AN ORDINANCE REZONING THAT PROPERTY IDENTIFIED AS
PARCELS 765-15560-000 AND 765-15560-001, FOR APPROXIMATELY 15.2
ACRES, LOCATED SOUTH OF WILLOUGHBY ROAD AND 0.8 MILES
EAST OF HWY 71B FROM I-2, GENERAL INDUSTRIAL TO R-A,
RESIDENTIAL AGRICULTURAL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the zone classification of the following described property is hereby
changed as follows:
From I-2, General Industrial to R-A, Residential
Agricultural as shown on Exhibit "A" attached hereto and
made a part hereof.
Section 2: That the official zoning map of the City of Fayetteville, Arkansas is hereby
amended to reflect the zoning change provided in Section 1 above.

Subject: Rezoning— Mulch Disposal Site
Staff has recently been informed that the mulch removal associated with the 2009 Ice Storm Debris
Clean-up is rapidly coming to a close. hi April of this year,the City Council approved a contract with
International Equipment Distributors(IED)to dispose of the mulch. The site selected for the clean-
up,as a transfer site, was also rezoned from R-A,Residential Agricultural to I-2,General Industrial
with an associated Bill of Assurance limiting the use of the property to the mulch disposal activities.
The site ultimately was not utilized for the intended purposes. In accordance with intent of the
Council with the original rezoning and the Bill of Assurance offered by the property owner,staff has
prepared an ordinance to rezone the property to its original R-A district. This proposal is sponsored
by Council Member Brenda Thiel.

Subject: Rezoning—Mulch Disposal Site
In a Special City Council meeting on 16 April 2009,the City Council approved Resolution 83-09,
awarding a contract with International Equipment Distributors (IED) to dispose of the mulch
remaining from the 2009 Ice Storm Debris Clean-up.In the bids submitted,contractors selected sites
which would meet the needs of the operation for removal,re-mulching and shipping of the mulch to
end users. The site to be utilized by the contractor selected by the City is approximately 0.8 miles
east of Hwy 71 B, south of Willoughby Road. The property is zoned R-A,Residential Agricultural,
and is currently not being utilized:
The zoning required for this use is I-2,General Industrial. As discussed at the Special City Council
meeting, it is necessary to rezone this site from R-A to I-2 in order to authorize the intended use;a
mulch disposal operation site.It is the understanding of staff that the rezoning of the property is
solely requested to fulfill the terms of the contract for the mulch disposal operation related to the ice
storm debris clean-up and as such, staff will recommend the property to be rezoned back.to the
original R-A, Residential Agricultural immediately upon the completion of the operation, as
determined by the City of Fayetteville.
In accordance with the discussion of the City Council and staff at the Special City Council meeting,
attached is an ordinance and exhibit for your consideration.

BILL OF ASSURANCE
FOR THE CITY OF FAYETTEVILLE, ARKANSAS
In order to attempt to obtain approval of a request for a zoning reclassification, the
owner, developer, or buyer of this property, (hereinafter "Petitioner")
SjdZ- 1 ni,!!L , hereby voluntarily offers this Bill of
Assurance and enters into this binding agreement and contract with the City of Fayetteville,
Arkansas.
The Petitioner expressly grants to the City of Fayetteville the right to enforce any
and all of the terms of this Bill of Assurance in the Circuit Court of Washington County and
agrees that if Petitioner or Petitioner's heirs, assigns, or successors violate any term of this Bill of
Assurance, substantial irreparable damage justifying injunctive relief has been done to the
citizens and City of Fayetteville, Arkansas. The Petitioner acknowledges that the Fayetteville
Planning Commission and the Fayetteville City Council will reasonable rely upon all of the
terns and conditions within this Bill of Assurance in considering whether to approve Petitioner's
rezoning request.
Petitioner hereby voluntarily offers assurances that Petitioner and Petitioner's
property shall be restricted as follows IF Petitioner's rezoning is approved by the Fayetteville
City Council.
1. The use of Petitioner's property shall be limited to the mulch disposal operation(2009
Ice Storm Debris Clean-up) as described and adopted by the City Council in Resolution 83-09 on
16 April 2009.
2. The Petitioner agrees that the zoning of the property is solely requested to fulfill the
terms of the contract for the mulch disposal operation related to the ice storm debris clean-up and
as such, will request the property to be rezoned back to the original R-A, Residential Agricultural
immediately upon the completion of the operation,as determined by the City of Fayetteville.
3. Petitioner specifically agrees that all such restrictions and terms shall run with the
land and bind all future owners unless and until specifically released by Resolution of the
Fayetteville City Council. This Bill of Assurance shall be filed for record in the Washington
County Circuit Clerk's Office after Petitioner's rezoning is effective and shall be noted on any
Final Plat or Large Scale Development which includes some or all of Petitioner's property.
