AN ORDINANCE APPROVING VAC 14-4753 SUBMITTED
BY CITY STAFF FOR PROPERTY LOCATED AT 1560 S.
HAPPY HOLLOW ROAD TO VACATE EXISTING STREET
RIGHT-OF-WAY FOR HAPPY HOLLOW ROAD.
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate
public grounds or portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of the
platted street right-of-way is not required for corporate purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates and
abandons the following portions of street right-of-way described in Exhibit "B" attached hereto
and made a part thereof.
Section 2: That a copy of this Ordinance duly certified by the City Clerk along with the
map attached and labeled Exhibit "A" shall be filed in the office of the Recorder of the County
and recorded in the Deed Records of the County.
Section 3: That this vacation approval is subject to the following conditions of approval:
1. Any damage or relocation of existing facilities shall be at the owner/developer's
expense.
2. Existing utility easements shall not be vacated by this ordinance.
3. New easements shall be dedicated for existing utility lines as described on the
attached utility approval forms and easement plat.

RECOMMENDATION:
Staff and the Planning Commission recommend approval of an ordinance to vacate existing street
right-of-way.
BACKGROUND:
The City's Transportation Division, Parks and Recreation Department, Fleet Operations, and
Recycling and Trash Collection offices and storage yards are located south of 151h Street/Happy
Hollow Road. The primary access into this campus is through a paved two-lane drive off of Happy
Hollow Road that is gated in several places. This access drive is located within existing street
right-of-way for Happy Hollow Road that is proposed to be vacated.
DISCUSSION:
On June 23, 2014 the Planning Commission forwarded this item to the City Council with a
recommendation of approval with a vote of 7-0-0.

BACKGROUND:
Property and background: The City's Transportation Division, Parks and Recreation Department,
Fleet Operations, and Recycling and Trash Collection offices and storage yards are located south
of 1511 Street/Happy Hollow Road. The primary access into this campus is through a paved two-
lane drive off of Happy Hollow Road that is gated in several places. This access drive is located
within existing street right-of-way for Happy Hollow Road that is proposed to be vacated. Land
use and zoning surrounding the City's campus in this area is depicted in Table 1.

Proposal: The City requests vacation of approximately 2.0 acres of existing street right-of-way for
Happy Hollow Road that bisects the City's campus, equipment and storage yards as indicated on
the attached survey. This right-of-way has never been developed or utilized as a public street.
This vacation is partially needed to facilitate future expansion and improvements to the City's
Recycling and Trash Collection facility.

DISCUSSION:
Vacation Approval: The applicant has submitted the required vacation forms to the City utility
departments and applicable franchise utilities, with no objections, provided that utility easements
are retained for existing utilities. The area proposed to be vacated is surrounded entirely by
property owned by the City. The northern end of the vacation area is adjacent to a private property
owner, however, this section of right-of-way is not proposed to be vacated and will not affect
access to this property.

located in the Fayetteville Industrial Park. The City of Fayetteville, Arkansas owns all the
properties directly adjacent to the street right-of-way.
The reason for this vacation request by the City of Fayetteville is to make it part of the entrance
into their existing facility. This street right-of-way has not been used by the public as a street
for many years and the public interest and welfare would not be adversely affected by the
abandonment of the street right-of-way.

19941-000 and 765-19940-000 which are all owned by the City of Fayetteville and has not been used by the
public as a street for a period of many years, only as an entrance into the City of Fayetteville's Facilities and
that the public interest and welfare would not be adversely affected by the abandonment of the portion of the
above described street right of way.
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the above described real
estate, subject, however, to the existing utility easements and sewer easements as required, and that the above
described real estate be used for their respective benefit and purpose as now approved by law.
The petitioners further pray that the above described real estate by vested in the abutting property owners as
provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the City of
Fayetteville, Arkansas, abandon and vacate the above described real estate, subject to said utility and sewer
easements, and that title to said real estate sought to be abandoned be vested in the abutting property owners as
provided by law, and as to that particular land the owners be free from the easements of the public for the use
of said alley.
