A resolution awarding RFP #08-05 to Arkoma Playgrounds and Supply in the amount of $199,969 with a 5% project contingency of $9,998 for a total project cost of $209,967 for the construction of Rodney Ryan Park. Lake Recreation Regulations Park Land Dedication Ordinance Fund Monthly Report CIP Report HMR Monthly Report PRAB Agenda — August 4, 2008 2 FAYETTEVILLE PARKS AND RECREATION ADVISORY BOAD Meeting Minutes July 7, 2008 Opening: The regular meeting of the Parks and Recreation Advisory Board was called to order by Chairman Wade Colwell at 5:31 p.m. on July 7, 2008 in room 326 of the City Administration Building located at 113 West Mountain Street in Fayetteville, Arkansas. Present: Park and Recreation Advisory Board members Colwell, Biendara, P Jones, Waite, Mauritson, and Bitter were present for the first vote. Davidson and Hatfield came in immediately after that vote. Park Staff Edmonston, Humphry, Wright, Jumper, C Jones, Thomas, and the audience were in attendance. 1. Approval of June 2, 2008 PRAB Meeting Minutes PRAB Motion: Bitter motioned to accept the minutes as written, and Biendara seconded it. Motion passed 6-0-0 by voice vote. 2. Botanical Gardens Monthly Report: Walt Eilers, Board of Directors Eilers discussed the monthly report. One accomplishment mentioned was the BGSO achieving 1,000 members. Bitter asked about the encroachment issue mentioned in the report. Eilers said there were several piles of dirt, mulch, etc. by the trail on the Environmental Study Center's property. Scott Starr, Operations Director for the Botanical Gardens is working with C Jones to clean it up, and hopes to be able to report the site will be cleaned up by the next meeting. 3. Request to Rename Eagle Park to Rodney Ryan Park: Contact was made with the neighborhood requesting input to change the park name to Rodney Ryan Park. In addition, several letters from the public endorsing to name the park Rodney Ryan Park are in the PRAB Attachment section. This item was tabled at the June 2, 2008 PRAB meeting for public input. Colwell was impressed with the number of letters endorsing the renaming. Mauritson said that many people thought well of Dr. Ryan. Staff Recommendation: Approval to Rename Eagle Park to Rodney Ryan Park PRAB Motion: Colwell motioned to rename Eagle Park to Rodney Ryan Park. Mauritson seconded it. Motion passed 8-0-0 by voice vote. 4. Request to Name the Gary Hampton Softball Complex Pavilion as the Rotary Club of Fayetteville: This item was tabled at the June 2, 2008 PRAB meeting for public input. Colwell asked if this was to name the pavilion only. Edmonston said yes, it was only the pavilion. Staff Recommendation: Approval to name the new pavilion at the Gary Hampton Softball Complex as the Rotary Club of Fayetteville. PRAB Motion: Colwell motioned to accept the staff recommendation. Davidson seconded it. Motion passed 8-0-0 by voice vote. 5. SW 12 multi -family units 1 acre 0.2 acres $8, 160 Park Land at Aspen Ridge Developer is requesting to dedicate money in lieu of land. Staff recommends accepting money is lieu of land and would like to work with the developer in the future to acquire additional land to the north for the Tsa La Gi trail corridor. None Tsa La Gi trail corridor is located on the north side of this development. Staff anticipates working with the developer to secure the trail corridor when the land develops. Mauritson asked if there would be a water feature there, since it stays wet all the time. Hoskins agreed that it was a little wet in the area. He also said that this project would be in the ten to twelve apartment range. Jumper commented that the numbers always fluctuate until the final plat was approved. Colwell wanted to know if the whole area would be raised. Hoskins said they would try to keep a rain garden there. They are working on getting the fuel tanks and buildings removed. He has already spoken to Matt about the trail. PRAB Motion: Mauritson motioned to accept the staff recommendation, and P Jones seconded it. Motion passed 8-0-0 by voice vote. 6. Regional Park Update: Steve Aust with Nock Investments for Southpass Aust was not able to attend this meeting, but will be at the August meeting. 