HomeMy WebLinkAbout03-70 RESOLUTIONRESOLUTION NO. 3-76 6 WHEREAS, under Title 1 of the Housing Act of 1949 as Amended, herein referred to as "Title 1", the Secretary of Housing and Urban Development is authorized to extend financial assistance to local public agencies in the elimination and prevention of'the spread of their slums and urban blight through the planning and i undertaking of urban renewal projects; and WHEREAS, it is desirable and in theipublic interest that the Housing Authority of the City of Fayettevill, Arkansas make surveys and prepare plans, presently estimated to cost approxi- mately Two Hundred Fifty One Thousand Twenty -Four Dollars and no cents ($251,024.00) in order to undertake and carry out an urban renewal project of the character contemplated by Section 110(c) of the City of Fayetteville, Arkansas, County of Washington, State of Arkansas, which is described as follows: Beginning at a point where the West right-of-way line of College Avenue intersects with the North right-of- way line of Spring Street; thence South along the West right-of-way line of College Avenue to the North right- of-way line of Center Street; thence East 185 feet along the North right-of-way line of Center Street to the West right-of-way line of County Avenue; thence South from said point along the East right-of-way line of County Avenue to the South right-of-way line of Mountain Street; thence West along the South right-of-way line of Mountain Street to the East right-of-way line of College Avenue; thence South along the East right-of-way line of College Avenue to the South right-of-way line of Rock Street; thence West along the South right-of-way line of Rock Street to a point 120 feet West of the West right-of-way line of Church Avenue; thence North along a line parallel to the West right-of-way line of Church Avenue to the South right-of-way line of Mountain Street; thence West along the South right-of-way line of Mountain Street to a point 160 feet West of the West right-of-way line of Locust Avenue; thence North 170 feet along a line parallel to the West right-of-way line of Locust Avenue to a point 100 feet South of the South right-of-way line of Center Street; thence West from said point along a line parallel to the South right-of-way line of Center Street to the West right-of-way line of School Avenue; thence North along the West right-of-way line of School Avenue to the South right-of-way line of Meadow Street; thence West along the South right-of-way line of Meadow Street to the East right-of-way line of West Avenue; thence South along the East right-of-way line of West Avenue to the South right-of-way line of Center Street; thence West along the South right-of-way line of Center Street to the centerline of the St. Louis and San Francisco Rail- road right-of-way; thence Northwardly 820 feet along said railroad centerline to a point which intersects with the West extended and North right-of-way line of Spring Street; thence East from said point along the West extended and North right-of-way line of Spring Street to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: 1. That the proposed Urban Renewal Area described above is a blighted, deteriorated and deteriorating area appropriate for the urban renewal project and that the undertaking by the Housing Authority of the City of Fayetteville, Arkansas of surveys and plans for an urban renewal project of the character contemplated by Section 110(c) of Title 1 in the proposed area is hereby approved. 2. That the financial assistance available under Title 1 is needed to enable the Housing Authority of the City of Fayetteville, Arkansas to finance the planning and undertaking of the proposed project. • 3. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title 1, including those relating to (a) the relocation of site occupants, (b) the provision of local grants-in-aid, (c) the prohibition of discrimination because of race, color, creed, or national origin, and (d) the requirement that the locality present to the Secretary of Housing and Urban Development, as a prerequisite to,approval of the,application.described below, a Workable Program for Community_ Improvement, as set forth inSection 101(c) of Title 1, for utilizing -appropriate public and private resources to eliminate and -prevent the development dr spread of slums and urban blight. t 4. That it is the sense of this body (a) that a feasible method for the relocation of individuals and families displaced from n the Urban Renewal Area, in conformity with Title 1, can be prepared, and (b) that the local grants-in-aid can and will be provided in an amount which will be not less than one-fourth of the Net Project Cost of the Project and which, together with the Federal capital grant, will be generally equal to the difference between Gross Project Cost and the proceeds or value of project land sold, leased, or retained for use in accordance with the urban renewal plan. 5. That the filing of an application by the Housing Authority of the City of Fayetteville, Arkansas for an advance of funds from the United States of America to enable it to defray the cost of the surveys and plans for an urban renewal project in the proposed Urban Renewal Area described above is hereby approved. (2) That the attached resolution is a true and correct copy of the resolution as finally adopted at a meeting of the Governing Body held on the 9th day of February, 1970; and duly recorded in his office; (3) That said meeting was duly convened and held in all respects in accordance with law and to the extent required by law due and proper notice of such meeting was given; that a legal quorum was present throughout the meeting, and a legally sufficient number of members of the Governing Body voted in the proper requirements and proceedings under law incident to the proper adoption or passage of said resolution, have been duly fulfilled, carried out, and otherwise observed;. (4) That if animpression of the seal has been affixed below,it constitutes the official seal of the City and this certificate is hereby executed under such official seal.
