USE IN CONSTRUC-
TION, OPERATION AND MAINTENANCE OF WATER AND/OR SEWER LINES,
MAINS, AND APPURTENANCES THERETO.
WHEREAS, the City of Fayetteville, Arkansas is in the process
of constructing water and/or sewer lines, necessitating rights of
way and easements over certain lands in Washington County, Arkansas,
for construction, operation and maintenance of water and/or sewer
lines, mains, and appurtenances thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
the City of Fayetteville, Arkansas:
Section 1. That for the purposes of constructing, operating
and maintaining water and/or sewer lines, mains, and all appurte-
nances thereto, the necessary easements and rights of way in the
lands of Ottis Watson and Ralph Brophy and/or James R. Ogden and
S. B. Holly and/or Holly -Ogden Enterprises, Inc. to be entered upon
and taken and the City Attorney is hereby authorized to institute
condemnation proceedings to acquire said easements and rights of
way in a manner required by law.
Section 2. That as the questions in controversy in such pro-
ceeding are likely to retard the progress of said construction,
the City Attorney is further authorized to petition the Court for
permission to provide appropriate deposits with the registry of
the Court for making compensation and payment of damages, in order
that immediate possession of said lands may be secured and con-
struction proceed prior to assessment and payment of damages.