7. Request to apply for 2009 Arkansas Parks and Tourism 50/50 Outdoor Recreation Grant for the development of Fairlane subdivision park land: Parks staff hosted a Public Meeting at the 1.34 acre park land located at 1582 Fairlane Street to discuss priorities and needs for the 2009 Arkansas Parks & Tourism 50/50 Outdoor Recreation Grant. Citizens voted to apply for the grant to develop the park at Fairlane. The top three requested amenities were a walking trail around the park perimeter, a pavilion and a playground. C Jones reported a public meeting has been held at the potential parkland on Fairlane. The majority attending wanted that piece of property for the future park. The number one request was a walking trail around the perimeter of the park. Staff is asking PRAB to approve the park area and grant. Mauritson asked if the board was asking to approve the land and also the grant. Edmonston said yes, it would be both. Bitler wanted to know what was located east of the land. Jumper said it was private land. Parks and Recreation talked to the owner a few years ago, and he was not interested in selling. Bitler asked if any trees would be planted on the property. C Jones said yes, trees would be included in the design of the park. Mauritson asked what would happen if the grant isn't awarded to Fayetteville Parks and Recreation, or some other problem develops. Edmonston said that we have met all regulations, so that shouldn't happen. Colwell asked if the socioeconomic impact was considered. Wright said yes. The points are awarded to municipalities when they are applying for a project in a low income area of the community. Staff Recommendation: Approval to apply for 2009 Arkansas Parks and Tourism 50/50 Outdoor Recreation Grant for the development of Fairlane subdivision park land. PRAB Motion: Mauritson motioned to accept Staff recommendation. Waite seconded it. Motioned passed 8-0-0 by voice vote. 8. PRAB Term Proposal: Connie Edmonston, Parks & Recreation Director Currently PRAB terms are for 2 years with 4 positions being renewed each year. In reviewing the terms of other City Council appointed commissions, boards and committees, many are for 3 years. After reviewing this issue with City Attorney, Kit Williams, he recommended that we should also consider having 9 members on PRAB in the event a tie needs to be broken by the PRAB Chair. This would need to go before City Council for an amendment to the current ordinance. Mauritson asked if the existing terms would change, or would the changes happen as each term ran out. Edmonston said a decision would have to be made but the City Council would make that decision based on current terms and where board members are in their terms. Bitter asked why nine members were chosen instead of seven. Edmonston said that the City was growing, and more representation makes the most sense. The City Attorney also thought nine was a good number. Another good thing would be that the Chairperson would cast a tiebreaker vote, if necessary. Bitter said that to make sure he understood, the Chairperson would not vote on issues unless there was a tie that needed to be broken. Edmonston said yes. The Chairperson could give his opinion, but could not vote unless there was a tie. P Jones asked how the term change would happen. Edmonston said that if PRAB approves this request, it then would go before City Council. P Jones wanted to know if PRAB would have the final vote for recommendation. Edmonston said no. Mauritson commented that it was a good idea. He said that the longer you serve on the board, the more you learn. It's good to rotate out. Staff Recommendation: Approval to increase the terms of PRAB to 3 years having 3 new members appointed each year and to increase the members to 9. PRAB Motion: Mauritson motioned to accept Staff recommendation, and Davidson seconded it. Motion passed 8-0-0 by voice vote. 9. Other Business: Edmonston talked about the trail grant letter from Terry Easton, who is the co- chair of the 2008 National Trails Symposium. Edmonston said that Fayetteville Parks and Recreation has applied five times, and has been awarded four times. Wright talked about the many recreational programs that are going on now. He said they are doing very well. He mentioned the Yvonne Richardson Center is having a field trip every day with fifty to seventy kids attending. There is a waiting list for these field trips. The summer camps are filled to capacity, and concerts have about 1,200-1,500 people attending. He also said that the Girl's World Slow Pitch will be in Fayetteville next week. Colwell asked how many teams will be playing. Wright said forty to fifty teams will play. Waite asked how the dog obedience classes are going. Wright said they were going really well. There will be another one in the fall. Edmonston said that the budget for Parks and Recreation is very challenging. She is hoping that programs won't have to be cut. Davidson made the announcement that he is resigning from PRAB. He has moved fifty feet outside Fayetteville city limits, and for that reason he is not eligible to serve on the board. He can legally remain on the board until a replacement is found for him. He has enjoyed serving the citizens of Fayetteville. 