WHEREAS; it is necessary for the pfeservation of the pavement along School
curbs -
Avenue in the Citrof Fayetteville, Arkansas, that oubd and gutters shall
be constructed along said street from Center Street to Dickson Street;
EBEREAS;some oftheowners of real property abutting on said School Avenue
have construoted such curbs and gutters; and
WHEREAS; such curbs and gutters have not been so eonstruoted•along the
property hereinafter described,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTE*
VILLE, ARXANSAS:
SECTION ONE:
That the City Clerk of the City of Fayettville, Arkansas be, and
he is hereby directed to issue notices to the owners of lots in Blocks Five (5)
Six (6), Nine (9), Ten (10), and Nineteen (19) abutting on Sohool Avenue, and
along which ourbs and gutters have not been constructed, directing said owners

to construct suoh curbs and gutters within i0 days from the date/Of said
notices upon said owners, or agents thereof;
SECTION TWO:
• That incase any of said owners,refuse or fail to comply with the
requirement set forth in Section One hereof, the City of Fayetteville ,444/
may contract with some suitable person to construct said curbs and gutters,
after having first given ten.(10) days notice of their intention to do soil and
the cost thereof together with 6 per ountum penalty shall be charged against
said owners, and shall constitute a lien against said property under the pro-
visions of section 7748 Crawford & Moses Digest -of the laws of the State of
Arkansas.

SECTION THREE:
That this resolution shall take effect and be in force from
and after its passage and approval, and that all resolutions or parte of
resolutions in conflict herewith be, and the same are hereby repealed.
