AN ORDINANCE AMENDING §33.046 PROVIDING FIRE PROTECTION
SERVICES OUTSIDE THE CITY AND §33.050 RESPONSE TO
HAZARDOUS MATERIALS INCIDENTS OF THE CODE OF
FAYETTEVILLE TO MODIFY INTERLOCAL IN MUTUAL -AID
PROVISIONS AND TO INCREASE RATES CHARGED FOR FIRE
PROTECTION, SEARCH AND RESCUE AND HAZARDOUS MATERIALS
RESPONSE SERVICES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends
§33.046 Providing Fire Protection Services Outside the City so that after amendment, the
section shall read as follows:
"33.046 Providing Fire Protection and Search and Rescue Response Services
Outside the City
The city fire department shall not provide fire protection or search and rescue response
services beyond the corporate limits and shall not combat any fire located outside the corporate
limits except pursuant to:
(A) A mutual aid agreement, approved by the City Council, with another municipal
corporation or any duly organized firefighting or search and rescue organization in the United
States.
(B) The city fire department shall have the right to refuse to respond to any fire or search
and rescue located outside the city's corporate limits if, in the judgment of the fire chief,

or authorized representative, fire protection or search and rescue response within the city
would be impaired."
(C) Rates, reimbursements, collections and records.
(1) The Fayetteville Fire Department is hereby authorized to bill and collect from
recipients of services for all costs incurred by the fire department responding to firefighting or
search and rescue incidents, including but not limited to:
(a) A charge of $400.00 for the first hour and $200.00 for each additional hour for each
major piece of fire apparatus which responds to the incident;
(b) An hourly charge equivalent to the regular hourly pay for each hour that each on -duty
employee of the fire department spends in response to and/or on the scene of the incident, and
the regular time and one-half rate of pay for each hour that each off -duty employee of the fire
department spends in response to and/or on the scene of the incident;
(c) The replacement costs of all expendable equipment and supplies used by the fire
department in managing and mitigating the incident including any equipment damaged or made
unusable by contamination; and
(d) All costs incurred by the fire department for any labor, materials, or supplies provided
by third parties at the request of the Fayetteville Fire Department, including but not limited to,
any mutual aid agreement, local government entities, business and industrial facilities,
specialists, consultants, and utilities and any other costs necessary to manage and mitigate the
incident.
(2) The fire chief, or the fire chief s designated representative, shall collect charges due
the city for the provision of firefighting or search and rescue incident services and shall:
(a) Prepare and issue statements for charges to persons, corporations, partnerships or any
other entities, who are provided firefighting or search and rescue services under this section;
(b) File suit to collect delinquent charges due within a reasonable time after the service is
provided;
(c) Maintain adequate records, which shall contain the following information:
(i) Date;
(ii) Funds collected for services rendered;
(iii) Accounts receivable;
(iv) Unpaid charges; and

(v) Such other information as may be required by officials of the city."
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby amends
§33.050 Response to Hazardous Materials Incidents so that after amendment, the section shall
read as follows:
"33.050 Response to Hazardous Materials Incidents
(A) The Fayetteville Fire Department is hereby authorized to respond to hazardous
materials incidents inside the city, outside the city where contracts for fire protection with the
city exist and outside the city upon a call for assistance from another fire department pursuant to
the Interlocal Cooperation Agreement for Hazardous Materials Incident Response Services in
Washington County, or any other mutual aid agreement or program requiring a hazardous
materials incident response.
(B) As used in this section, "hazardous materials incident" shall mean any incident
involving the release, spill, leak or other undesirable accumulation of any substance for which a
Material Safety Data Sheet (MSDS) is required under §311 of the Emergency Planning and
Community Right -To -Know Act of 1986 (Public Law 99-499).
(C) Rates, reimbursements, collections and records.
(1) The Fayetteville Fire Department is hereby authorized to bill and collect from
recipients of services for all costs incurred by the fire department responding to a hazardous
materials incident, including but not limited to:
(a) A charge of $400.00 for the first hour and $200.00 for each additional hour for each
major piece of fire apparatus which responds to the incident;
(b) An hourly charge equivalent to the regular hourly pay for each hour that each on -duty
employee of the fire department spends in response to and/or on the scene of the incident, and

