A RESOLUTION FINDING THAT IT IS TO THE BEST
INTEREST OF THE CITY OF FAYETTEVILLE,
ARKANSAS, THAT DRAINAGE IN A PORTION OF
THE CITY BE. IMPROVED.
WHEREAS, Arkansas Western Gas Company, among others, owns land
in a block of the City of Fayettevillebounded by East Maple Street on the
North, East Lafayette Street on the South, 1Vlission Boulevard on. the
West and Tanglewood Drive on the East, and
WHEREAS, a stream draining approximately eighty acres crosses the
aforesaidblock and has from. time to time during the past caused flood-
ing in this area after heavy rains.,. said flooding being aided and abetted
by the clogged condition of thenatural stream, and
WHEREAS, the City Council of the City of Fayetteville, Arkansas, for
the protection and for the health. and welfareof its citizens deems it
advisable that an improved drainage system from the said aforedescribed
block be provided,
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of
Fayetteville, Arkansas.:
Section 1. The. Arkansas Western GasCompanyisrequested,
authorized and directed to construct a. tunnel 8 feet wide and 4 feet high
under its property in said lands .for the handling and disposal of surplus
water normally travelling in the aforesaid creek as shown. on the attached
plat marked Exhibit "A".
,Section 2.. .The health, welfare and property of the citizens of
the City of Fayetteville, Arkansas, require that an improved drainage
system be installed as soon. as possible and that, therefore, an emergency
ishereby foundand declared to exist and this. resolution being necessary
for the'immediate preservationof the public peace, health and safety, shall
take effect and be in force from the dateof itspassage and approval.
