WHEREAS, by virtue of authority delegated to the City Electrician
to furnish a Code of Rules and Regulations governing and controlling
the -electrical work in the city of Fayetteville, Arkansas, by Ordinance
#759, and providing for the adoption of said•Rules and Regulations by
the City Council by a Resolution...
,BE IT THEREFORE RESOLVED, By the City Council of the City of Fay-
etteville,•A rkansas:
First: That the following Code of Rules and Regulations, consisting
of twelve consecutive sections shall constitute the Electric Code of
the City of Fayetteville, Arkansas:
SECTION 1.
The City Electrician is hereby authorized, empowered and directed to
regulate and supervise generally all electrical apparatus, machinery
and material, and the stringing, placing and attaching of electric light,
power and other electric wires of any nature whatsoever now or hereafter
placed in, and in any manner directly attached to any building, tent,.
or similar structure in the City of Fayetteville, Arkansas, and.inspect
and re-inspectall such electrical apparatus, machinery and wires which
he considers to be of sufficient importance or hazed to require such
inspection. The City Electrician is hereby vested with full authority
to enter any building or premises, subway or plant at any time in t ne
discnarge of his duties and to pass upon and decide any question arising
under the provisions of this Code and City Electrical Ordinance #759,
relative to the manner of construction or the materials and devices to.
be used.

SECTION 2:
Any person desiring to work as a Journeyman Electrician in the, City
of Fayetteville, Arkansas, shall make application to the City Electrician
in writing, for Journeyman Electrician's examination: When aforesaid
examination is successfully passed, the Board of Examiners shall issue
a certificate to above mentioned applicant, which certificate will entitle
the person who has successfully passed said examination, to a Journeyman
Electrician's license, which license may be obtained from the City

Collector, who is nericy authorized to grant the same to any person who
presents a certificate from the Board of Examiners showing that he is
qualified.
Any person, firm, partnership or corporation may secure a Master
Electrician's license from the City Collector, who is hereby authorized

to grant the same, upon payment of the proper fee therefor.and provided
surety bond as provided for by Ordinance Number 759, is given by the above
mentioned person, firm, partnership or corporation.
SECTION 3.
All electrical work in the city of Fayetteville, Arkansas, snail be
done 'under the direction of a licensed Journeyman Electrician, who shall
comply with all the requirements.of this Code and Ordinance #759.. No
electrical installation, contract, alteration, repair, or electrical• work
'of any nature shall be done in the city of Fayetteville, Arkansas, without
the presence of at least one Journeyman Electrician to direct the work
under such installation, contract, alteration or repair.
SECTION 4.
That approved surety bond as set out in Section 5 of Ordinance 4759
shall be furtner conditioned that any4person, firm, partnership or
corporation, shall, after 48 hours notice from the City Electrician,

reconstruct or repair any defective or faulty work caused by incompetent
workmen, inferior or non-standard material, that"bond for such purpose
shall be in force for one year after work of electrical construction,
repairs or installation is done, and one recovery shall not exhaust said
bond, but said bond shall be a continuous obligation against the sureties

thereon until the entire amount thereof shall have been exhausted;
That if the bond herein provided for and in Ordinance #759 snail be de-
creased on account of any recovery which may be obtained, the City Council
shall require upon notice of such fact, an additional bond to be given
by any such person, firm, partnership or corporation in an amount
sufficient when added to the unexpired amount of tne original bond to be
at all times equal to the sum of One Thousand ($1000.00) Dollars. The
City of Fayetteville may, for itself or for the use and benefit of any
person, by reason of failure to reconstruct or repair any defective
electrical work, maintain suit on said bond in any court having jurisdiction
thereof, or suit may be maintained thereon by any person by reason of
the failure of

SECTION 5.
No Master Electrician holding a Master Electrician's license, Shall
transfer same or allow the use of same directly or indirectly by any
otner person for the purpose -of -obtaining a permit to do any of the
electrical work herein specified. All licensed Master Electricians shall
file with the City Electrician tneir--correct address and telephone number
and any changes in address shall be immediately filed with the City
Electrician.
Where the holder of license changes the him name or where additional
members are taken into the. firm, or where firm is incorporated, a notice
of such changes shall be forwarded to the City Electrician.
SECTION b.
No Master Electrician or Journeyman Electrician shall enter upon the
erection, construction, alteration or change or any electrical installation,
machinery, work or wiring in the City of Fayetteville, until a permit has
been issued by the City Electrician, covering each installation to be
made, and when required by tne said City Electrician, plans and specifica-
tions for the proposed work must be filed with him before the permit is
granted. No permit will be issued to a Journeyman Electrician. .

No permit will be required for the installation of wires to operate
electric bells, gas iignting apparatus, house annunciators, burglar alarms,
telephone, telegraph, district messenger, watch, clock, fire alarm, or
other similar instruments if current operating same is less than 30 volts
potential.
When any wiring or apparatus is installed in such a manner that the
same could be used for electric light or power purposes under the pro-
visions of this Ordinance, it shall be deemed that the said wiring
apparatus is to be used for such purposes and permit shall be required
and inspection made as provided for such.
SECTION 7.
On written application made to the City Electrician by any Master
Electrician, who has secured a license as hereinbefore stated, it shall
be the duty of the City Electrician to issue a permit, permitting each
Master Electrician permission to install electrical wiring as set forth
in his application.
Fees to be paid the City Electrician by Master Electricians, will
be as follows:
For the first ten outlets, 25¢ each.
For the second ten outlets, 15¢ each.
For the third ten outlets, i0¢each.

