AN ORDINANCE APPROVING VAC 10-3707 SUBMITTED BY CEI
ENGINEERING ASSOCIATES, INC. FOR PROPERTY LOCATED AT 2396
NORTH COLLEGE AVENUE, TO VACATE AN EXISTING SEWER
EASEMENT ON THE PROPERTY,AS DESCRIBED HEREIN.
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate
public grounds or portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described portion of the
platted sewer easement is not required for corporate purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE,ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby vacates and
abandons the following utility easement as described in Exhibit B (attached).
Section 2: That a copy of this Ordinance duly certified by the City Clerk along with the
map attached and labeled Exhibit A shall be filed in the office of the Recorder of the County and
recorded in the Deed Records of the County.
Section 3: That this vacation approval is subject to the Condition of Approval as follows,
and shall not be in effect until such condition is met:
1. The vacation of the existing 10' sewer easement shall not be accepted until the
required 15' sewer easement is dedicated along the southern property line.

RECOMMENDATION
Staff and Planning Commission reconvnend approval of an ordinance vacating a sewer easement on the subject
property(VAC 10-3707).
BACKGROUND
The subject project boundary is made up of three separate lots and is bound by three public streets - Township
Street, College Avenue, and Jane Avenue. On November 8, 2010, the Planning Commission approved the
applicant's Conditional Use Permit (CUP 10-3688) and Large Scale Development (LSD 09-3495) requests to
construct a 10-pump gas station and a 4,958 sq. ft. convenience store on the subject property. During staffs
review of the proposed development request, an existing sewer easement along the eastern and southern
portions of the subject property was discovered by the applicant, as this easement was not included in the City's
GIS database.
The applicant's request is to vacate an existing sewer easement on the subject property in order to allow for the
construction of the convenience store. This easement does not contain utilities, and the applicant is to dedicate
an easement along the southern property line that is adequate to serve the subject property and all adjacent
properties.
DISCUSSION
On December 20, 2010 the Planning Commission forwarded this request to the City Council with a recommendation
for approval with a vote of 6-0-1 (Commissioner Hoskins recused).

COLLEGE AVENUE. The property is zoned C-2, THOROUGHFARE COMMERCIAL
and contains approximately 1.22 acres. The request is to vacate a utility easement within

Findings:
Property Description: The subject project boundary is made up of three separate lots and
is bound by three public streets - Township Street, College Avenue, and Jane Avenue. On
November 8, 2010, the Planning Commission approved the applicant's Conditional Use
Pemlit (CUP 10-3688) and Large Scale Development (LSD 09-3495) requests to
construct a 10-pump gas station and a 4,958 convenience store on the subject property.
During staffs review of the proposed development request; an existing sewer easement
along the eastern and southern portions of the subject property was discovered by the
applicant, as this easement was not included in the City's GIS database.
Request: The applicant's request is to vacate an existing sewer easement on the subject
property in order to allow for the construction of the convenience store.
The applicant has submitted the required notification forms to the City Utilities
Department with the result summarized below.

Public Comment: No public comment has been received.
Recommendation: Finding that the easement to be dedicated along the southern
