HomeMy WebLinkAbout20-65 RESOLUTIONIMP RESOLUTION NO4e 6c' • • • • A RESOLUTION TO ESTABLISH A HOUSING AUTHORITY FOR THE CITY OF FAYETTEVILLE, ARKANSAS, AND TO CONFER URBAN RENEWAL AND DEVELOPMENT -AUTHORITY UPON SAID HOUSING AUTHORITY, AND FOR OTHER PURPOSES. WHEREAS, under the provisions of Act 298, 1937 Acts of Arkansas, as amended, and Act 212, 1945 Acts of Arkansas, as amended, Housing Authorities were created in each City of the State of Arkansas, and vested with certain powers and authority pertaining to housing in said cities, and vested with certain urban renewal and development powers and authority in said cities, and WHEREAS, under the aforesaid Acts, as amended, before a Housing Authority of a city is empowered to transact any business or exercise the powers so authorized, the city must determine and declare by proper resolution that there is a need for an authority to function in said city and that it is in the public interest to elect for said authority to also have the powers conferred by said Acts, as amended, for urban renewal and development, and WHEREAS, the City Council of the City of Fayetteville, Arkansas, at a special meeting on December 28, 1961, by motion only, attempted to appoint a Board of Housing Authority and Urban Renewal, but did not by proper resolution make the neces- sary determinations and election to have powers, as required by law, in order to validly constitute said Housing Authority and confer housing, urban renewal and development powers thereon; and the Board so appointed at said special meeting, never having formally organized itself, transacted any business or exercised any powers, and not being validly established according to the Laws of Arkansas, it is deemed _in the best interest of the public to rescind the motion made at said special meeting, and proceed in the manner prescribed by law to establish a validly consti- tuted Housing Authority with the powers as aforesaid, and provide for the appointment of Commissioners of said Authority, and WHEREAS,_the City Council of the City of Fayetteville, Arkansas, finds that insanitary and unsafe inhabited dwelling accomodations exist in the "City of Fayetteville, Arkansas, and ,,that there is a shortage of safe or sanitary dwelling accomo- • 'dations in said City available to persons of low income at -rentals they can afford; and that there is a need for a Housing Authority in said City; and. that it is to the best interest of the public that the City of Fayetteville, Arkansas elect to have and confer upon said Housing Authority all such powers and s s141/4, • 2 r • • • authority pertaining to housing and urban renewal and development authorized by the aforesaid Acts, and 'amendments thereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: a SECTION 1. That,the motion at a special meeting of the City Council on December 28, 1961, attempting to appoint a,Board of Housing Authority and Urban Renewal be and the same is hereby rescinded and rendered of no effect whatsoever. SECTION 2. That a need is hereby determined and declared to exist for a Housing Authority in the City of Fayetteville, Arkansas; and that it is in the public interest that said Housing Authority have all powers authorized by Act 298, 1937 Acts of Arkansas, as amended, and Act 212, 1945 Acts of Arkansas, as amended, including powers of urban renewal and development. SECTION 3. That a, Housing Authority for the City of Fayetteville, Arkansas, is hereby established and determined to exist, and said Authority shall have and there is hereby vested in and conferred upon it all powers and authority authorized by Act 298, 1937 Acts of Arkansas, as amended, and Act 212, 1945 Acts of Arkansas, as amended, including powers of urban renewal and development. SECTION 4. That the Mayor of the City of Fayetteville, Arkansas, is hereby authorized and directed as provided in the Acts and amendments aforesaid to appoint five (5) persons as Commissioners of said Housing Authority, and to designate said Commissioners to serve for terms of one, two, three, four and five years, respectively, from the dateatof their appointment.
