3. Consent Agenda:
Approval of the minutes from the February 23, 2015 meeting.
LSP 15-4992: Variance (ARCHIE WATKINS RD./HAMBLEN): Submitted by Kellye
Hamblen for property located south of Archie Watkins Road. The property is located in
Washington County and within the One Mile Planning Area and contains approximately
40.22 acres. The request is for a variance of the minimum street frontage and City water
service access requirements.
Motion:
Commissioner Cook made a motion to approve the consent agenda. Commissioner
Chesser seconded the motion. Upon roll call the motion passed with a vote of 7-0-0.

4. New Business:
ADM 15-4995: Administrative Item (ACTIVE TRANSPORTATION PLAN AND MAP):
Submitted by CITY STAFF. The Active Transportation Plan and Map is an update of the
2003 Fayetteville Alternative Trails and Transportation Plan and it will be utilized to plan,
prioritize and implement bicycle and pedestrian policy and infrastructure improvements in
the future.
Leif Olson, Long Range Planner, read the staff report.
William Chesser, Commissioner, complimented the quality of the graphic presentation of
the plan.
Porter Winston, Commissioner, agreed and added that the future trail maps were useful for
the planning of residential and commercial projects.
Tracy Hoskins, Chair, asked where information could be found that would give estimated
completion dates for the future trails.
Matthew Mihalevich, Trails Coordinator, said that that information was regularly presented
at the Active Transportation Advisory Committee meetings, where the trail construction
schedule is presented for a projected 5 year period. He said that some trails on the west side
were scheduled in the next 5 years.
Hoskins said that he had considered tabling the item to allow for further review and comment,
but as it appeared to be a guiding document [rather than a technical document] he was in
favoring of forwarding.
Motion:
Commissioner Cook made a motion to forward ADM 15-4995 to the City Council with
a recommendation for approval. Commissioner Autry seconded the motion. Upon roll
call the motion passed with a vote of 7-0-0.

RZN 15-4953: Rezone (1195 S. CURTIS AVEJAMERICAN LEGION, 564): Submitted by
ENGINEERING SERVICES, INC. for property located at 1195 S. CURTIS AVENUE. The
property is zoned RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and contains
approximately 6.81 acres. The request is to rezone the property to RMF-24, RESIDENTIAL
MULTI FAMILY, 24 UNITS PER ACRE.
Quin Thompson, Current Planner, read the staff report.
Daniel Lazenby, applicant, said he was present to answer questions.
Christopher Barker, neighbor, said he was concerned with multi-family development due to
the impact it could have on property values. He referenced a University of Pennsylvania study
showing that increased crime rates and lowered property values have been linked to multi-
family development. He said that crime is an issue currently with the nearby apartment
development to the north. He said he did not support the rezoning request, saying the
neighborhood would become less safe and require a higher Police presence.
Roy Cordeen, Landowner to the south, said that he was not present to oppose the rezone,
but is concerned about existing water runoff problems onto from this property onto his mobile
home park.
Salma Lopez, neighbor, said that she owns a house in the neighborhood directly to the east,
and that her parents own two houses in the same neighborhood. She said she was opposed
to the rezone due to the increased traffic that it would bring to her street (Curtis Ave) in an
area where her 6 year old child plays.
Alison McTaggart, neighbor, said that she opposed further multi-family development
because she feared it would increase existing problems, such as gunshots and vandalism that
occur.
Tracy Hoskins, Chair, asked if the future development plan for the site would be for
subsidized housing.
Staff replied that planning was unaware of any development plans, adding that none had
been submitted.
Hoskins asked staff whether water runoff issues would be addressed at the development
stage.
Andrew Garner, City Planning Director, replied that water runoff is a development issue. He
added that staff had contacted the Police Department seeking comment, and that none had
been given. He said that staff would contact the Police Department again after the hearing.
Porter Winston, commissioner, asked staff about future street stub-outs and connectivity.
Hoskins asked if a connection could be required to the west, where there is a large tract of
undeveloped land.
Garner replied that connectivity cannot be required of multi-family development.

