A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF
CERTAIN LANDS IN THE CITY OF FAYETTEVILLE, ARKANSAS, FOR USE IN
WIDENING AND IMPROVING HIGHWAY 265.
WHEREAS, the Arkansas Highway Commission is in the process
of widening and improving State Highway 265 (Job No. 9497) in the
City of Fayetteville, Arkansas, in consideration of which the
City of Fayetteville, Arkansas, has agreed to provide the necessary
right-of-way for this work; and certain lands in the City of
Fayetteville, Arkansas, are immediately necessary for the completion
of this work.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION T. That for the purposes of widening and improving
Highway 265 in the City of Fayetteville, Arkansas, including
construction of necessary bridges, abutments, and approaches thereto,
the necessary lands of the owners designated in Exhibit "A" to this
Resolution be entered upon and taken as right-of-way for said N1 ;rare
and the City Attorney is hereby authorized and directed to .
condemnation proceedings to acquire said lands in the manner provided
by law.
SECTION 2. That as the questions in controversy in such pro-
ceedings are likely to retard the progress of said construction,
the City Attorney is further authorized and directed to petition
the Court for permission to provide appropriate deposits with the
Registry of the Court for making compensation and payment ofamages,
in order that immediate posession of said lands may be secur,d and
construction proceed prior to asses ent and payment of damages.
