WHEREAS, there has been formed in the City of Fayetteville, Arkan-
sas, an Improvement District, known as. Hill Avenue Improvement District
Number One of the City of Fayetteville, Arkansas, for the purpose of
paving South Hill Avenue, from the North line of Wall Street to the
North line of West Center Street, and West Center Street, from the
East line ofHill Avenue,.to.the West line of University Avenue;1
WHEREAS, said Improvement District did not provide for curbing
along the pavement to be constructed on said streets and parts of
streets above mentioned;
WHEREAS, for the purpose of protecting said pavement, it is
highly necessary that curbing be placed along the sides of said
pavement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO UNCI L OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
SECTION ONE: That the owners of property abutting on the
streets and parts of streets to be paved within Hill Avenue Im-
provement District Number One of the City of Fayetteville, Arkan-
sas.,_.are_hereby,required to build curbing along the sides of said
streets and parts of streets;
SECTION TWO: That the said curbing shall be made of concrete,
and in the manner and form required by specifications to be furn-
ished by the City Engineer of the City of Fayetteville, Arkansas;
SECTION THREE: That said work shall be commenced by each of
such property owners within thirty days from the passage of this
Resolution;
SECTION FOUR: That if any owner of such property shall. fail
or refuse to comply with the provisions of this Resolution in the
manner and within the time herein prescribed, the said City of
Fayetteville, Arkansas,may contract with some suitable person
for the construction"of said curbing on the best-termstthat can.
be made, after giving reasonable notice to such owner or the agent
in charge of said property, of an intention to do so. And said

City of Fayetteville, Arkansas, may pay said person for so constructing
said curbing, and the amount so paid, together with six (6) percentum
penalty added thereto, shall constitute a charge against the owner of
said property, and said charge shall be a lien on said property from
the date of the commencement of said work, and same shall be collected
in the manner and form provided by statute in such cases made and
provided. -
SECTION FIVE: That the City Clerk of the City of Fayetteville,
Arkansas, be, and heris hereby required, to issue and cause to be served
a notice upon each of the property owners within the Improvement District
herein mentioned, advising them of the passage of this Resolution and.
stating in substance the provisions thereof.
