V RESOLUTION NO. 2 7'e) MIN WHEREAS, Phase III of the sewer construction projects currently being undertaken by the Water and Sewer Department of -the City of Fayetteville, Arkansas is estimated to cost $1,150,000 which is some $31,000 it excess of the cost anticipated at the time financing was arranged and construction contracted; and WHEREAS, failure to complete said sewer construction projects would render the sewerage system incapable of providing adequate sewer service; and WHEREAS, failure to complete said sewer construction projects would render the sewerage system incapable of providing service to additional customers and would, therefore, adversely -t affect the sewer system as a revenue producing undertaking; and -WHEREAS, the Arkansas Highway Department has notified the City of Fayetteville, Arkansas that certain water sewer lines running parallel to U. S. Highway.No. 71 can not remain at their present location on State Highway Right of Way and must be re -- located immediately to a position back of new curbing and storm drainage systems to be constructed by the Highway Department as U. S. Highway 71 is widened;and WHEREAS, the estimated cost of said re -location is $45,000 and the cost of said relocation is not reimbursable by the Highway Department; and WHEREAS, failure to relocate these water and sewer facilities so that their continued use will be assured would render the water and sewer system incapable of supplying water to some 350 residential consumers, four industrial consumers and numerous small business consumers; and re. WHEREAS, failure to,{locate these water and sewer facilities would render the water and sewer system incapable of providing sewerage service to some 4,000 customers'and would, therefore, adversely affect the continuous operation of the waterworks and sewer system as revenue producing undertaking;•and WHEREAS, the waterworks and sewer contingency reserve fund has a current balance of $151,130 compared with a reserve requirement of $100,000 for said funds; and 9 • WHEREAS, monies for the above necessary unforeseen "emergency expenditures are not available from any other waterworks or sewer system related funds or any other waterworks and sewer system related revenue; and WHEREAS, the water and sewer construction fund balance has been obligated to pay contracts awarded for - construction of waterworks and sewer system facilities; and WHEREAS, the current rate of expenditures for waterworks and sewer system operations and debtobligations will reduce the v" watertiaorks "and" scorer operating fund_ balance to amounts substantially less than the amount needed for these emergencies by the end of the current fiscal year; and• WHEREAS, the resources of the waterworks and sewer system surplus revenue funds have been earmarked for construction of water and sewer facilities necessary for the development of the industrial park; NOW, THEREFORE, Bi -IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: 1. That the expenditure or transfer of $75,000 from the Waterworks and Sewer Contingency Reserve Fund is hereby authorized .to provide funds for the relocation of water and sewer.lines running parallel to U. S. Highway No. 71, and to provide adequate financing for the Phase III of the sewer construction project currently being undertaken by the Water and Sewer Department of the City of Fayetteville, Arkansas. BE IT FURTHER RESOLVED that the waterworks and sewer utility rates study now being conducted by Black and Veatch of Kansas City, Missouri, include in its schedule of necessary revenues an amount needed to restore the balance of the Waterworks. and Sewer Contingency Reserve Fund to $100,000 in addition to the amount needed to meet all operating, capital outlay and debt amortization and reserve requirements of Resolution 7-63, Ordinance 1508 and Ordinance 1653 of the City of Fayetteville, Arkansas.
