RESOLUTION 7-61
WHEREAS, the City of Fayetteville, Arkansas, incorporated under the
laws of the State of Arkansas, plans additions to the Water Distribution
System, and
WHEREAS, these improvements include the crossing of the right-of-way
of the Saint Louis and. San Francisco Railway Company with a six-inch cast
iron water mainat their Mile Post 350, plus 38 poles, plus 30 feet, further
described as an East and West crossing at the projection of Poplar Street
across said right-of-way, and
WHEREAS, it is necessary for the City of Fayetteville and Saint Louis
and San Francisco Railway Company to enter into a written "Pipe Line
Contract" for the crossing of the said mainat this said location.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, OF
THE CITY OF FAYETTEVILLE, .ARKANSAS:
1. That the Mayor and City Clerk be and they are hereby authorized
to enter into a Pipe. Line. Contract in the name of the City of Fayetteville,
Arkansas, with the Saint Louis and San Francisco Railway Company for the
pipe line crossing at the above-described location and to bind. the City of
Fayetteville, Arkansas, to all the terms of the said Pipe Line Contract.
2. . That the consideration of Twenty -Five Dollars ($25.00) as a. one-
time payment to the Saint Louis and San Francisco Railway Company, as
stipulated in the Pipe Line Contract, isauthorized to be paid from Water
Department Funds.
