NOTICE TO MEMBERS OF THE AUDIENCE
All interested persons may address the City Council on agenda items of New and
Old Business. Please wait for the Mayor to request public comment and then
come to the podium, give your name, address, and comments about the agenda
item. Please address only the Mayor. Questions are usually answered by the
Mayor, Aldermen or Staff after the public comment period is over. Please keep
your comments brief and respectful. Each person is only allowed one turn at the
microphone for discussion of an agenda item.
All cell phones must be silenced and may not be used within the City Council
Chambers.
Below is a portion of the Rules of Order and Procedure of the Fayetteville City
Council pertaining to City Council meetings:
Agenda additions: A new item which is requested to be added to the agenda at a
City Council meeting should only be considered if it requires immediate City
Council consideration and if the normal agenda setting process is not practical.
The City Council may only place such new item on the City Council meeting's
agenda by suspending the rules by two-thirds vote. Such agenda addition shall be
heard prior to the Consent Agenda.
Consent Agenda: Consent Agenda items shall be read by the Mayor and voted
upon as a group without discussion by the City Council. If an Alderman wishes to
comment upon or discuss a Consent Agenda item, that item shall be removed and
considered immediately after the Consent Agenda has been voted upon.

Old business and new business.
Presentations by staff and applicants. Agenda items shall be introduced by the
Mayor and, if an ordinance, read by the City Attorney. City staff shall then present
a report. An agenda applicant (city contractor, rezoning or development applicant,
etc.) may present its proposal only during this presentation period, but may be
recalled by an alderman later to answer questions. Staff and applicants may use
electronic visual aids in a City Council meeting as part of their presentation.
Public comments. Public comment shall be allowed for all members of the
audience on all items of old and new business and subjects of public hearings. No
electronic visual aid presentations shall be allowed, but the public may submit
photos, petitions, etc. to be distributed to the City Council. If a member of the
public wishes for the City Clerk to distribute materials to the City Council before its
meeting, such materials should be supplied to the City Clerk office no later than
9:00 a.m. on the day of the City Council meeting. Any member of the public shall
first state his or her name and address, followed by a concise statement of the
person's position on the question under discussion. Repetitive comments should
be avoided; this applies to comments made previously either to the City Council or
to the Planning Commission when those Planning Commission minutes have been
provided to the Aldermen. All remarks shall be addressed to the Mayor or the City
Council as a whole and not to any particular member of the City Council. No
person other than the Aldermen and the person having the floor shall be permitted
to enter into any discussions without permission of the Mayor. No questions shall
be directed to an Alderman or city staff member except through the Mayor.
Courtesy and respect.
All members of the public, all city staff and elected officials shall accord the utmost
courtesy and respect to each other at all times. All shall refrain from rude or
derogatory remarks, reflections as to integrity, abusive comments and statements
about motives or personalities. Any member of the public who violates these
standards shall be ruled out of order by the Mayor, must immediately cease
speaking and shall leave the podium.
Interpreters or TDD for hearing impaired are available for all City Council
meetings, a 72 hour advance notice is required. For further information or to
request an interpreter, please call 479-575-8330.

SUBJECT: Amendment No. 3 to the Contract with Mitchell, Williams, Selig, Gates &
Woodyard, PLLC, for an additional $14,000, for the White River Water Quality
Standards Petition
RECOMMENDATION:
City Administration recommends approval of Amendment No. 3 to the Contract with Mitchell,
Williams, Selig, Gates & Woodyard, PLLC, increasing the compensation by $14,000 for legal
actions relating to the White River Water Quality Standards and negotiations with the ADEQ and
the Arkansas Pollution Control & Ecology Commission (APCEC).
BACKGROUND:
The Noland WWTP National Pollutant Discharge Elimination System (NPDES) permit contains
limits on Total Dissolved Solids (TDS) and minerals, specifically chloride and sulfate. In that
permit, the City was required to complete a Petition to the APCEC to change the local stream
standards. If the APCEC does not approve our request, we might be required to complete a
very expensive modification to our wastewater treatment plant to comply with the very strict
limits of chloride, 20 mg/I; sulfate, 20 mg/I; and TDS, 160 mg/I. The estimated capital cost for
this modification is approximately $45 million. The City's team consists of CH2M HILL, and the
Mitchell, Williams law firm.
DISCUSSION:
The contract between the City and Mitchell, Williams was originally set at $48,000 and was
amended in 2013 to $63,000 and again in 2014 to $83,000 to help cover un -anticipated costs
due to Act 954. However, additional complications have arisen requiring the Mitchell, Williams
firm to spend more time on the TDS and minerals effort than the amended contract allows for.
There are still several tasks to be performed. Below is the list of items that still need to be done:
• Team conference(s) to deal with comments by ADEQ
• Arrange for and meet with ADEQ water and legal division seeking agreement on the
requested minerals numbers
• Prepare and file Statement of Basis and Responsiveness Summary (Response to
Comments) with the APCEC

AMENDMENT TO AGREEMENT FOR ENVIRONMENTAL LEGAL SERVICES
CONTRACT AMENDMENT NO.3
This Contract Amendment No. 3 dated January 13, 2016 shall amend the original contract between the City
of Fayetteville, Arkansas, and Mitchell, Williams, Selig, Gates & Woodyard, PLLC., dated April 5, 2011,
referred to in the following paragraphs as the original contract.
This Contract Amendment No. 3:
1. Services to be Performed: Adds: Continued actions as required to obtain final approval from the Arkansas
Pollution Control and Ecology Commission (APCEC) to modify site specific water quality criteria in the White
River, to provide advice and guidance on what actions the City and its consultants need to take to successfully
accomplish the task of receiving approval to the petition from two committees of the AR Legislature, and to
assist in obtaining relevant approvals from USEPA. The following items are the currently known required
actions:
• Team conference(s) to deal with comments by ADEQ.
• Arrange for and meet with ADEQ water and legal division seeking agreement on the requested minerals
numbers
• Prepare and file Statement of Basis and Responsiveness Summary (Response to Comments) with the
APCEC
• Prepare for and attend (defend) legislative review of the Third -Party Rulemaking by Joint Legislative Public
Health and Welfare Committee and the Joint Legislative Rules and Regulations Committee