Lazenby said that there were no plans to develop the property at this time.
Craig Honchell, Commissioner, pointed out that the surrounding zoning is RMF-24, and he
wanted the public to understand that compatibility with surrounding properties was the
deciding factor for him.
Motion:
Commissioner Honchell made a motion to forward RZN 15-4953 to the City Council
with a recommendation for approval. Commissioner Bunch seconded the motion.
Upon roll call the motion passed with a vote of 7-0-0.

RECOMMENDATION:
Staff recommends forwarding VAC 16-4986 to the City Council with a recommendation for
approval.
BACKGROUND:
Property and background. This property is lots 138, 147, 148, and 149 in the Crystal Springs
Subdivision which is zoned RSF-4, Residential Single Family Four Units per Acre. The lots are
undeveloped and contain a 35-foot utility easement along the northern property line. The
surrounding zoning and land use is listed in Table 1.

I,the undersigned,being all owners of the real estate abutting the easement hereinafter sought to be
abandoned and vacated, lying in Lots 138,148&149 Crystal Springs Subdivision, Phase III, City of
Fayetteville,Arkansas,a municipal corporation, petition to vacate and easement which is described in
the attached legal description.
That the abutting real estate affected by said abandonment of the easement are Lots#137, 139, 147,
150,&164 In Crystal Springs Subdivision, Phase III, Lots#12, 13, 14,15, 16, 17 in Cobblestone
Subdivision,Phase I, and Lot#54 in Cobblestone Subdivision, Phase Il, City of Fayetteville used by the

SUBJECT: PPL 15-4988: Preliminary Plat(MARK MILLS LN. &WINDSWEPT DR./SUMMIT
PLACE SUBDIVISION, 329): Submitted by BLEW & ASSOCIATES for property
located at MARK MILLS LN. & WINDSWEPT DR. The property is zoned RSF-4,
RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE and NC,
NEIGHBORHOOD CONSERVATION and contains approximately 16.58 acres.
The request is for a 45 lot single-family subdivision.
RECOMMENDATION:
Staff recommends approval of PPL 15-4988 with conditions of approval.
BACKGROUND:
This property is the Summit Place subdivision which contains 30.56 acres on the south side of
Township street approximately 500 feet east of College Avenue. The site is within the Hillside
Hilltop Overlay District (HHOD), is partially wooded and contains significant topography change.
The site transitions from 1,310 feet above mean sea level (AMSL) in the northwest corner to a
hilltop located at 1,500 feet AMSL in the southeast corner of the site, an elevation change of
approximately 200 feet. Slopes vary in percent gradient from 10% to greater than 20%. Access is
only currently available from Township Street with a street stub-out in the southwest corner of the
site.
The final plat for the Summit Place Subdivision was filed of record on January 22, 2008. This final
plat created 50 single family lots. The property was rezoned in July of 2011 from RSF-4,
Residential Single Family Four Units Per Acre to Neighborhood Conservation (NC), the
subdivision was then re-platted into smaller lots and several homes were built on the smaller lots.
In September 2014 the eastern portion of the site was rezoned back to RSF-4. The surrounding
zoning and land uses are depicted in Table 1,

