RESOLUTION NO.
A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN
LANDS IN FEE SIMPLE FOR A SEWER LIFT STATION, AND AUTHORIZING AND
DIRECTING THE CONDEMNATION OF EASEMENTS FOR CONSTRUCTION, INSTALLATION
AND MAINTENANCE OF SEWER LINES AND APPURTENANCES THEREIN, AS .'A PART
OF PROJECT WPC -ARK 216.
WHEREAS, the City of Fayetteville, Arkansas is in the process
of Constructing Sanitary Sewerdimprovement Project, WPC -ARK 216,
necessitating fee simple title to certain lands in Washington County,
Arkansas for a sewer lift station and necessitating rights of way
and easements over certain lands in Washington County, Arkansas, for
construction; "installation and maintenance of'sewer lines, being
constructed under said Project. 1
NOW, THEREFOREe BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
SECTION,1. That for the purposes of constructing, erecting,
operating and maintaining (as more fully set forth in the contract
documents pertaining to said project) a sewer lift station, pursuant
to Sanitary Sewer Improvement Project WPC -ARK 216, the necessary lands
of the owners designated in Exhibit "A" to this Resolution be entered
upon and taken in fee simple, and the City Attorney -is hereby authorized
and directed to institute condemnation proceedings to acquire the nec-
essary lands in the manner required by law.
SECTION 2. That for the purposes of constructing, installing and
maintaining (and as more fully set forth in the contract documents
pertaining to said Project) sewer lines and all appurtenances thereto,
pursuant to Sanitary Sewer Improvement Project WPC -ARK 216 the nec-
essary easements and rights of way in the lands of the owners designated
in Exhibit "A" to this Resolution be entered upon and taken, and the
City Attorney is hereby authorized and directed to institute condemna-
tion proceedings to acquire said easements and rights of way in the
manner required by law.
SECTION 3. That as the questions in controversy in such
proceedings are likely to retard the progress of said construction,
the City Attorney is further authorized and directed to petition the
Court for permission to provide appropriate deposits with the Registry
of the Court for making compensation and payment of damages in order
that immediate possession of said lands may be secured and construction
proceed prior to assessment and payment of damages.

EXHIBIT "A"
LIFT STATION --FEE SIMPLE
OWNERS --George Hendrix, Sr., and Eula Hendrix, husband and
wife, and such other parties as appear of record to
have an interest in the lands.
EASEMENTS AND RIGHTS OF WAY:
1. Two 12 -inch lines, one being a forced main, and the other
being a gravity sanitary clay (interceptor) main.
OWNERS --George Hendrix, Sr., and Eula Hendrix, husband
and wife, and such other parties as appear Of
record to have an interest in the lands.
2. One 14 -inch sewer outfall line.
OWNERS --James K. Mahan and Jane Mahan, husband and wife, and
such other parties as appear of record to have an
interest in the lands.