10. FAYETTEVILLE CODE OF ORDINANCES TITLE IX GENERAL REGULATIONS Cross reference(s)--Penalty, 597.999. 97.068 Camping Prohibited No person in a park shall set up or use tents, shacks, or any other temporary shelter for the purpose of overnight camping, nor shall any person bring in or leave in a city park after closing hours any structure or vehicle to be used or that could be used for such purpose, such as house trailer, camp trailer, camp wagon or the like. Where permitted, horses shall be thoroughly broken and properly restrained and ridden with due care, and shall not be allowed to graze or go unattended, nor shall they be hitched to any rock, tree, or shrub. Lake Fayetteville, Lake Sequoyah, and Lake Wilson shall be open to the general public throughout the year from sunrise to sunset daily and shall be closed each day from sunset to sunrise; provided, each lake shall be closed Thanksgiving Day. The boat docks shall be closed on December 24th and shall remain closed through January 14th. (B) Permits for fishing and boating. (a) Each person 16 years of age or older is required to purchase a fishing/use permit for fishing on each lake or any stream within the city owned lake property. (b) A boating permit applies to the boat rather than the occupants thereof; however, all occupants of a boat, 16 years of age or older must purchase a fishing/use permit. Daily permits are valid only for use on the date of purchase. (C) Boat docking. Boat docking shall be permitted at the boat docks at Lake Sequoyah and Lake Fayetteville on a space available basis to season boating and fishing permit holders for the following per boat annual fees: (1) Lake Fayetteville (a) City resident (b) Non-resident (2) Lake Sequoyah $250.00 $325.00 $100.00 (D) Fishing. All fishing shall be done only from the lake bank or boat. No wading, swimming, or belly boats shall be permitted. Arkansas Game and Fish regulations shall control the number and size of fish which may be caught, however, the Fayetteville Parks and Recreation Division may provide additional requirements necessary to manage the fish population. All persons should check with the boat dock operator before fishing. It shall be unlawful for any person fishing to use trot lines, set lines, limb lines, cast nets, yo-yo's or jug fishing. FAYETTEVILLE CODE OF ORDINANCES TITLE IX GENERAL REGULATIONS (E) Boating. A boating permit for each boat must be purchased before its use on the lake. At boats must be docked at the boat landing at lake closing time. No boats except those used by lake employees wit be docked at any other location on the lake. (F) Place of entry. All persons are warned to enter the lake for boating or fishing only through the entrance at the lake office. Persons entering the lake property from any other location shall be considered trespassing and subject to prosecution. (G) Use of motors on boats. (1) In the event that motors are used on boats, the boats shall be operated in such a manner that they will not endanger other boats or the occupants thereof and shall not be operated in such a manner as to create heavy waves causing undue erosion of the shoreline. (2) No boats shall be permitted within 500 feet of the spillway of Lake Sequoyah. (3) No houseboats, water skiing, or jet skis allowed. Speeding and boat racing is not permitted and each outboard motor operator is cautioned to operate his motor in a safe and cautious manner. Failure to abide by this requirement will cause loss of boating permit. The dock operator shall revoke the boating permit of any boat which in his judgment is unsafe, overloaded, or operated in a careless manner. (4) All state laws governing boats must be complied with before using a boat on any city lake. Facilities for docking or landing of boats will be provided, however, the city will not be responsible for any damage or theft of boats, motors or equipment left in boats at docks. (H) Picnicking or other recreational activities. Picnicking is permitted on any part of Lake Fayetteville, Lake Sequoyah, or Lake Wilson or land surrounding said lakes, except within restricted nature