HomeMy WebLinkAbout33-68 RESOLUTIONRESOLUTION NO. am- It • A RESOLUTION APPROVING UNDERTAKING OF`GENERAL NEIGHBORHOOD RENEWAL PLAN AND FILING OF APPLICATION FOR FEDERAL ADVANCE OF FUNDS, AND RESCINDING RESOLUTIONS NOS. 27-66, 3-67, AND 28-68. ^"WHEREAS, under Title I of the Housing. Act of 1949, as amended, the Secretary of Housing and Urban Development may make advances o f funds to local public agencies for the preparation of General Neighborhood Renewal Plans for areas defined in Section 102(d) o f such Title where the interest of sound community planning makes it desirable that the urban renewal activities proposed. for the areas be planned in their entirety; and WHEREAS Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color or national origin under any program or activity receiving Federal financial assis- tance and Executive Order 11063 prohibits discrimination on the basis of race, color, creed or national origin in sale, lease o r other disposition of residential property (including land intended for residential use) or in.the use or occupancy thereof; and IA WHEREAS it is desirable and in the public interest that the Housing Authority,of the'City of Fayetteville, Arkansas prepare a General Neighborhood Renewal Plan, presently estimated to cost $94,215.00, in that certain area, herein designated a General Neighborhood Renewal Area, located in the City of Fayetteville, County of Washington, and State of Arkansas, and described as follows: Part of the West 1/2 of Section 22, part of the West 1/2 o f Section 15, part of the East 1/2 of Section 16 and part o f the East 1/2 of Section 21, all being in Township 16 North, Range 30 West, more particularly described as follows, to -wit: Beginning at the SE corner of the NE 1/4 of the NW 1/4 of Section 22, T -16-N, R -30-W, thence North to the NE corner of the SE 1/4 of the SW 1/4 of Section 15, T -16-N, R -30-W, thence West to the NW corner of the SE 1/4 of the SW 1/4 of Section 15, T -16-N, R -30-W, thence North to a point on the North boundary of Rock Street right-of-way, thence East to the Southeast corner of Lot 8, Block 4, Hills Addition, thence North three hundred e ighty-five (385) feet, more or less, thence East 1240 feet more or less, to a point 247.3 feet South and 150 feet West o f the NE corner of NE 1/4 of the SW 1/4 of Section 15, T -16-N, R -30-W, thence North to the NW corner of Lot 1, Block 1, Skillerns Sub -Division; thence West to the NE corner of Lot 10, Block 3, Skillerns Sub -Division; thence North to the NE corner of Lot 5, Block 1, Mcllroys Addition; thence West to the center line of Rollston Street, thence North along the center line of Rollston Street to the center line of Watson Street, thence West along the center line of Watson Street to the center line of Campbell Street, thence North along the center line of Campbell Street to -2- .-.--._.. .t, w 4 .. fn.. vJ ! . the center line of -Lafayette Street, .thence West along the center line of Lafayette Street to apoint located in the center of railroad right-of-way, thence Southeast along the center line of railroad right-of-way, three hundred sixty feet (360), more or less, thence South one thousand sixty feet (1,060), more or less, to a point in thecenter,of the railroad tracks, thence in a southerly direction with said railroad tracks to a point located at the intersection of said railroad track and a creek more particularly described as being 110 ±eet East, more or less, and 30 feet South, more or less, of the NE corner of the NW 1/4 of Section 21, T -16-N, R -30-W, thence South 70 feet, more or less, thence East to the Southwestcorner of Lot 6, Block 15, Ferguson's Addition, thence South to the Southwest corner of Lot 13, Block 17, Ferguson's Addi- tion, thence East to the Southeast corner of Lot 8, Block 6, Ferguson's Addition, thence North six hundred sixty feet (660), more or less, thence East to the Southeast corner of Lot 6, Block 4, Ferguson's Addition, thence North three hundred eight (308) feet, more or less, thence East three hundred eighty (380) feet, more or less, thence North 300 feet, more'or less, to the South right-of-way line of 7th Street, thence East along: 7th Street right-of- way line 930 feet, more or less, to the West right-of-way line of South College Avenue, thence South along the South College Avenue right-of-way line 2530 feet, more or less, to the North right-of-way line of Fifteenth Street, thence East along the Fifteenth Street right-of-way line to the SE corner of Lot 6, Block 7, Bert Dodd Addition, thence North to the NE corner of Lot 7, Block 3, Bert Dodd Addition, thence West to the NE corner of Lot 4, Block 3, Bert Dodd Addition, thence North to the SE corner of Lot 3, Block 4, Glen Wood Park Addition, thence East 800 feet, more or less, to the West right-of-way line of Wood Avenue, thence South along Wood Avenue right-of-way line 1150 feet, more or less, thence East along South lot lines of Block 1, McClinton Addition, to the point of beginning. WHEREAS, it is required that the Housing Authority of the - City of Fayetteville, Arkansas, in its undertaking of a .General Neighborhood Renewal Plan,conform more precisely to current criteria as established by the Department of Housing and Urban Development by this Resolution and, WHEREAS, this Resolution is in conflict with and should supersede certain Resolutions previously approved; accordingly Resolutions No. 27-66 dated October 17, 1966; No. 3-67 dated February 6, 1967; and No. 28-68 dated September 25, 1968 should be rescinded. -3 - NOW, THEREFORE, •BE .IT RESOLVED BY THE BOARD. OF DIRECTORS OF'THE''"-- CITY THE'"--CITY OF FAYETTEVILLE,ARKANSAS: 1. That the proposed .General Neighborhood Renewal Area des- cribed above is an area consisting of an urban .renewal area or areas which.is of such size that the urban renewal .activities in the urban renewal area or areas may have to be initiated in stages, consistent with thecapacity and'resources-of,the Housing. Authority of the City of Fayetteville, Arkansas, over an estimated period of not more than 8 years. 2. That the undertaking by4the Housing Authority ofthe City of Fayetteville,. Arkansasof the preparation of a'General Neighborhood Renewal'Plan fo`r the•General•Neighborhood.Renewal Area described above is hereby approved. 3. That it is cognizant of the intention of the Housing Authority of the City of Fayetteville,. Arkansas, to undertake an urban renewal project promptly upon completion of the General Neighborhood Renewal Plan and the preparation of an urban renewal plan for such project, which project shall embrace at .least 10 percent of the urban renewal area or areas within the .General Neighborhood Renewal Area and shall be of the character contemplated by Section 110.(c) of Title I. 4. That it is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title I, including those re- lating to (a) a feasible method of relocation, (b) the provision of necessary local -grants-in-aid, and (c) the prohibition of discri- mination because of race,color,creed, or national origin; as well as the. requirement of Section 102(d) of Title I that a General Neighborhood Renewal Plan conform to the locality's .general plan and Workable Program for Community Improvement. 5. That it is the intention of this body that the.General Neighborhood Renewal Plan will be used to the fullest extent feasible as a.guide for the provision of public improvements in the General Neighborhood Renewal. Area and that the Plan will .be considered in formulating codes and other regulatory measures affecting property in such Area and in undertaking other local governmental activities pertaining to the .development; redevelopment, and rehabilitation of the Area. 6. That the filing of an application of the Housing Authority of the City of Fayetteville, Arkansas for an advance of funds from the United States to enable it to defray the cost of preparing a General Neighborhood Renewal Plan for the proposed General Neigh- borhood Renewal Area described above is hereby approved. 7.
