RECOMMENDATION: The Planning Commission and staff recommend approval of an ordinance to vacate a drainage easement. BACKGROUND: The subject drainage easement is located in the Falcon Ridge Subdivision, which is south of Huntsville Road between Hunt Lane and Tallgrass Drive. The easement crosses through Lots 57- 60 and ends on Lot 1. The easement was dedicated to the City of Fayetteville in 2001, but there is no drainage infrastructure located within the easement. The easement was not shown on the civil plans presented for the Falcon Ridge Subdivision and it was not reflected on the filed final plat in 2008. The owner of Lot 59 has applied for a building permit, but the drainage easement prohibits any structure from being located on the property. The owners of the lots impacted by the drainage easement are requesting to vacate the easement. All of the necessary storm pipes installed in the subdivision are located within other dedicated easements or within the public right-of-way. DISCUSSION: On September 28, 2015 the Planning Commission forwarded this item to the City Council with a recommendation for approval with a vote of 8-0-0 as a consent item.
