BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE,ARKANSAS:
Section 1: That R-PZD 07-2551 (Champions Club Condos) is hereby revoked because
the developer failed to obtain development permits in accordance with the approved phased
development schedule.
Section 2: That the zone classification of the following described property is hereby
changed as follows:
From R-PZD, Residential Planned Zoning District 07-
2551 to UT, Urban Thoroughfare, as shown on Exhibits
"A"and `B" attached hereto and made a part hereof.
Section 3: That the official zoning map of the City of Fayetteville, Arkansas is hereby
amended to reflect the zoning change provided in Section 2 above.

RECOMMENDATION
Planning Commission and staff recommend approval of an ordinance to revoke the expired Champions Club Condos
Planning Zoning District and rezone the property from R-PZD 07-2551 Champions Club Condos to U-T, Urban
Thoroughfare.
BACKGROUND
The subject property contains 4.42 acres located south of 15`h Street and West of Razorback Road. The site is zoned
R-PZD 07-2551, and is generally flat, undeveloped, disturbed grassland with the Town Branch along the western
border of the site. On July 3, 2007 the City Council approved the Champions Club Condominiums Planned Zoning
District on the subject property (R-PZD 07-2551). The property was originally zoned I-1, Heavy Commercial/Light
Industrial. The R-PZD zoning permitted a total of 143 multi-family dwellings with a density of approximately 32
units per acre. Construction permits for the project were never obtained and the R-PZD approval has expired. If an
approved PZD expires the property does not automatically revert back to the original zoning. The property is unable
to be developed or subdivided until the old PZD zoning is revoked and a new, valid zoning district is assigned. In an
effort to establish a valid zoning district on the subject property the City Planning Division has initiated the PZD
revocation process following the requirements of Fayetteville Unified Development Code Chapter 166.06(C). An
initial letter was sent to the property owners on October 21, 2010 notifying them of the expired PZD, discussing
options for establishing a valid zoning district, and the intent of the City to revoke the PZD and rezone the property
if the owners did not initiate a rezoning. On April 7, 2010 the City Planning Division sent an official PZD revocation
letter to the property owner via certified mail notifying them that the City Planning Division was proposing to revoke
the PZD and rezone the property to U-T, Urban Thoroughfare.
DISCUSSION
On May 9, 2011 the Planning Commission forwarded this item to the City Council with a recommendation for
approval with a vote of 8-0-0.

BACKGROUND:
Property Description:The subject property contains 4.42 acres located south of 15"'Street and West
of Razorback Road. The site is zoned R-PZD 07-2551,and is generally flat,undeveloped,disturbed
grassland with the Town Branch along the western border of the site. Surrounding land use and
zoning is depicted in Table 1.

CITY PLAN 2025 FUTURE LAND USE PLAN: City Plan 2025 Future Land Use Plan
designates this site as Urban Center Area. Urban Center Areas are the equivalent ofa main street,
including building types that accommodate retail, offices, rowhouses and apartments. These areas
contain taller buildings and have the most intense and dense development patterns within the City,
as well as the greatest variety of buildings, with unique civic buildings in particular.
INFRASTRUCTURE:
Streets: The site has access to 15th Street and Razorback Road. Improvements will be
needed along 15th street to connect with Razorback. Razorback is an improved five

lane state highway and 15th Street is an improved four lane state highway in this
location.
Water: Public water is located adjacent to the site. There is a 12" waterline to the east side
of the property at 15th street. This 12"main will need to extend through the property
and connect to the main on the east side of Razorback at the time of development.
Sewer: Sanitary sewer is available on the site. There is a 24"sewer main located through the
center of the property. Sewer service will need to be extended within the property at
the time of development. Improvements to the sewer system may be required
dependent upon the demand placed by the development.
Drainage: Standard improvements and requirements for drainage will be required for the
development. This property is affected by the 100-year floodplain of Town Branch.
Police: Staff did not receive objections from the Police Department to this rezoning.
Fire: This site is located three miles from Engine 6 at 900 South Hollywood with an
anticipated response time of four minutes to this site.This rezoning should not affect
calls for service or response times.
FINDINGS OF THE STAFF
1. A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: Staff finds the proposal is highly consistent with the land use planning
objectives, principles and policies, as evidenced by the number of guiding
policies for Urban Center Area this proposal meets.Rezoning the property will
accommodate both the future land use plan for non-residential and residential
uses in this intended high-intensity area. The subject property is a desirable
location for infill development at this intersection of two principal arterial
roadways and in close proximity to the University of Arkansas. The proposed
UT zoning would also be compatible with the surrounding university,
commercial, and multi-family uses.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: The proposed zoning is needed at this time as the existing R-PZD zoning has
expired and the property is unable to be developed in any manner, including
minor applications such as a lot split or single family residence,until the expired
PZD zoning is revoked and a new zoning district is assigned. As discussed in
Finding No. 1, the proposed zoning is justified as it is compatible with the

surrounding zoning and land uses and consistent with the City's Future Land
Use Plan.
A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: The proposed rezone would potentially increase traffic over the existing R-PZD
zoning. However, given this site's location at the intersection of two Principal
Arterial roadways (both state highways); the existing street infrastructure can
safely accommodate increased traffic with standard street improvements
required at the time of development.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and sewer
facilities.
Finding: Increased load on public services were taken into consideration and
recommendations from the Engineering, Fire, and Police Departments and are
included in this report. The proposed zoning change to UT should not have an
adverse impact on public services.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted under
its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the proposed
zoning is not desirable.
Finding: Not applicable. Staff recommends in favor of the request.

