WHEREAS, it is the duty of the Fayetteville City Council to provide for the
public welfare, safety, oomfort and convenience of the inhabitants of the City of
Fayetteville, Arkansas, a Municipal Corporation, and
WHEREAS, applicable statutes of the State of Arkansas confer upon cities of
first olass the power to compel the owners of any property abutting on city streets
to build, rebuild, maintain and repair foot pavements or sidewalk improvements, and
to designate the kind of sidewalk to be made, the kind of material to be used, the
specifications to be followed, and the time within which such improvement is required
to be completed,
NCM, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That a complete list of the owners of property abutting on the east
side of Garland Avenue from ahmiamiStreet north to the Fayetteville City Limits which
list contains the legal desoriptions of said properties, is attached hereto marked
"Exhibit 4" and made a part of this Resolution as though set out herein word for word,

Section 2. That each of the property owners named in said "Exhibit A" is hereby
directed to build and construct a concrete sidewalk along the west side of their re-
spective property; that eaoh of said property owners shall undertake and commence
said sidewalk construction within thirty (30) days from the date of the service of
a certified copy of this resolution upon him or her; and that each of said respective
property owners shall have completed hie construction work within sixty (60) days
from the date of the service of a certified copy of this resolution upon him or her as
the case may be.
Section 3. That said sidewalk when oompleted shall be of concrete five (5)
inches thick and four (4) feet wide, commencing one (1) foot from the western edge
of the respeotive property lines and extending four (4) feet west toward the street
and shall meet the general specifioations required for grade and construction of
concrete walks in the City of Fayetteville, which specifications are of record in the
office of the City Engineer of the City of Fayetteville, Arkansas.
Section 4. That in the event construction is not arranged for and commenced by
said property owner or owners within thirty (30) days from the date of service of a
certified copy of this Resolution or in the event said oonstruotion is not completed
within sixty (60) days from the date of service of a certified copy of this resolution,
that the City of Fayetteville shall proceed to construct said sidewalk in accordance
with the specifications set forth and referred to in this Resolution by contract and
that a lien for the cost of said constructionitogether with a six percent (6%) penalty
shall constitute a charge against the respective owners of said property from the date
of commencement of said work.