Proposal:The applicant proposes to re-plat 16.58 acres of the Summit Place subdivision into 45
single family lots. This preliminary plat would leave the existing lots in the southwest portion of
the site and create larger lots (approximately half-acre lots) in the recently rezoned RSF-4 portion
of the site. Infrastructure improvements associated with this preliminary plat include the
construction of a turn lane along the site's Township Street frontage and minor water and sewer
improvements.
Water and Sewer System:Two sanitary sewer line extensions approximately 130 feet in length
each are required along Ozark View Drive and Champion Drive, and one water line extension
approximately 120 feet in length along Freshwater Avenue is required in addition to minor utility
work to serve lots created by this re-plat.
Adjacent Master Street Plan Streets: Township Street (Collector Street)
Right-of-way to be dedicated: Adequate right-of-way was dedicated for Township Street and all
interior streets with the filing of the original Summit Place Final Plat. However, additional right-of-
way dedication will be required for the Residential Streets in this neighborhood (Freshwater
Avenue, Ozark View Drive, Champion Drive, and Windswept Drive).The Master Street Plan cross
section for a Residential Street has increased from 40 feet to 43 feet since this neighborhood was
developed in 2008. The additional right-of-way dedication is primarily to accommodate sidewalk
on both sides of the street. The additional 1.5 feet of right-of-way on each side of these streets
should not impact the existing infrastructure.
Access and connectivity: The subdivision is accessed by two streets onto Township Street with
approximately 450 feet of separation. All interior streets have been constructed and were
dedicated with the filing of the Summit Place Subdivision. Marks Mill Lane stubs out in the
southwest corner of the site for future street connectivity. A full re-evaluation of the block length
and interior street layout is not warranted given the limited scope of this re-plat.
Street Improvements: A turn lane for westbound traffic turning into the primary subdivision
entrance off of Township Street is required per the most recent Summit Place re-plat in 2011. All
interior streets are required to have sidewalks in accordance with the Master Street Plan. The
applicant is requesting a variance for sidewalk only to be constructed on the east side of
Freshwater Avenue because no new residential lots are being created along this section of street
and steep topography exists along the west side of the street. Staff recommends in favor of this
variance.
Multi-use Trail: The Fayetteville Alternative Transportation and Trails (FATT) Master Plan
identifies a future multi-use trail to be located along the south edge of the Summit Place property
connecting to Overcrest Street at the southeast corner of the property. Due to the steep
topography, an alternative route can follow on-street along Champion Drive and switch back to
Marks Mill Lane. This proposed route will necessitate the construction of a multi-use trail and
dedication of easement from Overcrest Street to Champion Drive, approximately 300 feet. Staff
recommends the following trail improvements:
• Construct an 8-foot wide concrete trail from the southeast corner of the property
at Overcrest Street, northwest to Champion Drive. The location of the trail shall
be coordinated with Matt Mihalevich, Trails Coordinator, and should be situated
to minimize the slope of the trail and to save significant trees. An access ramp
shall be included at the trail intersection with Champion Drive and the cul-de-sac
at Overcrest Street.
• A 20-foot wide multi-use trail easement shall be dedicated on the final plat.

Parks: On September 12, 2005, the Park and Recreation Advisory Board (PRAB) recommended
accepting money in lieu of land for 50 single family units due to the development's proximity to
Gulley Park. Fees were paid for the final plat in January 2008 in the amount of $27,750. On
February 7, 2011, the Park and Recreation Advisory Board again recommended accepting money
in lieu of land for the additional lots, due to the development's proximity to Gulley Park, Craft Park,
Brooks-Hummel Nature Preserve and Gordon Long Park. Parks fees in lieu of land dedication
were paid prior to the most recent re-plat in the total amount of$26,880 (28 single family units at
$960/unit). Credit was given for the $27,750 previously paid resulting in a credit of $870. On
October 6, 2014, PRAB reviewed the project and recommended accepting money in lieu to satisfy
the park land dedication ordinance. Fees in the amount of$40,530 are due as follows:
45 single family units at$920/unit = $41,400
Credit = -870
Balance = $40,530
Public Comment: Staff has received comment from an adjoining property owner to the southwest
concerned with storm water runoff and an adjoining property owner to the southeast commented
that they would like a street stub-out to their property from this site.
RECOMMENDATION: Staff recommends approval of PPL 15-4988 with the following
conditions.
Conditions of Approval:
1. Planning Commission determination of street improvements. Consistent with the previously
approved conditions from the Summit Place re-plat (PPL 11-3902), staff recommends a turn
lane for westbound traffic turning into the primary subdivision entrance, Marks Mill Lane. This
turn lane should provide adequate stacking distance and transition rates for design speed as
approved by the City Engineering Division. This improvement is required to completed prior to
final plat.
SUBDIVISION COMMITTEE RECOMMENDED IN FAVOR OF THIS CONDITION (03-12-15)
2. Planning Commission determination of multi-use trail improvements. As discussed earlier in
this report, staff recommends the following trail improvements:
• Construct an 8-foot wide concrete trail from the southeast corner of the property at
Overcrest Street, northwest to Champion Drive. The location of the trail shall be
coordinated with the Trails Coordinator, and should be situated to minimize the
slope of the trail and to save significant trees. An access ramp shall be included at
the trail intersection with Champion Drive and the cul-de-sac at Overcrest Street.
• A 20-foot wide multi-use trail easement shall be dedicated on the final plat.
• This improvement is required prior to final plat.
SUBDIVISION COMMITTEE RECOMMENDED IN FAVOR OF THIS CONDITION (03-12-15)
3. Planning Commission determination of a variance of UDC Section 166.04.B.3.f. for sidewalk
to be only on the east side of Freshwater Avenue. Staff recommends in favor of this variance

