RECOMMENDATION:
The Planning Commission and staff recommend approval of an ordinance to rezone the property
to RSF-4, Residential Single Family, 4 Units per Acre, and P-1, Institutional.
BACKGROUND:
The subject properties are located at 1220 and 1226 W. Cleveland, 725, 727, and 805 Hall
Avenue and consist of six (6) parcels containing a total area of approximately 2.71 acres and are
zoned R-PZD-Project Cleveland. The PZD was approved on June 19, 2012, for 122 multi -family
units with a condition that Phase I receive all permits within 18 months of City Council approval.
This requirement has not been met, and the PZD expired on December 19, 2014. Prior to the
PZD zoning the properties were zoned RSF-4 and RMF-40.
The properties are currently being developed with a parking lot after it was purchased by the
University of Arkansas in May of 2013, and one lot contains a single family residence owned by
a private property owner.
DISCUSSION:
On September 14, 2015 the Planning Commission forwarded this item to the City Council with a
recommendation for approval by a vote of 9-0-0.

Request The request is to rezone the properties from R-PZD, Residential Planned Zoning
District -Project Cleveland to RSF-4, Residential Single Family and P-1, Institutional. The
University owned property would be zoned P-1 and the single family residence would be zoned
RSF-4.
Public Comment: Staff has received public comment from one individual requesting clarification
only. The property owner was notified of the rezone request through certified mail on July 31,
2015. The owner has contacted staff and stated the proposed rezone is acceptable.
INFRASTRUCTURE:
Streets: The subject parcel has access to Cleveland Street and Hall Avenue. Both are
improved roads with existing curb/gutter and sidewalk through the subject parcel
areas. However, the existing sidewalk and curb and gutter are in poor condition,
and do not meet Master Street Plan dimensions. Any required improvements to
these streets will be determined at time of development.
Water: A 6" diameter public water main and 8" public sewer main are available to the
subject parcels in along Cleveland and Hall. Existing utilities in the area should
have ample capacity for the proposed use of the property. If additional capacity
is necessary, it shall be the responsibility of the developer, and the time of
development.

Drainage: Any additional improvements or requirements for drainage will be determined at
time of development. This parcel does not lie within the 100-yr floodplain,
streamside protection areas, or the Hillside/Hilltop Overlay District.
Fire: The Fire Department did not express any concerns with the request.
Police: The Police Department did not express any concerns with this request.
CITY PLAN 2025 FUTURE LAND USE PLAN: City Plan 2030 Future Land Use Plan designates
the properties within the proposed rezone as City Neighborhood Area. These areas are more
densely developed than residential neighborhood areas and provide a varying mix of
nonresidential and residential uses. This designation supports the widest spectrum of uses and
encourages density in all housing types.
FINDINGS OF THE STAFF
RECOMMENDATION: Staff recommends RZN 15-5156 be forwarded to City Council with a
recommendation for approval, finding that the proposed zoning will remove the expired and
outdated PZD zoning and allow development compatible with the existing adjacent uses and
consistent with the Future Land Use Plan.

1. A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: Land Use Compatibility: The proposed zoning is compatible with the
surrounding mixture of single-family and institutional uses. The site has
contained a multi -family development until recently when the University of
Arkansas purchased the land in May of 2013. The University is currently
developing a parking lot. The University is not subject to the City zoning or
development code. The site is immediately adjacent to a residential
neighborhood to the north, a public school to the east, fraternity housing to
the west, and U of A campus student housing to the south.
Land Use Plan Analysis: The proposed zoning is compatible with the Future
Land Use Map (FLUM) which designates this property as City Neighborhood
Area.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: In staff's opinion, the requested RSF-4 and P-1 zoning districts are justified
at this time and the properties are currently within an expired Planned
Zoning District and effectively have no zoning.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: Rezoning the properties will not likely increase traffic danger or congestion.
The U of A parking development on the site is separate and not within the
City of Fayetteville jurisdiction. With the U of A parking lot the traffic counts
are expected to increase, however the proposed zoning will not factor into
those increased counts.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: Rezoning the property from R-PZD to RSF-4 and P-1 will decrease the
potential population density or load on public services. The Police and Fire

Departments have expressed no objections to the proposal. The Cleveland
Street PZD was approved with a density much higher than that allowed
within the proposed zoning districts.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the
proposed zoning is not desirable.

RE: Expired PZD-Cleveland Project Rezone
Dear Planning Commission and City Council Members:
Please accept this letter as a request for rezoning of 6 lots located at 1220 & 1226 W. Cleveland
Street and 725, 7274, & 805 Hall Ave. The lots are owned by the University of Arkansas and
Charles & Marianne Baxter. The land is associated with an Expired PZD and City Staff are
recommending a rezone to P-1, Institutional, and RSF-4, Residential Single Family, 4 Units per
acre.
In order to remove this expired PZD and bring the properties into a zoning district that is more
compatible to the area and the current use of the land, the City Planning Staff are proposing to
rezone the properties back to RSF-4, Residential Single Family, 4 Units per acre and P-1,
Institutional. This change will have little to no effect on the surrounding properties. Moreover, the
change will not increase traffic danger or congestions nor will it impact public services due to
population density increases.

Dear Property Owner:
This letter is in reference to your property, parcel # 765-02591-000. Your property, along with
others adjacent to it, were originally included in the previously approved and currently expired
PZD — Cleveland Project. These properties were rezoned to a PZD by the property owners prior
to the current owners, which now includes the University of Arkansas.
In order to remove this expired PZD and bring the properties into a zoning district that is more
compatible to the area and the current use of the land, the City of Fayetteville is proposing to
rezone your property back to RSF-4, Residential Single Family, 4 Units per acre. A map of the
area to be proposed for rezoning is attached, along with a copy of the zoning map of the area.
If you would like to provide comments or feedback to the City Planning Division about rezoning
your property before we submit an application, please contact me by August 17, 2015. If the
rezoning goes as planned the proposal will be discussed at the Planning Commission meeting on
September 14, 2015. You are free to discuss the rezoning with me any time and will be welcome
to speak at the public hearing(s).
