AN ORDINANCE TO APPROVE VAC 15-5206 SUBMITTED BY JORGENSEN AND ASSOCIATES, INC.
FOR PROPERTY LOCATED AT 5026 E. TALON TRAIL TO VACATE A DRAINAGE EASEMENT
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or portions
thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described drainage easement is not required for
corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby vacates the drainage easement as
described in Exhibits A and B attached hereto.
Section 2. A copy of this Ordinance duly certified by the City Clerk along with the map attached hereto as
Exhibit A shall be filed in the office of the Washington County Circuit Clerk.

RECOMMENDATION:
The Planning Commission and staff recommend approval of an ordinance to vacate a drainage
easement.
BACKGROUND:
The subject drainage easement is located in the Falcon Ridge Subdivision, which is south of
Huntsville Road between Hunt Lane and Tallgrass Drive. The easement crosses through Lots 57-
60 and ends on Lot 1.
The easement was dedicated to the City of Fayetteville in 2001, but there is no drainage
infrastructure located within the easement. The easement was not shown on the civil plans
presented for the Falcon Ridge Subdivision and it was not reflected on the filed final plat in 2008.
The owner of Lot 59 has applied for a building permit, but the drainage easement prohibits any
structure from being located on the property.
The owners of the lots impacted by the drainage easement are requesting to vacate the
easement. All of the necessary storm pipes installed in the subdivision are located within other
dedicated easements or within the public right-of-way.
DISCUSSION:
On September 28, 2015 the Planning Commission forwarded this item to the City Council with a
recommendation for approval with a vote of 8-0-0 as a consent item.
