BID WAIVER FOR LIGHT POLES & FIXTURES:
AN ORDINANCE TO WAIVE THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING AND
AUTHORIZE THE PURCHASE OF STREET LIGHT POLES AND FIXTURES MANUFACTURED BY
AMERLUX EXTERIOR, LLC FROM THE SOLE REGIONAL DISTRIBUTOR, PREMIER LIGHTING
GROUP, INC., IN AN AMOUNT NOT TO EXCEED $210,500.00 FOR CITY-WIDE
TRANSPORTATION INFRASTRUCTURE PROJECTS THROUGH DECEMBER 31, 2020.
WHEREAS, the City Council has previously authorized the purchase of street light poles and fixtures
manufactured by Dynamic Lighting, Inc. and its successor, Amerlux Exterior, LLC, and has installed
these unique street light poles and fixtures in the downtown area; and
WHEREAS, in order to remain consistent with existing, previously installed street light poles and fixtures
in the downtown area, the purchase of additional matching street light poles and fixtures from the sole
regional distributor for other city-wide transportation infrastructure projects is necessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby finds that such
circumstances constitute an exceptional situation where competitive bidding is deemed not feasible or
practical, and therefore waives the requirements of formal competitive bidding and authorizes the purchase
of street light poles and fixtures manufactured by Amerlux Exterior, LLC from the sole regional distributor,
Premier Lighting Group, Inc., in an amount not to exceed $210,500.00 for city-wide transportation
infrastructure projects through December 31, 2020.

SUBJECT: Bid Waiver for Light Poles & Fixtures
RECOMMENDATION:
An ordinance waiving the requirements of formal competitive bidding for the purchase of light
poles and fixtures for transportation infrastructure projects.
BACKGROUND:
The College Avenue project is a necessary part of the City's continued effort to make
Fayetteville's neighborhoods walkable by 2030. Enhancements include installation of decorative
street lights.
DISCUSSION:
In order to remain consistent with the existing light poles and fixtures in the downtown area, the
purchase of materials manufactured by Dynamic Lighting, Inc. and distributed by Amerlux
Exterior, LLC will be necessary.
Staff recommends waiving the requirements of formal competitive bidding and approving the
purchase of Dynamic Lighting, Inc. light poles and fixtures as needed for transportation
infrastructure projects.
BUDGET/STAFF IMPACT:
Transportation Bond Fund is providing funding for this street enhancement project.
