AN ORDINANCE TO AMEND §33.001 CITY ORGANIZATIONAL
CHART OF THE CODE OF FAYETTEVILLE
WHEREAS, the Mayor has the right to organize and reorganize the administration of the City to
provide the most efficient service possible for our citizens as long as the Mayor stays within approved
budget(including the approved number of personnel); and
WHEREAS, the Organizational Chart within the Code of Ordinances has often been out of date
and not reflective of the actual current organizational structure of city departments; and
WHEREAS, it would be preferable for the City Organizational Chart adopted as part of the
Fayetteville Code to include only those departments which are statutorily set (and thus unlikely to
change)while including only the generic term "Administration" under the Mayor who can then determine
the most efficient organization for the administration.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE,ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby repeals §33.001
CITY ORGANIZATIONAL CHART in its entirety and enacts the replacement §33.001 CITY
ORGANIZATIONAL CHART in its stead as shown below:
"§33.001 CITY ORGANIZATIONAL CHART
"The basic City Organizational Chart shown on the following page is
hereby adopted. The Mayor shall further detail the organization of the
Administration in a chart that shall be available to the citizens of �,yip� o TR sP'•••

RE: §33.001 City Organizational Chart
Having a detailed City Organizational Chart enacted as part of the Code of
Fayetteville is probably a holdover from our previous City Manager/Board of
Directors form of government that was replaced in 1992 with the Mayor/Council
form of government. Under the City Manager form of government, the City Board
had both legislative and executory (administrative) power. Thus, the City Board
had the power to determine how the administration would be organized and
function. Under this power, the City Board approved and enacted a City
Organizational Chart.
Under our current form of government, the City Council's statutory power is
primarily limited to legislative power while the Mayor is the chief executive
officer responsible for the efficient administration of city government. The City
Council uses its power to determine budgetary matters including numbers and
costs of city personnel. However, within the confines of the budget, the Mayor has
the statutory power to organize his or her administration for efficiency and service.
The current City Organization Chart was enacted on April Fool's Day of
2003 and became out of date within a year or two. I really do not know how many
major or minor "reorganizations" the City has had over the last six years. It is
clear that none were presented as an amendment to the April 1, 2003
organizational chart.
I recommend that the §33.001 CITY ORGANIZATIONAL CHART be
amended and that the chart published in the Fayetteville reflect only the
unchanging statutorily required organization. Both the Police Chief and Fire Chief
report by statutory requirement to the Mayor just as the City Prosecutor reports to
the City Attorney and the District Court reports to the District Judge.
For purposes of the Fayetteville Code, I recommend that the broad term
"Administration"be substituted for the detailed and ever-changing department and
division mix employed in previous organizational charts enacted into the
Fayetteville Code. The Mayor would then publish(and easily change if situations
or conditions require modification)the detailed Administration Organization Chart
on the City's web page and in other ways so our citizens will have accurate and up-
to-date knowledge of our city government's organization.
I recommend this amendment to§33.001 of the Fayetteville Code.