Subject: Updade City ordinance Title III, Chapter 33, Article V, Fire Department
PROPOSAL: The City of Fayetteville Fire Department (FFD) has determined that the City
Code regarding the Fire Department should be amended to more accurately reflect current
relationships with local, regional, state, and national jurisdictions and authorities. In addition,
the rates charged for Hazmat response and fire protection should be increased to reflect current
cost recovery.
Section 33.046, Providing Fire Protection Services Outside City, currently authorizes mutual aid
agreements for fire protection with municipalities and other fire departments only in Washington
County. The FFD needs authorization to enter mutual aid agreements under state and national
authorities, as well as local and regional jurisdictions. This will provide for our participation in
programs such as the Northwest Arkansas Urban Search and Rescue Team (USAR); Hazardous
Materials Emergency Incident Response Team (HRT); Area Mutual Aid Agreements with
municipalities and other fire departments; Arkansas Fire Service Mutual Aid Plan; The Arkansas
Mutual Aid Plan; State to State Emergency Mutual Aid Contracts (EMACS); and the Intrastate
Mutual Aid Plan (IMAS) from the International Association of Fire Chiefs.
In addition, Section 33.050, Response to Hazardous Materials Incidents, currently restricts
authorization for the FFD to respond exclusively into areas serviced by the former Regional
Hazardous Materials Response Team [3.050, A, and C § 1 (d)]. This response authority should
be updated with the deletion of references to the Northwest Arkansas Regional Hazardous
Materials Response Team, as well as including the recently enacted Interlocal Cooperation
Agreement for Hazardous Materials Incident Response Services in Washington County. It
should further include other mutual aid agreements and programs that require a Hazmat
response, such as the USAR Team.
Finally, in Section 33.050 § C, 1 (a), the hourly charge for each fire truck was established 23
years ago when a fire engine cost around $225,000. At that time the hourly rate was set at
"... $200 for the first hour and $100 for each additional hour...". In 2010 the City paid
approximately $467,000 for the newest fire engine. The rate charged to recover the cost of the
taxpayers should reflect the inflation that has occurred since 1990. A national revenue recovery
firm lists the hourly cost of a Class A Engine from $450 to $600. The rates charged by FFD
should be increased to $400 for the first hour and $200 for each additional hour.

RECOAIAMNDATION: Staff recommends amending City Code Section 33.046 to reflect
authorization to enter into mutual aid agreements under state and national authorities, as well as
local and regional jurisdictions. Staff further recommends ammending Section 33.050 to reflect
the recently enacted Interlocal Cooperation Agreement for Hazardous Materials Incident
Response Services in Washington County, as well as other mutual aid agreements and programs
that require a HazMat Team response. This recommendation includes updating the rates charged
by the FFD for fire protection and HazMat services to $400 for the first hour and $200 for each
additional hour.
BUDGET IMPACT: The number of hazmat response calls can vary and fluctuate each year,
so pinpointing anticipated revenue and subsequent related costs cannot be precisely determined.
However, they will be precisely tracked and recorded. Anew program (1010.3040) and revenue
account (1010.0001.4401.08) were activated in the General Fund and will be used to capture
haz-mat related expenditures and revenue.

ARTICLE VI
PUBLIC FACILITIES BOARD
33.065 Findings
The City of Fayetteville hereby finds and determines:
(A) There exists within and near the city, including
the city's projected growth areas and the city's
extraterritorial planning areas, a shortage of
decent, safe and sanitary residential housing
facilities available for rehabilitation, construction,
or purchase on terms that persons and families of
low and moderate income can afford to pay.
(B) Existing economic conditions including high rates
of interest on residential mortgage loans, and a
shortage of funds within lending institutions in the
state for residential mortgage loans are operating
to: Further restrict the rehabilitation, construction,
and purchase of residential housing by persons
of low and moderate income at reasonably
affordable costs; create unemployment and
hardship within the residential construction
industry, adversely affecting residents of the city;
and reduce and limit the value of property within
the city; all of which adversely affect the city's tax

