AN ORDINANCE TO AMEND § 172.10 BICYCLE PARKING RACK
REQUIREMENTS (D)(2)(e) TO REDUCE THE MINIMUM CLEARANCE
TO A FIRE HYDRANT FROM 15 FEET TO 6 FEET
WHEREAS, in response to requests from business owners in downtown Fayetteville for
increases bicycle parking, the Development Services Department after consultation with the
Fayetteville Fire Marshall recommends amending § 172.10 (D)(2)(e) to reduce the required
separation distance of a bicycle rack to a fire hydrant from 15 feet to 6 feet.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby amends §
172.10 (D)(2)(e) of the Unified Development Code by repealing this subsection in its entirety
and enacting a replacement subsection as follows:
"172.10 (D)(2)(e) Bicycle parking racks shall have a six foot (6') minimum clearance
from the edge of fire hydrants."

Subject: ADM 13-4408: UDC Amendment: Bicycle Parking Requirements
RECOMMENDATION
Staff and the Planning Commission recommend approval of an ordinance to amend Chapter 172: PARKING AND
LOADING of the Fayetteville Unified Developement Code to add flexibility to staff review of bicycle parking rack
location requirements and to reduce minimum separation requirements between racks and fire apparatus.
BACKGROUND
Sustainability and Planning staff have been working to increase the amount of bicycle parking in downtown
Fayetteville after being approached by two groups of business owners who identified a lack of adequate parking for
customers and employees. Working in conjunction with the Transportation Department, Sustainability and Strategic
Planning staff has overseen the installation of approximately 19 new racks around and near the Fayetteville Square.
An additional 23 bicycle racks are planned for future installation on Dickson and Spring streets.
While scouting locations, a large area of open sidewalk was identified on the corner of Block and Meadow Streets
that was be planned for bicycle parking when improvements were made to Block Street. A fire hydrant location was
changed in the field, thereby making the planned location inappropriate according to the Unified Development Code
(UDC)being amended here.
The UDC calls for a minimum clearance of 15 feet between fire hydrants and bicycle parking racks.
This case is specific but it has the potential to benefit additional sites in the future, especially on Dickson Street
where it can be difficult to meet all the code requirements relating to bicycle rack location.
The City Engineering Department and the Fire Marshal have reviewed the proposed changes and their comments are
reflected in the proposed ordinance amendments.

The following is a list of the changes proposed:
Chapter 172: Parking and Loading. Specifically, 172.10 Bicycle Parking Rack Requirements
• Add language allowing the review of bicycle parking rack locations by staff designated by the City Engineer.
• Reduce minimum separation between fire hydrants and bicycle parking racks from 15'0"to 6'-0"measured from
the edge of fire hydrants.
• Add language requiring minimum separation between fire department connections (FDC) and bicycle parking
racks from 15'0"to 6'-0"
DISCUSSION
These amendments were heard at the June 18, 2013 Planning Commission meeting, at which the Planning
Commission voted 9-0-0 in favor of a recommendation of approval for ADM 13-4408.

location requirements and review.
Planning Staff
BACKGROUND
172.10(D)(2)(d) states that bicycle parking racks should not be located within bus stops,
loading zones, or other curb space where on-street parking is permitted unless approved by
the City Engineer. In practice, all bicycle parking is reviewed by the planning division and
the Sidewalk Administrator (Engineering Division) for compliance with all relevant codes.
The proposed change would formalize this arrangement, allowing the City Engineer to
delegate review of proposed bicycle parking to his designee.
In addition, the Fayetteville Unified Development Code Section 172.10(D)(2)(e) requires a
minimum clearance of 15'-0" from the edge of fire hydrants. The 2007 Arkansas Fire
Prevention Code requires a Y-0" clear space around the circumference of all fire hydrants
(Section 508.5.5). Staff feels that the UDC requirement is unnecessarily restrictive, and
proposes that the minimum clearance be reduced to 6'-0". The additional Y-0" requirement
over and above the minimum clearance required by the 2007 Arkansas Fire Prevention Code
provides additional clearance for bicycles.
PROPOSAL
The proposed code amendment under UDC Chapter 172.10 (D)(2)(d) requires review of
bicycle parking rack locations by the City Engineer or his designee.
The proposed code amendments change the City's minimum clearance requirement
surrounding fire hydrants under UDC Chapter 172.10 (D)(2)(e) from 15'-0" to 6'-0".
Language creating minimum clearance around fire department connections (FDC) has also
been added.
The proposed code changes are shown in st,�o and highlight/underline in the attached
document. The phrase "Subdivision Regulations" has been added to clarify the overall
regulations for subdivisions outside the City limits.
