AN ORDINANCE REZONING THAT PROPERTY DESCRIBED IN
REZONING PETITION RZN 09-3270, FOR APPROXIMATELY 1.00 ACRE,
LOCATED AT 41 EAST NORTH STREET, ON THE SOUTHWEST CORNER

Section 1: That the zone classification of the following described property is hereby
changed as follows:
From RSF-4, Residential Single-Family, 4 units per acre
to R-O, Residential Office, as shown on Exhibits "A" and
"B" attached hereto and made a part hereof.
Section 2: That the official zoning map of the City of Fayetteville, Arkansas is hereby
amended to reflect the zoning change provided in Section 1 above.

Subject: Rezoning for Ramona Jones(RZN 09-3270)
RECOMMENDATION
Staff and the Planning Commission recommend approval of rezoning the subject property
from RSF-4, Residential Single-family to R-O, Residential Office located at 41 E. North
Street.
BACKGROUND
The subject property is located at the southwest corner of North Street and Pollard
Avenue. The approximately 1-acre tract is currently developed with a single-family
dwelling that was constructed in 1942. The property is bordered by the University of
Arkansas for Medical Sciences campus, a parking lot for UAMS, a professional office
building and a single-family residence.
The applicant proposes to rezone the property from RSF-4, Residential single-family to
R-O, Residential Office.
DISCUSSION
This item was heard at the regular Planning Commission meeting on May 11, 2009. The
Planning Commission voted 7-0-0 to forward this rezoning request to the City Council.

Water: Public water is available to the property. There is an 8" and 10" main adjacent to the
property.

Sewer: Sanitary sewer is available to the site. There is a 12"and 6"public main adjacent to the
property.
Drainage: Standard improvements and requirements for drainage will be required for the
development. This property is affected by the 100-year floodplain.
Police: It is the opinion of the Fayetteville Police Department that this RZN will not substantially
alter the population density,and will not create an appreciable or undesirable increase in
the load on police services. This RZN will not create an appreciable increase in traffic
danger and congestion.

Fire: This property will be covered by Engine#4 located at 708 N. Garland.

CITY PLAN 2025 FUTURE LAND USE PLAN: City Plan 2025 Future Land Use Plan designates this
site as City Neighborhood Area,which is a denser and primarily residential urban fabric with mixed and
low-intensity nonresidential uses usually confined to corner locations.

FINDINGS OF THE STAFF

1. A determination of the degree to which the proposed zoning is consistent with land use planning
objectives,principles, and policies and with land use and zoning plans.
Finding: The proposed R-O zoning is consistent with the City Neighborhood Area land use
designation,which recognizes mixed and low-intensity nonresidential uses on corner
locations.Based on the City's adopted land use planning objectives and principles,
staff finds that the subject property,which is located on North Street(a principal
arterial) and surrounded on three sides by nonresidential uses, would be more
appropriately regulated under the R-O zoning district than the current Residential

single-family zoning designation.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: The subject property has been utilized for a single-family residence for j
approximately 65 years; however,it has sat vacant and for sale for the last several
years. Staff finds that the rezoning request is justified at this time to allow the
property to be converted to either a denser residential use, or to a low-intensity
nonresidential use,such as an office,at this corner location. It is evident based on
the surrounding higher intensity land uses that this particular property is no longer
desirable for single-family residential use.
3. A determination as to whether the proposed zoning would create or appreciably increase traffic
danger and congestion.
Finding: It is expected that a rezoning from RSF-4 to R-O will result in the potential for a
slight increase in traffic compared with that allowed under the existing zoning.
However, the property has direct access to two adjacent streets, including North
Street (a principal arterial), and is only one lot removed from College Avenue (a
principal arterial).
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and sewer
facilities.
Finding: Staff finds that the proposed zoning would not create undesirable impacts to public
services, or a density that is incompatible with the surrounding area, based on a
review of infrastructure, existing land uses, and the development potential of the
property.The property is currently zoned for single-family dwellings.The change in
zoning to R-O would not permit uses that would adversely impact public services.
Increased load on public services were taken into consideration and
recommendations from the Engineering,Fire,and Police Departments are included j
in this report.
5. If there are reasons why the proposed zoning should not be approved in view of considerations
under b (1) through (4) above, a determination as to whether the proposed zoning is justified
and/or necessitated by peculiar circumstances such as:
i
a. It would be impractical to use the land for any of the uses permitted under its
existing zoning classifications;
b. There are extenuating circumstances whichjustify the rezoning even though
there are reasons under b (1)through(4)above why the proposed zoning is
not desirable.
Finding: Not applicable. Staff recommends in favor of the requested zoning.
