HomeMy WebLinkAbout13-28 RESOLUTIONig- 020 R'ESOLUT ION WHEREAS, a petition signed by persons claiming to be a majority in value of the owners of real property within paving District No. 39 of the City of Fayetteville, Arkansas, which district was layed off and designated and formed under Ordinance No. 685 of the city of Fayetteville for the purpose of improving by grading, rolling and paving North Walnut`Avenue.sfr.omsthe Nor,,th.:Line of:East,4Maple-Street to_the._ North Line of Johnson Street; North Olive Avenue from the North Line of Gunter Street to the, South Line of Johnson Street; Johnson Street from the East line of North Walnut Avenue to the west Line of North Mission Avenue and Gunter Street from the East Line of North Walnut Avenue to t»e West Line of North Mission Avenue in the city of Fayetteville, Arkansas, was duly filed with and presented to the City Council of the City of Fayetteville, Arkansas on the 28th day of May 1928 asking that said improvement be undertaken and that the costs thereof be assessed and charged upon the real property situated within such district. WHEREAS, said City Council of the City of Fayetteville, Ark- ansas did on the 28th day of May 1928 aforesaid order and direct the City `Clerk `. of said City of Fayetteville, Arkansas to give notice by publication once each week for two weeks in some newspaper published and having a general circulation in the County of Washington, in which said City of Fayetteville lies advising the property owners within said district that such petition had been filed and that it would be considered and heard at the City Hall on the 18th day ofJiine 1928 be- ginning at 8:00 o'clock P. M. and that all owners of real property within such district shall be heard before the council for the purpose of determining whether the signers of said petition constitute a majority in value of such owners of real property:in said,distr.ict.. WmtREAS, it appears to the City Council of the City of Fay- etteville, Arkansas aforesaid that said notice was published by the city Clerk in accordance with law and said resolution in the Fayetteville Daily Democrat on the 30th Day of May 1928 and the 6th day of June 1928. WHEREAS, the time for hearing said petition has arrived and said hearing has been duly and properly held. NOW, THEREFORE, BE IT SOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS. ymal Page #2. SECTION ONE: That after a careful consideration the said city Council of the City of Fayettevile, Arkansas, finds that there is a ei total assessed valuation of $ 2 676 upon the real property within said paving District No. 39 as shown by the last county assessment on file in the office of the County 'Clerk of Washington County, Arkansas, _ :ander-that; persons .whoUaignedsaid .petitionn_real property with or? district as shown by the record of deeds in the office of the Recorder of said County of Washington of the assessed valuation of $ e3 4 U\ according to said assessment. SECTION TWO: That it is the finding of the said City Council of the City of Fayetteville, Arkansas, that the signers of said petition constitute a majority in value of the owners of real property within said paving District No. Thirty-nine of the City of Fayetteville, Ark- ansas. SECTION THREE: That in determining whether those signing said petition constitute a majority in value of the owners of real property �`in 'said"District the City -CoAcil-cF the said City of`F yetteville, Arkansas, has been guided by the record of deeds in the office of the Recorder of said County of Washington and has not considered any un- • recorded instruement as to the ownership of the real property and has taken and been governed by the valuation placed upon 'said real property as shown by the last county assessment on file in the County Clers office as to the valuation of the real property in said paving District No. Thirty-nine.
