RECOMMENDATION
Staff and the Planning Commission recommend approval of rezoning the subject
property, located at the northeast corner of Sycamore Street and Saddlehorn Avenue,
from RSF-4, Residential Single-Family, 4 units/acre to I-1, Institutional.
BACKGROUND
The property, containing approximately 1.27 acres, is culTently vacant and located at the
corner of Sycamore Street and Saddlehome Avenue, adjacent to 1-540. The applicant
proposes to rezone the property from RSF-4, Residential Single-Family, 4 units/acre, to P-1,
Institutional in order to develop the property as an expansion of the Life Styles College for
Living, an adult education program for individuals with developmental disabilities.
Currently, Life Styles is located at the southwest corner of Sycamore Street and Porter Road,
just two properties southeast of the subject property. Development of this property will be
subject to the I-540 Design Overlay District and Commercial Design Standards.
DISCUSSION
This item was heard at the regular Planning Commission meeting on March 9, 2009. The
Planning Commission voted 9-0-0 to forward this rezoning request to the City Council with a
recommendation for approval.
While the proposed use of the subject property is classified as Use Unit 4, a use allowed
in the underlying RSF-4 zoning district only by Planning Commission approval of a
conditional use permit, staff recommends in favor of the rezoning request, finding that
any future expansion of the facility would require a new conditional use permit
application to be reviewed by the Planning Division and the Planning Commission. Staff
finds that rezoning the property to P-1, Institutional, which allows only city-wide uses,
cultural and recreational facilities, and government facilities as permitted uses, is
appropriate as the underlying zoning district would accurately reflect the use and govern
the development_of the property with regulations established and adopted for this type of
use.

INFRASTRUCTURE:
Streets: The site has access to Sycamore St. and Saddlehorn Ave. Both are fully improved
paved two lane City streets,but there is a gap separating them. Street improvements
will need to be evaluated at the time of development.
Water: Public water is available to the property. There is a 4"main along Sycamore Street.
Water may need to be extended through the property at the time of development to
provide domestic service and fire protection.
Sewer: Sanitary sewer is available to the site. There is an 8" public main across this
property. Sewer may need to be extended through the property at the time of
development. The capacity of the existing main may need to be evaluated at the time
of development.
Drainage: Standard improvements and requirements for drainage will be required for the
development. This property is affected by the 100-year floodplain.
Fire: This development will be protected by Engine 2 located at 708 N. Garland.
It is 2 miles from the station with an anticipated response time of 6 minutes to the
beginning of the development. The Fayetteville Fire Department does not feel this
development will affect our calls for service or response times.
Police: It is the opinion of the Fayetteville Police Department that this RZN will not
substantially alter the population density, and will not create an appreciable or
undesirable increase in the load on police services. This RZN will not create an
appreciable increase in traffic danger and congestion.

CITY PLAN 2025 FUTURE LAND USE PLAN: City Plan 2025 Future Land Use Plan
designates this site as Residential Neighborhood Area, which recognizes conventional subdivision
development but encourages traditional neighborhood development that incorporates low -intensity
non-residential uses.
FINDINGS OF THE STAFF
1. A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: The proposed P -I zoning is consistent with the City's Residential Neighborhood
Area land use designation to encourage traditional neighborhood development
that incorporates low -intensity non-residential uses. Based on current planning
objectives and principles of development and land use, staff finds that the
subject property, adjacent to Interstate 540, on a University of Arkansas
Razorback transit service route, and surrounded by other low -intensity non-
residential uses and a variety of housing types and densities, would be more
appropriately developed under the P -I zoning district than the current low -
density, single-family residential zoning designation.
Staff finds that the proposal fulfills Goal I of the City Plan 2025, to make
appropriate infilI and revitalization our highest priorities, and Goal 3, to make
traditional town form the standard. The subject property is currently vacant
and bound by I-540 to the north and west and by a neighborhood with a variety
of residential and non-residential uses and sprawling characteristics to the east
and south. Staff finds that rezoning the subject property to P-1 will minimize
the sprawling nature of the neighborhood by working to fill-in a vacant
property in an existing neighborhood with a low -intensity non-residential use
that has proven to be compatible with the surrounding neighborhood.
2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: Life Styles has provided a unique and community -wide service for persons with
disabilities since 1976. Staff finds that the proposed zoning is justified and
needed to accommodate an expansion for the facility to continue serving persons
with disabilities in a growing community. While the proposed use of the subject
property is classified as Use Unit 4, a use allowed in the underlying RSF-4
zoning district only by Planning Commission approval of a conditional use
permit, staff recommends in favor of the rezoning request, finding that any
future expansion of the facility would require a new conditional use permit
application to be reviewed by the Planning Division and the Planning
Commission. Staff finds that rezoning the property to P -I, Institutional, which
allows only city-wide uses, cultural and recreational facilities, and government