areas, which are controlled by the city. Overnight camping is allowed only by special group permit. (1) Committing nuisances. No person shall commit any nuisance while on Lake Fayetteville, Lake Sequoyah, and Lake Wilson or any of the land surrounding the lakes belonging to the city, nor shall any trash or other materials be thrown into the CD97:7 (J) lakes or left about the shore line or on the premises of any lake, Fishing and boating prohibited near intake tower. No one shall climb upon, enter, or fish from the intake towers of the lakes. (K) Fishing on stream below dam. State laws governing fishing below dams shall be applicable on city property. Fishing permits are required to fish in the stream on city property below the dams. (L) Firearms and hunting. No firearms, hunting or trapping will be permitted on city owned property at any time. (M) Use of motor vehicles. No person at Lake Fayetteville, Lake Sequoyah, or Lake Wilson shall drive a motor vehicle or ride a motorcycle, ATV or bicycle on other than a paved vehicular road or path designated for that purpose. (N) Revoking permits. The city shall have the right to revoke any permit issued under this section if it is determined that the permittee willfully violated any of the provisions of this section. Installation of camera and connective sidewalk. Staff has purchased and will install an infrared light for the camera at Walker Park during the Fourth Quarter of 2008 as well as creating connecting sidewalks to the Skate Park. Infrared lighting will be complete in the Second Quarter. Sidewalk connection will be complete Fourth Quarter 2008. Lights of the Ozarks Lights of the Ozarks is a display of more than 500,000 Tights on the downtown square that runs from Mid -November until New Years. The installation will begin in October, the lighting ceremony will be held on November 22, and removal will start the first week of January 2009. The Wal-Mart Foundation awarded a $10,000 Grant for the 2008 Lights of the Ozarks program. Staff applied for a donation from the A&P Commission in the Spring but was denied. Additonal funding will be requested in Third Quarter to assist with lights. The A&P Commission typically donates $20,000 to $25,000 annually. Lighting Design - September Lighting Installation - October Lighting Ceremony - November Lighting Removal -January Community Park Development Purchase and develop a multi-purpose Community Park according to the Parks and Recreation Master Plan. Cummings property was selected for the community park site by PRAB and Park Staff. On September 7 2004, a resolution approving the mayor to enter into a contract with SouthPass Development was approved. This included the donation of 200 acres and 1 million dollars for the development of the park. Terracon Consultants, Inc. completed a work plan that described all necessary studies needed to determine the impact of the 33 -acre landfill located within the property. Estimated cost of the complete study is $50,000. Staff is working with ADEQ for potential funding of land fill remediation. Staff continues to meet with SouthPass developers. Project will begin as soon as the 200 acre park land is donated to the City. There are currently no changes. Park Beautifications Additional flowerbeds were requested at several of the Parks and Recreation Master Plan public meetings. Additional improvements are Happy Hollow planting and various entry features. Happy Hollow additional plantings will be ongoing through 2008. Several trees did not survive late planting and will be replanted in Fall 2008. Ongoing. To be completed along with the development of the new parks in 2008. Entry feature for Salem Park, David Lashley Park and Harmony Pointe Park are scheduled to begin Third Quarter, Happy Hollow Intersection trees have been planted and berms formed, replanting of trees will be in Fall. Additional plantings for Happy Hollow are anticipated through 2008. Neighborhood Park Development Funds are used to develop new neighborhood parks. St. Joseph Park (PD), Salem Park (PLD), Walker Park Lighting (PD) Harmony Pointe Park (PLD), David Lashley Park (PD, PLD, ST), Eagle Park (PLD), Davis Park Expansion (PLD), Gary Hampton Pavilion (PLD and Donation). Construction of David Lashley Park is complete. Trees were planted at Harmony Pointe Park in January 2008. Eagle Park RFP is currently advertised and construction is anticipated to begin in the Third Quarter of 2008. The Gary Hampton Pavilion under construction. Staff received a $15,000 donation