AN ORDINANCE TO AMEND §174.03 EXEMPTIONS OF CHAPTER 174
SIGNS OF THE FAYETTEVILLE CODE TO ALLOW ADVERTISING ON
PEDICABS
WHEREAS, pedicab companies would like to be able to place advertising signs for other
businesses on their pedicabs.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends
§174.03 Exemptions of Chapter 174 Signs of the Fayetteville Code by enacting a new (S) as
shown below:
"(S) Pedicabs. Pedicabs not operating on city trails may be allowed one
advertising sign placed upon the rear of the pedicab and extending no higher than
the stock body of the pedicab. The sign shall not be illuminated and shall not
exceed six square feet (2' x 3'). Prior to displaying this sign publicly, such sign
as attached to the pedicab must be presented to the Zoning and Development
Administrator for permitting and, if the sign is in full compliance with this
subsection, approval."

Alderman Petty brought this proposed ordinance to the Ordinance Review
Committee along with his other proposed changes. The Ordinance Review
Committee split two to two on whether to recommend approval or denial and then
voted to forward it to the whole City Council without a recommendation.

RE: Proposed ordinance to allow offsite advertising signs on pedicabs
I must oppose this proposed ordinance as a weakening of the legal supports
of our Sign Ordinance. After much discussion and consideration, the Fayetteville
Board of Directors decades ago passed Fayetteville's Sign Ordinance which
required numerous businesses to remove their existing signs and replace them with
signs conforming to the new standards. The ordinance also required the removal
of all bill boards and other off-site advertising signs. This ban on offsite signs is
the heart of the Sign Ordinance.
Fayetteville's Sign Ordinance was not supported by many businesses, and
the Sign Ordinance was challenged in Court several times. The Arkansas Supreme
Court upheld the constitutionality of our Sign Ordinance as properly supported by
the City of Fayetteville's legitimate considerations of traffic safety and aesthetics.
Our neighboring cities, especially Springdale, initially scoffed at our Sign
Ordinance which was supposed to kill our commercial sales. Decades later
Springdale has almost caught us in population, but as shown in the most recent
City & Town magazine (Feb. 2011), Springdale's commercial sales are less than
58% of ours. In fact statewide, only Fort Smith with $3.0 million in monthly
municipal sales tax receipts tops our $2.5 million. No other city collects even $2.0
million. These facts show that our Sign Ordinance has made our City more
attractive not only to citizens, but our commercial establishments.
Most of our neighboring cities have, too late, tried to follow our lead with
their own sign ordinances. Unfortunately, the sign lobby convinced the Legislature
to enact a law to prevent other cities from forcing the removal of billboards as
Fayetteville accomplished. Other cities such as Bentonville have tried other ways
to reduce the number of billboards (which are large off-site signs) in their city.
According to the Northwest Arkansas Times, February 19, 2011, page 2A,
Mayor Bob McCaslin stated: "Anything we can do to reduce the number of
billboards in town is a plus for all of us. None of us want to have a thoroughfare
where there is nothing but signs sticking up in the air." Mayor McCaslin was
defending an ordinance that allowed the installation of an electronic billboard for
every four standard billboards which are removed. After a two-sided electronic
billboard was installed the headline read: "Officials Question Billboard Decision."
Aldermen said these electronic billboards are "very bright and very distracting,
especially at night," and "a bad idea."
Rather than facing a billboard problem and following Bentonville's effort to
do everything possible to reduce the number of billboards, the City of Fayetteville
needs to ensure its long standing Sign Ordinance banning billboards and all off-site
signs is preserved. Would allowing off-site advertising signs (small billboards) on
pedicabs endanger the legal support of our Sign Ordinance? It would be another
chink in our legal armor for it would provide an exemption to the off-site
prohibition which our Sign Ordinance states is necessary to achieve our aesthetics
and traffic safety goals.
Two years ago I informed you that a sign regulation that allows too many
exemptions could be held invalid by a court because the exemptions have
undermined the goals the ordinance was supposed to protect. Billboard
companies look at city sign ordinances and examine them for constitutional
weaknesses such as excessive exemptions. This recently happened to Los Angeles.
Los Angeles adopted its sign ordinance on April 30, 2002, supported by the
same purposes of the Fayetteville Sign Ordinance passed decades earlier: traffic
safety and aesthetics. In eight early appeals to the Arkansas Supreme Court and a
more recent appeal to the Eighth Circuit Court of Appeals, our Sign Ordinance
(with some necessary amendments) has been held constitutional.
The Los Angeles ordinance was challenged by a billboard company, Metro
Lights, which installed several billboards (off-site signs) in violation of the sign
ordinance. The Federal District Court struck down the L.A. sign ordinance on
grounds that the city had allowed too many exemptions for off-site signs at transit
stops and on busses which undermined the City's grounds of aesthetics and traffic
safety.
"(T)he Supreme Court has held that a regulation can
be unconstitutional if it `in effect restricts too little speech
because its exemptions ... diminish the credibility of the
government's rationale for restricting speech in the first place.'

Fortunately, the Ninth Circuit Court of Appeals reversed the decision in
favor of the billboard company and held Los Angeles' Sign Ordinance did past
constitutional muster.
"It is well-established that traffic safety and aesthetics
constitute substantial government interests." Id. at 45
CONCLUSION
As City Attorney, I am charged with the defense of the constitutionality and
legality of all the city ordinances that the City Council passes. None has been
attacked in Court more than our Sign Ordinance. Therefore, I remain concerned
about anything that could weaken the constitutional and legal support for the Sign
Ordinance which certainly includes too many exemptions to its most basic
prohibition against off-site signage.
I must oppose this proposed new exemption for off-site signs on pedicabs as
I will any additional off-site advertising sign exemption. I opposed the exemption
for advertising signs on taxicabs and buses. Adding an exemption for pedicabs
because taxicabs were given one is not a question of fairness, but of weakening our
Sign Ordinance still further.
Be thankful that the hard work of prohibiting billboards and other off-site
signs was accomplished by your predecessors on the Fayetteville Board of
Directors decades ago. Now, rather than wrestling with "Anything we can do to
reduce the number of billboards in town," like our neighboring cities, we must only
be careful to preserve our Sign Ordinance's prohibition of billboards and other
off-site signs.