All additional outlets, 5¢ eacn.
Tne minimum charge shall be $1.00. No inspection charge shall be
made for less than six outlets unless service entrance is installed.
Charge for entrance inspection shall be $1.00.
Charge will be made for eacn switch wnich controls one or more current -
consuming outlets.
Wnen outlets are moved from one location to another they shall be
considered as nem outlets.
Whenever additional trips are necessary to be made by the City
-.Electrician because of, defective workmanship, which would require additional
inspection, a charge of $1.00 will be made for each additional trip.
For inspection of apparatus for which no fee is prescribed, or other-
wise provided, a charge of $1.00 will be made.

That all money for each inspection snall be due the City Electrician
from the Master Electrician who has performed tne work, when final in-
spection has been made, the work accepted and final certificate issued
therefor.
SECTION S.
The City Electrician shall have, and is hereby given,authority to
refuse to issue a permit for the installation of electric wiring, as here-
in provided, or for any additions or extensions to any electrical wiring
in or on any building, where, in his estimation the wiring done or pro-
posed to be done, is unsafe or not in accordance with the providions of
this Code and Ordinance #759. If, after a permit is issued, tne work
installed under such permit for any reason does not comply with the
regulations of this Code and Ordinance #759, --elle City Electrician shall re-
fuse to issue a certificate of inspection.
No Electric Light and Power Company snail, connect to any
electrical installation of any kind whatsoever, except as provided in
Section #10, Ordinance #759, until furnished with a certificate of in-
spection or a permit for such connection duly executed by tne City
Electrician.
Provided, that all Electric Light and Power Companies shall upon
written notice from the City Electrician, disconnect from any circuit or
service designated by said notice and shall not reconnect to said circuit
or service except upon written notice from the City Electrician..
SECTION 9.
Wherever any electrical wiring or
other apparatus
id found by the
City Electrician to be unsafe, or defective, or in an insecure condition,
he snail notify the owner or person in control thereof it writing to re-
pair or remove tne defective wiring or apparatus and upon the owner's
failure to repair or remove same within such time as tne City Electrician
may deem necessary which time snail be stated in such written notice, the
said City Electrician snaii cause the service connected to such wiring or
apparatus to be disconnected. He snail report all violations of tnis
Section to the City Attorney for prosecution.

SECTION 10.
On inspecting the wiring of any building, the City Electrician shall
leave a tag or notice attached to service. This notice shall state clearly
whether the wiring is approved or is to be kept open for correction, and
if wiring is to be kept open for further inspection, no person shall
lathe, ceil or in any manner conceal any wiring until they are informed
that such wiring has been approved by .the City. Electrician. The general
contractor or owner shall be held responsible for any violation of this
Section. It shall be tne duty of the City Electrician to immediately
notify the Electrical Contractor of said defects, and defects shall be
corrected within twenty-four hours from said notice.
SECTION 11.
The City Electrician must, in all cases,. inspect any electrical
wiring within tne corporate limits of tne City of Fayetteville, within
twenty-four (24) hours ofreceipt of notice from the Electrical Wiring
Contractor (holidays and Sundays shall not be included in this time).
SECTION 12.
Ali electrical wiring for light, heat and power purposes hereafter to
be installed within the city of Fayetteville, and as respectively described
in the following sub -sections hereof, shall in all cases be installed as
described in said sub -sections, viz.
A. All electrical wiring in buildings within the fire districts shall
be made in rigid conduit, or metalic tubing, except connections, alterations
or extensions, made in any existing wiring system,•the extent of which
does not overload the circuits, so as to require a new entrance, such
work may be done ray the use of armored cable with proper fittings on repair
work to six outlets. If a new service switch is required, the work shall
be done in conduit.
B. Rigid conduit will be required on all service installation to
meter switches.
C. All supply wiring for electric signs shall be installed with lead -
covered wire in rigid conduit.
D. All apparatus installed in underground work, shall be in rigid
galvanized conduit and lead -covered wire pulled in.
E. All inside or outside wiring for decorative lighting, display
windows, and temporary work, provided, however, the City Electrician may
grant permission for a period designated by him for decorative display
lighting and temporary installation bay be installed with open wiring,
after which period designated has expired such installation shall be re-
moved.
F. Outside of the fire districts,approved knob and tube or flexible
conduit installations will'be permitted, provided, however, that such
installation is in accordance with the requirements of the National
Electric Code.
G. All current -consuming outlets, installed on main ceiling or side
walls, to be used for general illumination in store rooms, shall not be
more than four outlets to the circuit.
H. In no case shall there be more than twelve current -consuming
outlets allowed on any one circuit in any other classes of installation.
I. Service wire smaller than No. 10 shall not be used for entrance
to any business,warehouse or store.,building, where a one circuit installa-
tion is installed. Ail installations of more than one circuit shall be
governed by.tne rules and regulations of the National Electric Code.
J. Temporary electric wiring for lights in tents used for such purposes
as religious gatherings, shows, skating rinks, entertainments or gather-
ings of a similar nature may be installed by any person, provided however
that such wiring equipment and material are in strict accordance with,tne
rules and regulations of. the National Electric Code, and further provided
that entrance to such installations be installed under the direction of
a licensed Master Electrician as provided in this Code and Ordinance #759.
Y. Metalic tubing may be used on any work which does not conflict
with the National Underwriters Electric Code.
This esolution shall become effective and be in force from and after its
adoption and approval.