from the Rotary Club for this pavilion. The Davis Park Expansion design will begin in the Fourth Quarter. St. Joseph Park 10 trees were ordered and planted in April 2006. Project completion date is pending on neighborhood fund raising. Salem Park and Harmony Pointe Park are complete with the exception of entry signs. The signs are expected to be completed in the Third Quarter, Walker Park trail connection to Block Street is anticipated to begin design in Fourth Quarter. Construction of David Lashley Park was completed in May 2008. Eagle Park design is out to bid with completion in Fourth Quarter. Gary Hampton Pavilion is under construction with completion anticipated in July 2008. Davis Park design to begin Fourth Quarter 2008. Other Park & Safety Improvements Improvements to Wilson Park east bridge and renovations to the Parks and Recreation Office. Gary Hampton Softball Complex scoreboard replacement, The Gary Hampton Softball Complex scoreboards were completed during the First Quarter. Wilson Park bridge construction is scheduled to start during the Fourth Quarter with completion in the Fall of 2009. The office renovations began during the Fourth Quarter of 2007 and will be completed in the Fourth Quarter 2008. Wilson Park bridge construction is scheduled to start in the Fourth Quarter and to be completed in 2009. Office renovations are to start Fourth Quarter and completed Fourth Quarter 2008. Gary Hampton Softball Complex scoreboard replacements began in January and was completed during the First Quarter. Gordon Long/Red Oak Improvements Trail and drainage improvements are needed at Red Oak and Gordon Long Parks. Water runoff from adjoining subdivisions discharges into the lower valley of Red Oak Park has created an erosion problem for the park trail, tree root erosion, and various park amenities. Gordon Long Park has two low water bridges that need to be renovated. This project will improve the safety and usability of the bridges over Scull Creek. The trail at Gordon Long also needs improvements. The Red Oak project was resubmitted to City Council and approved March 18, 2008 with $39,578 being removed from Sales Tax and charged to Park Land Dedication Funds. Staff is working with Dave Evans as a consultant from Game and Fish Commission to start the restoration of Red Oak Project in August 2008. Funds are to be used for a partial 50/50 matching Arkansas Parks and Tourism Outdoor Recreation Grant. Grant funding in the amount of $100,000 was awarded through the Arkansas Parks and Tourism Outdoor Recreation Grant Program for playground replacement, toddler playground equipment, and basketball courts for Sweetbrier and Davis Parks. Construction is complete and staff is preparing reimbursement materials for the Arkansas Department of Tourism Outdoor Grant to reimburse the City of Fayetteville for the grant portion of the funds. Bid awarded in December 2007 to RJR Enterprises. Began construction in January 2008, completion expected Second Quarter 2008. Reimbursement expected in Third Quarter. CIP STATUS - Quarterly Update Lake Improvements An ADA accessible restroom will be installed to the Lake Fayetteville Boat dock recreation area. The Lake Sequoyah boat docks are being evaluated for replacement/renovation. $12,000 was approved to replace the bleacher cover at Field # 3, resod ballfield access, concession building renovations, and restripe the parking lot at Lake Fayetteville Softball Complex. Evaluation of Lake Sequoyah Boat Docks began in March 2005 and will be continued in 2008. Funding for replacement of the Lake Fayetteville Environmental Study Center Boat Dock/Study Area is a joint project with the U of A Landscape Architect Department, CEI Engineering, Fayetteville Public Schools, Springdale Public Schools, and the City of Fayetteville. The City of Fayetteville and the schools are each providing $4,500 to fund the project. The U of A Class designed and assisted the City of Fayetteville, Springdale and Fayetteville Public Schools and Kevin Bennoch with building the dock and CEI stamped the design and overseen the project. The project is complete with the exception of a plaque recognizing the partnership. Evaluation of Lake Sequoyah Boat Docks began in March 2005 and will be continued in 2008. Lake Fayetteville Storage Building was completed in May 2007. Fishing pier construction began December 2007, completion is expected Third Quarter 2008. Forestry, Safety, & ADA Compliance Funds are used for the Celebration of Trees give-away, a tree