given that this subdivision will not be creating any new residential lots along the subject section
of Freshwater Avenue and low pedestrian volumes in the area. In addition, there is a very steep
drop in this area of the site and greenspace and sidewalk would require substantial fill and/or
retaining walls.
SUBDIVISION COMMITTEE RECOMMENDED IN FAVOR OF THIS CONDITION (03-12-15)
4. Planning Commission determination of parkland dedication or fees-in-lieu. The Parks and
Recreation Advisory Board and applicant recommend parks fees in lieu of land dedication in
the amount of$40,530 prior to signing of the final plat. The payment of these fees may be
phased based on the number of lots being created with each final plat, in accordance with City
ordinance.
SUBDIVISION COMMITTEE RECOMMENDED IN FAVOR OF THIS CONDITION 03-12-15
5. The applicant shall dedicate additional right-of-way in conformance with the Master Street Plan
for the Residential Streets in this neighborhood (Freshwater Avenue, Ozark View Drive,
Champion Drive, and Windswept Drive) for a total of 43' right-of-way.
6. Preliminary plat approval is valid for one year. All permits to complete construction for all lots
within this preliminary plat are required to be obtained within one(1)year, subject to extensions
in accordance with the Unified Development Code.
7. All tree preservation, landscape, engineering and fire department conditions included herein
shall apply. All revisions shall be addressed prior to construction plan approval.
Standard conditions of approval:
8. Impact fees for fire, police, water, and sewer shall be paid in accordance with City ordinance.
9. Plat Review and Subdivision comments (to include written staff comments provided to the
applicant or his representative, and all comments from utility representatives:AR Western Gas,
SWBT, Ozarks, SWEPCO, Cox Communications).
10. Staff approval of final detailed plans, specifications and calculations (where applicable)for
grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks, parking
lot(s) and tree preservation. The information submitted for the plat review process was
reviewed for general concept only. All public improvements are subject to additional review
and approval. All improvements shall comply with City's current requirements.
11. All exterior lights shall comply with the City lighting ordinance. Manufacturer's cut-sheets
are required for review and approval prior to issuance of a building permit.
12. All mechanical/utility equipment (roof and ground mounted) shall be screened using
materials that are compatible with and incorporated into the structure. A note shall be clearly
placed on the plat and all construction documents indicating this requirement.
13. Trash enclosures shall be screened on three sides with materials complimentary to and
compatible with the principle structure. Containers may also be screened from view of the
street by the principal structure or vegetation. Elevations of the proposed dumpster enclosure
shall be submitted to the Planning and Solid Waste Divisions for review prior to building permit.

14. All freestanding and wall signs shall comply with ordinance specifications for location, size,
type, number, etc. Any proposed signs shall be permitted by a separate sign permit application
prior to installation. Freestanding pole signs and electronic message boards (direct lighting)
are prohibited in the Design Overlay District.
15. All existing utilities below 12kv shall be relocated underground. All proposed utilities shall
be located underground.
16. Preliminary Plat development shall be valid for one calendar year.
17. Prior to building permit, a cost estimate for all required landscaping is to be submitted to
the Landscape Administrator for review. Once approval is gained, a guarantee is to be issued
(bond/letter of credit/cash) for 150% of the cost of the materials and installation of the plants.
This guarantee will be held until the improvements are installed and inspected, at the time of
Certificate of Occupancy.
18. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. An on-site inspection by the Landscape Administrator of all tree protection
measures prior to any land disturbance.
C. Separate easement plat for this project that shall include the tree preservation area
and all utility easements.
d. Project Disk with all final revisions
e. One copy of final construction drawings showing landscape plans including tree
preservation measures submitted to the Landscape Administrator.
f. Completion of all required improvements or the placement of a surety with the City
(letter of credit, bond, escrow) as required by Section 158.01 "Guarantees in Lieu
of Installed Improvements"to guarantee all incomplete improvements. Further, all
improvements necessary to serve the site and protect public safety must be
completed, notjust guaranteed, prior to the issuance of Certificate of Occupancy.

