AN ORDINANCE TO AMEND § 72.34 PARKING SIGNS OR CURB
MARKINGS REQUIRED OF THE FAYETTEVILLE CODE TO
AUTHORIZE THE TRAFFIC SUPERINTENDENT TO ERECT SIGNS OR
PAINT CURBS INDICATING A NO PARKING ZONE WHERE NECESSARY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby repeals § 72.34 of
the Fayetteville Code in its entirety and enacts a replacement § 72.34 as shown below:
"72.34 Parking Signs Or Curb Markings Authorized
Whenever the Fayetteville Code imposes a parking time limit or prohibits or limits parking or
stopping on any street or part of street, the Traffic Superintendent shall be authorized where
necessary to erect signs or to paint curb markings on such street or part of street giving notice
thereof."

SUBJECT: §72.34 to Authorize Traffic Superintendent to install signs and paint curbs
when necessary
RECOMMENDATION:
The Administration recommends that the City Council pass this proposed ordinance to
authorize the Traffic Superintendent to use his or her best judgment about where no or limited
parking or stopping signs & markings should be placed..
BACKGROUND:
The existing, old section of the current code is likely an out-of-date remnant city code. The
current ordinance §72.34 Parking Signs or Curb Markings Required, - states that "whenever a
provision of the chapter prohibits parking times on a street or part of a street, it shall be the duty
of the traffic superintendent to erect appropriate signs or to paint appropriate curb markings on
such streets or part of streets giving notice thereof, and no such regulations shall be effective
unless such signs are erected or such curb markings are painted and in place on the side or
sides of the street or part of street when parking time is limited or prohibited. "
DISCUSSION:
The cost of paint and staff time to regularly paint restricted areas throughout the entire city could
be significant without an ordinance change. Additionally, the ascetics of all city streets to be
painted should such an ordinance like restricted parking in front of mailboxes be passed could
cause yellow and red paintings that visually negatively impact our Ozark Mountain natural
neighborhood settings. We recommend giving the Traffic Superintendent the flexibility using
their best judgement. This would allow them to determine in areas of extensive traffic or high
pedestrian usage, or fire hydrant access, where markings for safety should be considered and
placed — markings could be done. In other areas such as of stop signs on residential streets, or
mailboxes areas in neighborhoods, the Traffic Superintendent would have the flexibility to waive
the painting of those areas.
BUDGET/STAFF IMPACT:
The budget impact of regular painting all areas and routinely conducting this activity annually
could be financially significant in both staff time and paint supplies. This would allow the city to
only incur those cost where required for clarity and safety purposes.