facilities as permitted uses, is appropriate as the underlying zoning district
would accurately reflect and govern the use and development of the property
with regulations established and adopted for the specific use. Furthermore,
development of the property will be subject to the requirements and regulations
of the 1-540 Design Overlay District and Commercial Design Standards.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: It is expected that a rezoning from RSF-4 to P-1 may create an increase in
traffic compared with that allowed under the existing zoning. A majority of the
students currently enrolled at the facility, which is located two properties
southeast of the subject property, walk or bike to the Life Styles campus or
utilize the Razorback bus service. Additionally, the facility provides van
transportation for students to and from the campus. Staff anticipates that
expansion of existing services to the subject property would not result in a
noticeable increase in traffic due to the variety of transportation options
available to the current and future students of the Life Styles campus.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and sewer
facilities.
Finding: Staff finds that the proposed zoning would not create undesirable impacts to
public services, or a density that is incompatible with the surrounding area,
based on a review of infrastructure, existing land uses, and the development
potential of the property.
Increased load on public services were taken into consideration and
recommendations from the Engineering, Fire, and Police Departments are
included in this report.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted under
its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the proposed
zoning is not desirable.
Finding: Not applicable. Staff recommends in favor of the requested zoning.

Dear Mr. Pate,
This letter is to fulfill the requirements of item 5 on the rezoning application.
a. The property owner is Life Styles, Inc. and there are no pending or proposed property
sales.
b. The zoning change is needed in order to develop the Life Styles College for Living. A
school is not allowed in the current RSF-4 zoning and the P-1 zoning is the most
compatible zoning for this type of development.
c. The property will be compatible with the surrounding properties. Interstate 540 is to the
west, apartments are to the east and townhouses to the south. The traffic will increase
slightly but most students will travel by van. The signage will be the maximum allowed
by the P-1 zoning. The building materials will blend with the surroundings and the
owner wants the development to be LEED certified.
d. Water and sewer is adjacent to the site. An 8" sewer main is located on the property and
a 6" water main runs along Sycamore and an 8" runs along Saddlehorne.

developments.

school is not allowed in the current RSF-4 zoning and the P-1 zoning is the most
compatible zoning for this type of development.
c. The majority of the students will travel by van. Therefore, the traffic will only increase
slightly.
d. The proposed development will NOT alter the population density or undesirably increase
the load on public services.
e. The proposed development is located in close proximity to their existing facility off
Sycamore. The property is too small to make residential development feasible and there
are not any permissible uses under the current zoning that will work with the proposed
development.

Dear Director Pate,
This document is in response to the request for a determination of whether the proposed
RZN 09-3218: (Life Styles, Inc., 363): Submitted by Bates and Associates for property
located North of Sycamore St. and Saddlehorn Avenue intersection would substantially
alter the population density and thereby undesirably increase the load on public services
and create an appreciable increase in traffic danger and congestion. The property
contains approximately 1.27 acres.
It is the opinion of the Fayetteville Police Department that this RZN will not substantially
alter the population density, and will not create an appreciable or undesirable increase in
the load on police services. This RZN will not create an appreciable increase in traffic
danger and congestion.

This development will be protected by Engine 2 located at 708 N. Garland.
It is 2 miles from the station with an anticipated response time of 6 minutes to the
beginning of the development.
The Fayetteville Fire Department does not anticipate any increase of call volume or
response times with the rezoning of this project.
