IN THE AMOUNT OF $41,072.69 FOR THE CONSTRUCTION OF EXTRA- WIDE SIDEWALK TO ACCOMMODATE A FUTURE TRAIL EXTENSION WHEREAS,Neal Hefner Construction Company, Inc., on behalf of G&C Family LLC is in the process of improving property located at 2518 W. Martin Luther King Jr. Boulevard, including remodeling the building, adding a new driveway with parking and removing the existing driveway near Martin Luther King Jr. Boulevard, and WHEREAS, part of the City-required improvements include construction of 241 feet of sidewalk five (5) feet wide, however the location of the new sidewalk is also on the Fayetteville Alternative Transportation Trails Master Plan as a section of Shiloh Trail, which will extend from Garland Avenue to Cato Springs Road along the west side of I-540, and WHEREAS, due to topography and limited space at the site, it is critically important to incorporate extra-wide sidewalks of twelve (12) feet wide to accommodate the future Shiloh Trail at the same time as the current improvements are undertaken, and WHEREAS, a cost-share agreement whereby the City pays the difference in cost between the City-required five (5) foot wide sidewalk and the desired twelve (12) foot wide sidewalk to accommodate Shiloh Trail is the most cost-efficient way, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines the above-stated facts constitute an exceptional situation in which competitive bidding is deemed not feasible or practical and therefore waives the requirements of formal competitive bidding and approves a cost-share agreement with Neal Hefner Construction Company, Inc. in the amount of $41,072.69 for the construction of approximately 366 feet of sidewalk twelve (12) feet wide, to accommodate the future Shiloh Trail. RECOMMENDATION Staff recommends approval of a cost-share and bid waiver in the amount of$41,072.69 with Neal Hefner Construction Company, Inc., for the construction of approximately 366'of 12'wide sidewalk. PROPOSAL: G&C Family LLC is in the process of upgrading their property at 2518 W.Martin Luther King Jr.Blvd for an Automatic Auto Finance business. The property improvements include remodeling of the building, adding a new driveway with parking and removing of the existing driveway near Martin Luther King Jr.Blvd. As part of the improvements, 241 linear feet of 5' sidewalk is required. The location of the new sidewalk is also on the Fayetteville Alternative Transportation and Trails(FATT)Master Plan as a section of Shiloh Trail that will extend from Garland to Cato Springs Road along the west side of I-540. Due to the topography and limited space on the site,it is critical to incorporate the widened sidewalk at the time of these improvements. Jorgenson&Associates Engineers has designed the wide sidewalk to meet City standards and the owner is agreeable to a cost share to allow their contractor,Neal Hefner Construction Company, Inc.to install the wide sidewalk. The owner has also agreed to provide an easement to accommodate the widened sidewalk. Neal Hefner Construction Company, Inc. has provided a letter with the detailed cost analysis included in the packet. Staff has reviewed the estimate and determined the cost to be acceptable when factoring in the challenging site and donation of the necessary easement. Of the 366 linear feet of the proposed 12 wide sidewalk, 241 linear feet is required as 5 foot wide sidewalk,therefore the value for 241 linear feet of 5 foot wide sidewalk has been deducted from the cost share. BUDGET IMPACT: Sufficient funds in the amount of $41,072.69 are available for cost share improvements from street right of way intersection cost sharing account. ORDINANCE NO.
