ENACTING FURTHER LANGUAGE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section I.—That the City Council of the City of Fayetteville, Arkansas hereby amends § 150.02 Purpose of the
U.D.C. by placing all existing language in subsection (A) and enacting a new subsection (B) as shown below:
"(B) The primary purpose of the Unified Development Code remains to protect the peace, health, safety and
general welfare of Fayetteville residents by reasonable regulations upon development enacted to promote
purposes including, but not limited to, all statutorily approved purposes found in A.C.A. § 14-56-403 Purpose of
plans."

SUBJECT: ADM 15-5195: Administrative Changes to UDC Section 150.02 Purpose:
Submitted by CITY PLANNING STAFF for administrative revisions to Fayetteville
Unified Development Code Section 150.02.
RECOMMENDATION:
Staff recommends approval of an ordinance to amend Section 150.02 of the Unified Development
Code.
BACKGROUND and DISCUSSION:
Staff recommends changes to update and clarify the general Purpose statement of the Unified
Development Code as follows:
■ Section 150.02 — Repeal and replace this section to clarify and explain more adequately
that the Unified Development Code is designed primarily to protect and further the health,
safety or welfare of Fayetteville citizens and to carry out the adopted plans of the City.

TITLE XV UNIFIED DEVELOPMENT CODE
CHAPTER 150: GENERAL PROVISIONS
(A) The Unified Development Code is designed to carry out and protect the
Comprehensive Land Use Plan the Master Street Plan and all other adopted plans of the
City of Fayetteville all of which are designed to protect and further the health, safety or
welfare of Fayetteville citizens.
(B) The Unified Development Code is further designed and intended to protect the
health safety or welfare of our citizens by setting forth the procedures, requirements and
minimum standards necessary to promote reasonable, orderly, and beneficial zoning and
development to moderate street congestion, to enhance aesthetic quality and good civic
design and to fulfill the intent and purposes of municipal planning as set forth in A.C.A.
14-56-403.
(C) The Unified Development Code is further intended to protect the health, safety or
welfare of our citizens by reducing the dangers from fire, flood, erosion, and pollution; by
encouraging infill and affordable housing while protecting established neighborhoods; by
encouraging quality commercial industrial and mixed use growth while ensuring any
necessary protection or buffering for residential neighborhoods all to ensure that
Fayetteville citizens enjoy a high quality of life in a vibrant and livable community.