Development: PPL 15-4988 Summit Place Subdivision Re-plat
Engineer: Blew and Associates, PA
Plan Comments:
1. Township turn lane widening and all associated improvements will be reviewed in depth at construction
level review. These improvements must be completed, accented, and maintenance bonded prior to
engineering sign-off on the final plat for this subdivision.
2. All utility work associated with this re-plat must be completed prior to final plat approval.
Standard Comments:
1. All designs are subject to the City's latest design criteria(water, sewer, streets and drainage). Review
for plat approval is not approval of public improvements, and all proposed improvements are subject to
further review at the time construction plans are submitted.
2. Any damage to the existing public street due to construction shall be repaired/replaced at the
owner/developers expense
3. Water and sewer impact fees will apply for the additional impact to the system. The fees will be based
on the proposed meter size and will be charged at the time of meter set.
4. Note,the following portions of all projects will typically not be reviewed by the Engineering Division
until time of construction-level review(unless specifically requested at plat review):
o Storm Sewer pipe/inlet sizing, gutter spread, profiles, or utility conflicts
o Sanitary Sewer pipe sizing, profiles, or utility conflicts
o Waterline fittings, callouts, or utility conflicts
o Street profiles
o Fine grading/spot elevations
Special Comments:
1. The Engineer of Record shall:
a. Review and approve material submittals. Approved submittals shall be submitted to the City for
concurrence before grading permit is issued.
b. Perform"Full Time" Inspection for the utility installation and shall be"In- Charge"of the
approval testing.
c. Provide a qualified representative for all testing and inspection.
d. Schedule testing with the Public Works Inspector.

e. Authorize geotechnical testing laboratory to provide reports directly to City in PDF format.
Reports shall be submitted in a timely manner.
f. Prepare material data sheets and test reports required by the specifications.
g. Insure that daily inspection reports and data sheets are submitted to the City of Fayetteville's
public works inspector weekly in PDF format.
2. 2012 Standard Water& Sanitary Sewer Specifications&Details apply
3. Demolition shall not begin until the appropriate erosion control measures and required tree preservation
fencing are installed
4. Prior to Project Acceptance (Final Plat, Certificate of Occupancy, or Temporary Certificate of
Occupancy)the following items must be performed or provided to the satisfaction of the Engineering
Department:
a. The work shown on the civil site package must be complete and the items on the final punch list
completed.
b. Vegetation must be established in accordance with Section 169.06 of the UDC and perimeter
controls removed.
c. One (1) set of as-built drawings of the complete project(excluding details) as a hard copy and in
Tiff or PDF format;
i. Public infrastructure and services shall be surveyed after installation in relation to
easements, property lines, and rights-of-way.
1. More than 2 ft deviation of design alignment of shall require new easement
dedication or adjustment of the utility/storm drain.
ii. Sanitary Sewer, and Storm Drainage (Including Private) elevations must be verified and
updated. (Elevations out of design tolerance must be corrected)
iii. Professional surveyor shall provide stamp drawings specifically identifying the limits of
as-built survey performed.
d. Unit price construction costs for review and approval and a single 2 year maintenance bonds in
the amount of 25% of the public improvements;
e. Certification that the streets, sidewalk, storm sewer, water, fire line, and sewer lines, etc., were
installed per approved plans and City of Fayetteville requirements;
i. Provide all Inspection Reports; approved submittals; Data Forms from Utility
Specifications (Including Consultants sewer TV report); compaction test results, etc...
f Surveyor's Certification of Compliance for monuments and property pins.
