Section 2: That a copy of this Ordinance duly certified by the City Clerk along with the map attached and labeled Exhibit A shall be filed in the office of the Recorder of the County and recorded in the Deed Records of the County. Section 3: This vacation approval is subject to the owner's continuing agreement that any necessary relocation of existing utilities caused by this vacation will be at the expense of the owner. BACKGROUND The subject property is located at 1661 E. Cypress Lane in the Charleston Place Subdivision. The property contains a single-family structure that was constructed in 2005. A corner portion of the building was constructed into the 12' utility easement along the north side of the subject property. The applicant's request is to vacate a portion of a utility easement to bring the existing structure into compliance. DISCUSSION This item was heard at the regular Planning Commission meeting on May 26, 2009.