revenues and which, if not alleviated, will lead to
further urban blight and decay and result in
disproportionately large expenditures for services
by the city.
(C) The availability of mortgage financing to assist
such persons and families in the rehabilitation,
construction or purchase of decent, safe, and
sanitary residential housing facilities will be aided
by the providing of funds for mortgage financing
of residential housing facilities by the creation of
a Public Facilities Board pursuant to the
provisions of Act No. 142 of the General
Assembly of 1975.
(D) The providing of financial assistance in order to
enable persons and families of low and moderate
income to finance the costs of decent, safe and
sanitary residential housing facilities is a proper
public purpose as declared by the act, and by this
determination of the City Council.
(E) The public purpose of financing residential
housing facilities may best be served by
establishing a Public Facilities Board to purchase
mortgages on such residential housing facilities
or make loans to mortgage lenders to provide
financing for residential housing facilities as
provided in the act.
(F) In addition to all other findings and public
purposes stated in this ordinance, the
development of housing, health care, and related
facilities for elderly persons, regardless of
income, serves a substantial public purpose and
there is a significant need in the city for such
facilities.

Pursuant to A.C.A. §14-137-107 there is created and
established the city Public Facilities Board
(hereinafter known as "facilities board") with authority
as hereinafter provided to accomplish, finance,
contract or purchase mortgage loans conceming, and
otherwise act in such manner as may be permitted by
the act to provide decent, safe, and sanitary
residential housing facilities within or near the city,
including the city's projected growth areas and the
city's extraterritorial planning areas.

RESCUE AND HAZARDOUS MATERIALS RESPONSE SERVICES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby
amends §33.046 Providing Fire. Protection Services Outside the City so that
afteramendment, the section shall read as follows:
-33.046 Providing Fire Protection and Search and Rescue Response Services
Outside the City -
The city fire department shall not provide fire protection or search and rescue
response services beyond the corporate limits and shall not combat any fire
located outside the corporate limits except pursuant to:
'(A) A mutual aid agreement, approved by the City Council, with another
municipal corporation or any duly organized firefighting or search and rescue
organization in the United States.
- - (B) The city fire department shall have the right to refuse to respond to any fire
or search and rescue located outside the city's corporate limits if, in the judg-
ment of the fire chief, or authorized representative, fire protection or search
and rescue response within the city would be impaired."
(C) Rates, reimbursements, collections and records.
(1) The Fayetteville Fire Department is hereby authorized to bill and mi-
Iect from recipients of services for all costs incurred by the fire depart-
ment responding to firefighting or search and rescue incidents, including
but not limited to:
(a) A charge of $400.00 for the first hour and $200.00 for each addi-
tional hour for each major piece of fire apparatus which responds to
the incident;
(b) An hourly charge equivalent to the regular hourly pay for each
hour that each on -duty employee of the fire department spends in
response to and/or on the scene of the incident, and the regular time
and one-half rate of pay for each hour that each off -duty employee
of the fire department spends in response to and/or on the scene of
the incident;
(c) The replacement costs of all expendable equipment and supplies
used by the fire department in managing and mitigating the incident
including any equipment damaged or made unusable by contamina-
tion; and
(d) All costs incurred by the fire department for any labor, materials,
or supplies provided by third parties at the request of the Fayetteville
Fire Department, including but not limited to, any mutual aid agree-
ment, local government entities, business and industrial facilities,
specialists, consultants, and utilities and any other costs necessary
to manage and mitigate the Incident.
(2)The fire chief, orthe fire chief's designated representative, shallcollect
charges due the city for the provision of firefighting or search and rescue
incident services and shall:
(a) Prepare and issue statements for charges to parsons, corpora-
tions, partnerships or my other entities, who are provided firefighting
or search and rescue services under this section;
(b) File suit to collect delinquent charges due within a reasonable time
after the service is provided;
(c) Maintain adequate :records, which shall contain the following
information:
(I) Date;
in) Funds collected for services rendered;
(iif Accounts receivable;
(iv) Unpaid charges; and -
(v) Such other information as may be requiredby officials of
the city."