inventory, the Community Tree Planting Initiative program, and grants. Funds will also to be used for unforeseeable emergencies occurring due to inclement weather, vandalism, replacement, or renovation of park amenities to meet ADA Safety standards. A public lands hazard tree assessment and mitigation is in process. Mt. Sequoyah ADA access is on hold until the pavilion is completed. The remaining funds will be used on ADA compliance for the AR Outdoor Recreation Grant projects at Sweetbriar and Davis parks since only partial grant funding was awarded. The Celebration of Trees is on the first Saturday of April in conjunction with Farmers Market season opening. This project is on-going. Mt. Sequoyah ADA access is scheduled to begin after the pavilion is completed by the FNHA, ADA AR Parks and Tourism Grant project began construction in January and completed in Second Quarter 2008. Mount Sequoyah Land Purchase The City of Fayetteville purchased 68 acres on Mt. Sequoyah in 2003 for $700,000 with 3% interest until paid. The payment plan extends five years to 2008. This park is Mt. Sequoyah Woods located at 100 N. Summit Avenue. The final payment has been made. Completion in 2008. Lake Fayetteville Trails Projects include developing trail maps, mile markers, signs and kiosks. Research is complete and the kiosk design will be completed in the Third Quarter of 2008 with construction complete by the end of 2008. Brochures completed March 30. Kiosks design should be compete Fourth Quarter 2008, Gulley Park Improvements Funds will be used to add a parking area in Gulley Park. A grant was received through the Arkansas Urban Forestry Commission. Project construction is complete. Brochures have been printed and a sign panel was installed to complete the grant obligation. Start: June 2007. Completion: April 2008. Brooks -Hummel Land Purchase The City purchased 13.75 acres located north of the Lake Lucille Spillway in 2007 for a principal amount of $495,000 with an interest rate of 6% annually for five years on the unpaid balance. The City agreed to see 1.89 acres to the United Presbyterian Church for $68,000. The City also agreed to sell a conservation easement for this property to the Fayetteville Natural Heritage Association for $179,500. This property has been names the Brooks -Hummel Nature Preserve by Resolution 108-07. A payment was made for 2008 and will be paid annually through 2012. The Trail was marked by Parks and Recreation Staff and Fayetteville Natural Heritage. The trail will be blazed by the end of 2008. Payments shall be made as follows: 2008 $78,000 2009 $78,000 2010 $78,000 2011 $78,000 2012 $73,000 City Council moved funding from the Sales Tax Fund to Parks Development for 2008 payment. Tree Escrow Funds from this project can be used in a variety of ways such as planting trees, maintaining trees with either a seasonal FTE or contract labor, or to identify planting spaces using a tree inventory. Funds for this project are deposited through the development processes defined in Chapter 167 of the UDC and must be used within seven years or be refunded. This money should first be spent within the development and second within one mile and/or within the appropriate quadrant. A public lands hazard tree assessment and mitigation is in process. This project is ongoing and completion is expected December 2008. Wilson Park Improvements Wilson Park is one of aur City's oldest and most popular parks. The trail, built in the early 1990's, is now eroding and needs to be repaired. The trail also needs to be lighted for safety reasons and to help deter vandalism. The rock building was built in the late 1930's by the Civil Conservation Corps and thus has plumbing, electrical, and flooring problems. Central heating/air will be installed in order to create offices for the Horticulturists. This building needs to be renovated to preserve the park's history. The seven by forty foot rock wall by the swimming pool exit displays a beautiful flowerbed, but is deteriorating and needs repair. The condition of the wall is a safety concern. Design of the trail renovation will begin in September 2008. Construction is expected to begin in Fourth Quarter 2008. Design for the structure of a new pool wall is complete and construction will begin in September 2008. A contract has been signed with the Electrical Engineer and the survey is complete. Additional funds are needed to complete this project. Wilson Park Trial Renovation construction will start in 2008 with completion in 2009.