(A) Purpose. The Urban Thoroughfare District is designed to provide goods and services for persons living in the
surrounding communities. This district encourages a concentration of commercial and mixed use development that
enhances function and appearance along major thoroughfares. Automobile -oriented development is prevalent within

All permits for phase 1 of the project are anticipated to be obtained within 1 year
after City Council Approval with the opportunity for a 1 year extension with
planning commission approval. All permits for phase 2 of the project are
anticipated to be obtained within 4 years after City Council Approval with the
opportunity for a 1 year extension with planning commission approval.
E. Proposed Planning Areas:
The site will consist of a single planning area, All of the proposed development
standards will apply to the entire 4.42 acres.
F. Proposed Zoning and Development Standards:
R-PZD 00-2107 Champion's Club Planned Zoning District
(A) Purpose. The intent of the Champion's Club PZD is to provide Zoning
requirements that are beneficial to the development of the site, as well
as maintaining the current character of the neighborhood. The PZD
will allow a higher density, which Is required for this type of
development It will also be compatible with the apartments to the
west and will provide access to Baum Stadium to the north.

(F) Height regulations. Height for this structure will be measured from the
existing sidewalk or edge of asphalt of the street. This is done
because the existing sidewalk and street Infrastructure is much higher
than the site, which could result in a misleading building height. The
maximum height of the building along Razorback Road shall be 73.5
feet as measured on the street side of the building. The maximum
height of the building along 150i Street shall be 73.5 feet as measured
on the street side of the building. It is important to note that the
building height is only 83.5 feet at the intersection as can be seen in
Appendix A Building Elevations.
(G) Building Area. Buildings shall not exceed 60% of the total area of a
lot.
(H) Site Planning.
(1) Landscaping. Landscaping shall be in accordance with the
City of Fayetteville Landscape Manual as it pertains to Multi-
family and Mixed -use developments. A completed and
detailed Landscaping Plan shall be submitted and approved at
the time of Large Scale Development/ Final PZD application
for the development.

(3) Architectural Design Standards. The proposed development
will be Residential Condominium Project and will be 4 stories
in height from all street elevations and will be 5 stories from
the building's parking side (inward facing rear sides) with a
story of covered partdng underneath a portion of the building —
but not an underground parking deck. Maximum height of the
building will be 73.5 feet as measured on the street side of the
building. The building's skin will consist of Masonry with
accent areas of hardy board or siding. Siding will not be metal
building siding, but will consist of residential style siding or
hardy board. The building's massing has been broken down
into 3 main parts and further articulated on the exterior to
provide a proper scale and massing for the location.
(4) Signage. Proposed Signage for this development will include
display of the name of the development on the building as
shown on the elevations in Appendix A as well as a free-
standing monument style signage at the two entrances to the
development. All signage will have complementary
architectural elements and are targeting the University-themed
environment of this area. The details of the signage will be
provided and approved at the time of Large Scale
Development/ Final PZD application and will comply with the
City's Sign Ordinance.

161.21 Urban Thoroughfare
(A) Purpose. The Urban Thoroughfare District is designed to provide goods and services for persons living in the
surrounding communities. This district encourages a concentration of commercial and mixed use development that
enhances function and appearance along major thoroughfares. Automobile -oriented development is prevalent within
this district and a wide range of commercial uses is permitted. For the purposes of Chapter 96: Noise Control, the
Urban Thoroughfare district is a commercial zone. The intent of this zoning district is to provide standards that
enable development to be approved administratively.

166.06 Planned Zoning District (PZD)
(L) Revocation.
(1) Causes for revocation as enforcement action. The Planning Commission may recommend to the City Council
that any PZD approval be revoked and all building or occupancy permits be voided under the following
circumstances:
(a) Building permit. If no building permit has been issued within the time allowed.
(b) Phased development schedule. If the applicant does not adhere to the phased master developmemplan
schedule as stated in the approved development plan.
(c) Open space and recreational facilities. If the construction and provision of all common open spaces
and public and recreational facilities which are shown on the final plan are proceeding at a substantially
slower rate than other project components.
Planning staff may report the status of each ongoing PZD at the first regular meeting of each quarter, so
that the Planning Commission is able to compare the actual development accomplished with the approved
development schedule. If the Planning Commission finds that the rate of construction of dwelling units or
other commercial or industrial structures is substantially greater than the rate at which common open spaces
and public recreational facilities have been constructed and provided, then the Planning Commission may
initiate revocation action or cease to approve any additional final plans if preceding phases have not been
finalized. The city may also issue a stop work order, or discontinue issuance of building or occupancy
permits, or revoke those previously issued.
(2) Procedures. Prior to a recommendation of revocation, notice by certified mail shall be sent to the landowner or
authorized agent giving notice of the alleged default, setting a time to appear before the Planning Commission
to show cause why steps should not be made to totally or partially revoke the PZD. The Planning Commission
recommendation shall be forwarded to the City Council for disposition as in original approvals. In the event a
PZD is revoked, the City Council shall take the appropriate action in the city clerk's office and the public
zoning record duly noted.
(3) Effect. In the event of revocation, any completed portions of the development or those portions for which
building permits have been issued shall be treated to be a whole and effective development. After causes for
revocation or enforcement have been corrected, the City Council shall expunge suchrecord as established above
and shall authorize continued issuance of building permits.
