WHEREAS, a petition signed by prrsons claiming to be a majority
in value of the owners of real property within Curb and Gutter'Distriot'
Number Thirty-eight of the City of Fayetteville, Arkansas, which district
was ]a yed off and designated and formed irnaer Ordinance No. 684 of the
city of Fayetteville for the purpose of improving by grading, rolling
and constructing curb and gutter upon North Walnut Avenue from the North
Line of Bast Maple Street to the North Line of Johnson Street; North
Olive4 Avenue from the North Line of Gunter Street to the South Line of
Johnson Street; Johnson Street from the East Line of North Walnut Avenue
to the West Line of North Mission Avenue and Gunter Street from the East
Line of North Walnut Avenue to the West Line of North Mission Avenue in
the City of Fayetteville, Arkansas, was duly filed with and presented to
the City Council of the City of Fayetteville, Arkansas, on the 28th day
of May 1928 asking that said improvement be undertaken and and that the
costs thereof be assessed and charged upon the real property situated
within such district.
WHEREAS-,Ttsaid�City..Council.-of,_the_City.r.of,Fayette-ville„Ark-
ansas did on the 28thday of May 1928 aforesaid order and direct the City
Clerk of said City of Fayetteville, Arkansas, to give notice by public-
ation once each week for two weeks in some newspaper published and having
a general circulation in the County of Washington, in which said City
of Fayetteville lies advising the property owners within said district
that such petition had been filed and that it would be considered and
heard at the City Hall on the 18th day of J&re 1928 beginning at 8:00
o'clock P. M. and thatall owners of real property within such district
shall be heard before the council for the purpose of determining whether
the signers of said petition constitute a majority in value of such
owners of--realrproperty-.in=said district t '"--- ='”
WHEREAS, it appears to the City Council of the City of Fay-
etteville, Arkansas aforesaid that said notice was published by the city
Clerk in accordance with law ani said resolution in the Fayetteville
Daily Democrat on the 30th day of May 1928 and the 6th day of June 1928.
WHEREAS, the time for hearing said petition has arrived and
said hearing has been duly and properly held.

OF FAYETTEVILLE, ARKANSAS.
SECTION ONE: That after a careful consideration the said city

SECTION THREE: That in determining whether those signing said
petition constitute a majority in value of the owners of real property
in said District the City Council of the said City of Fayetteville,
Arkansas, has been guided by the record of deeds in the office of the
Recorder of said County of Washington and has not considered any un-
recorded instruement as to the ownership of the real property and has
taken and been governed by the valuation placed upon said real property
as shown by the last assessment on file in the County Clerk's office
as to the valuation of the Real property in said Curb and Gutter Dis-
trict No. Thirty-eight.
SECTION FOU&:' That all resolutions and parts of resolutions
in conflict heretith be, and the same are hereby repealed and this
resolution shall be in full force and effect from and after its passage
and approval.