BACKGROUND:
On January 7, 2014, City Council approved Resolution Number 5645 to waive competitive
bidding and enter into a memorandum of understanding (MOU) with the Watershed
Conservation Resource Center (WCRC) expressing the City's desire to work jointly with the
WCRC to identify, fund and completed stream restoration project and work together on nonpoint
source (NPS) related issued associated with reducing nutrients and improving riparian and other
natural areas. To that degree, the City and WCRC have completed several restoration projects
though this partnership. These projects included, but are not limited to, the White River
Riverbank Stabilization Project, Niokaska Creek within Sweetbriar Park, Niokaska Creek within
Gulley Park and the West Fork of White River Airport Site
DISCUSSION:
The MOU (Effective date January 9, 2014) outlines a process by which task orders can be
developed for various activities that are in line with the goal of reducing NPS pollution and
restoring the City's streams. Task Order No 04 is presented pursuant to the MOU and consists
of continuing efforts to establish and maintain dense native vegetation as well as make minor
modifications as necessary to the stream to ensure the continued success of the completed
restoration projects.
Establishment of a high-density riparian zone consisting of native vegetation is critical in
creating stream and river restoration project that will, upon maturity of the vegetation, be able to
withstand the power of future flood events. This can take several growing seasons to achieve
and ensure the native species are not overrun with invasive species. Also, minor adjustments

occasionally need to be conducted within the stream or river channel restoration area to prevent
cumulative degradation of the restoration project. This task order will provide funding to the
WCRC to conduct activities that help to ensure establishment healthy, native vegetation and the
channel stability of the restoration projects. This in turn will help to project the investments
made by the City of Fayetteville to improve water quality, habitat and recreational values of our
local streams and water bodies.
BUDGET/STAFF IMPACT:
The Stormwater Quality Management/Nutrient Reduction project has been designated in part to
fund projects that improve stormwater quality in the City of Fayetteville and would be proposed
as the source for a portion of the matching funds ($65,500). Funding from this project also
includes participation from the Water and Sewer Department ($14,000) as they are directly
impacted by the work included in the task order. Task Order #4 totals $79,500 for one year of
maintenance services.

VEGETATION AND CHANNEL STABILITY ESTABLISHMENT
CITY OF FAYETTEVILLE STREAM AND RIVER RESTORATION
PROJECTS
STATE OF ARKANSAS
COUNTY OF WASHINGTON
This Task Order is written pursuant to the Memorandum of Understanding (MOU) as
described in Ordinance No. 5354 executed on January 9, 2014. The referenced MOU
pertains to potential stream restoration projects and associated services with the Watershed
Conservation Resource Center (WCRC). This Task Order entered into and executed on the
date indicated below the signature block by and between the City of Fayetteville and
Watershed Conservation Resource Center sets forth the project description, project
schedule and associated fees for these services related to maintaining and caring for
stream and river restoration projects previously constructed that were funded by the City
and grant funds.
Section I - Project Description
This project consists of maintaining stream and river restoration projects whose original
implementation was funded in -part with City funds. Establishment of a high-density riparian
zone consisting of native vegetation is critical in creating stream and river restoration
projects that will, upon maturity of the vegetation, be able to withstand the power of future
flood events. Also, minor adjustments need to be occasionally conducted within the stream
or river channel restoration area to prevent cumulative degradation of the restoration
project. The WCRC has constructed several stream and river restoration projects using
City funds in combination with federal and state grant funding sources over the past 5
years. To insure the long-term success of these projects, the WCRC has continued to
maintain and care for the projects after the expiration of the original grant, without financial
support from any outside entities. This project will provide funding to the WCRC to conduct
activities that help to establish healthy, native vegetation and channel stability of the
restoration projects in order to protect the investments that the City has made to improve
water quality, habitat, and recreational values of streams located within the City.
Section II - Project Timeframe
The project will be conducted from February 17, 2016 to February 16, 2017.
Section III - Scope of Services
The WCRC will perform services that are targeted to maintain and improve the long-term
functionality of the restoration projects that have been implemented utilizing City Funding.
These services include two major components: 1) Stream restoration activities that help to

create long-term stability and 2) Vegetation Management. Stream restoration activities
include but will not be limited to 1) minor hand repairs of structural components of the
restoration 2) removal of unintended gravel deposition within the project site 3) repair of soil
mattresses and 4) re -setting of boulders that may become displaced. Vegetation
maintenance and management activities include but are not limited to 1) irrigation of
vegetation during summer months 2) removal of invasive vegetation and 3) planting
additional native plants to enhance vegetation density. These funds are intended to cover
costs associated with minor and routine maintenance of the sites. Repair of damages of
projects resulting from infrequent flood events are generally not covered under this
agreement and will be addressed under supplemental agreements. But, if necessary, these
funds can be used towards major repairs.
Section IV - Fees and Payments
WCRC will perform the above -referenced Scope of Services amounts not to exceed
$79,500 for this one year agreement.
Section V - Memorandum of Understanding in Effect
Except as amended specifically herein, the Memorandum of Understanding Fayetteville
shall remain in full force as originally approved.
