New Business: ADM 14-4691: Administrative Item (3535 N. COLLEGE AVE./SJ COLLINS, 213): Submitted by JORGENSEN AND ASSOCIATES for property located at 3535 N. COLLEGE AVE. The property is zoned C-2, THOROUGHFARE COMMERCIAL and contains 6.61 acres. The request is for an access management variance and cross access variance for a new commercial development. Andrew Garner, City Planning Director, gave the staff report. Jeff ? , applicant from SJ Collins agreed with the conditions and was present for questions? No public comment was presented. Commissioner Chesser asked about cross access. Garner discussed that cross access would be constructed to the property line. Winston asked about constructing the connection and grade changes. They shouldn't have to make up the grade change. Honchell asked about the right-in, right out and discussed concern with cars speeding going to the south. He is concerned about traffic during construction as well. Commissioner Autry discussed that this is no different than anywhere else on College Avenue. The light at Millsap will help control traffic speeds. Yes, it could be an increase but with the addition of the light it will help. This is similar to the intersection of College and Township Walgreens and CVS Pharmacy that is under construction. This is typical to this area of town. Commissioner Cook agreed with staffs comments about the cross access. Wish we didn't have to have a light there. It will put more pressure on the Summerhill neighborhood. He asked about other businesses in the area that had similar language in limited cross access. Garner discussed Walgreen's had similar requirements in their cross access agreements. Kit Williams, City Attorney, discussed the Planning Commission could enforce the condition of approval if there was a disagreement on what type of businesses were a nuisance or competitor. Commissioner Chesser agreed with Commissioner Winston about the grade change. Motion : Commissioner Chesser made a motion to approve ADM 14-4691 as recommended by staff, finding: • In favor on Condition #1 for the curb cuts; • In favor of #2 as recommended by staff including the language that: "The access easement language shall allow the applicant temporary use of the access easement area for parking and dumpsters as indicated on the site plan with the applicant Planning Commission April 28,2014 3 Agenda Item 1 Minutes 4-14-14 Page 3 of 12 agreeing to remove obstructions and parking at the time the cross connection is made. In addition the access easement language shall allow the applicant to restrict nuisance tenants and competitors." Taking note that arbitration of nuisance and competitors will be by the Planning Commission. • Adding the note on #2 to indicate that the grade change for cross access shall not be laid on the shoulders of this applicant. Commissioner Winston seconded the motion. Commissioner Hoskins discussed that they have three curb cuts. I like the fact that the main entrance will line up with Masonic Drive. The traffic light will cure a lot of that. The transition between the two properties would be difficult. I will support the project. Upon roll call the motion passed with a vote of 9-0-0. Planning Commission April 28,2014 4 Agenda Item 1 Minutes 4-14-14 Page 4 of 12 LSD 14-4654: Large Scale Development (NORTH OF CULPEPPER/FAYETTEVILLE MEMORY, 099): Submitted by JORGENSEN AND ASSOCIATES for property located NORTH OF CULPEPPER PLACE. The property is zoned R-A, RESIDENTIAL AGRICULTURAL and contains 16.56 acres.The request is for a 64,000 square foot assisted living facility. Jesse Fulcher, Senior Planner, read the staff report. No public comment was presented. Blake Jorgensen, applicant, stated they are saving trees along the street. They would like to eliminate the cross-connections recommended by staff. Ed Tims, applicant, stated they have concerns for their patients safety with traffic from the cross connections. Unsure what the future use of the adjacent properties would be and what impact that would have on this facility. Commissioner Hoskins asked for clarification. Tims stated that they want to eliminate all cross access points. Commission Hoskins asked if the cross access requirement in the code was a shall or should. Kit Williams, City Attorney, stated the Planning Commission can decide if it's required or not. Commissioner Chesser stated that the applicant's concerns were legitimate. Fulcher explained staffs stance on the issue. Commissioner Chesser stated that a connection was not necessary and he has a concern with safety. Commissioner Cook stated that an access easement should be provided to allow the possibility for a future connection if it's appropriate. Williams asked the commission to think about why cross connectivity is required and how it is generally used in commercial settings. Commission Hoskins stated that the requirement could be relaxed since the developer owns the property to the south and west. They can control future users and access. Williams stated that the applicant could control access through deed restrictions since they own the property to the west and south. Motion: Commissioner Hoskins made a motion to approve LSD 14-4654 requiring easements to the west and south for cross access. Commissioner Chesser seconded the motion. Commissioner Hoskins stated that the Subdivision Committee didn't support the stub out because it stubbed into smaller lots that had been recently subdivided and there is a stub out to the east. Motion: Commissioner Chesser made a motion to approve PPL 14-4666, not requiring a street stub-out to the north. Commissioner Autry seconded the motion. No public comment was presented. William Chesser, Commissioner, asked if the capacity was limited by state statute or by the proposed zoning. Jason Corral, applicant, clarified the statement made by staff, saying that 5,000 bbl is the state limit set for restaurant/brew pubs. Thompson added that the annual maximum production was also limited by the I-PZD being proposed. Production above the 5,000 bbl maximum would require rezoning the property. Porter Winston, Commissioner, commented that this is another example of a property being renovated and put to great use due to its proximity to the trail network. Motion : Commissioner Chesser made a motion to forward IPZD 14-4662 to City Council as recommended by staff. Commissioner Cook seconded the motion. The property is zoned C-1, NEIGHBORHOOD COMMERCIAL and contains approximately 20.71 acres. The request is to extend the lot split approval for an additional calendar year. RECOMMENDATION: Staff recommends approval of ADM 14-4708 with conditions. BACKGROUND: The subject property is comprised of undeveloped land on the northwest corner of Gregg Avenue and Van Asche Drive. The property is zoned P-1, Institutional, and contains approximately 20.71 acres. A lot split to subdivide the property was discussed at the February 27, 2013 Technical Plat Review hearing, where it was approved conditionally. The final plat was approved administratively by the planning staff on March 13, 2013. Pursuant to Fayetteville Unified Development Code Section 166.20(A), lot splits must be filed of record with the Washington County Circuit Clerk within one (1) calendar year of approval, or the approval is considered invalid. The Planning Commission may grant an extension of the approval within eighteen (18) months of the original approval. The applicant requests that the Planning Commission grant an extension of Lot Split 13-4322. Surrounding land use and zoning is depicted in Table 1. Finding: The applicant cites delays caused by interest in the property by many potential buyers, which have recently been solidified. Property sales are often difficult to finalized, for a variety of reasons out of the owner's control. The property is zoned RPZD, RESIDENTIAL PLANNED ZONING DISTRICT and contains approximately 20.92 acres. The request is to extend the PZD approval for Planning Area 4 for an additional calendar year. RECOMMENDATION: Staff recommends approval of ADM 14-4721 with conditions of approval. BACKGROUND: Planning Area 4 within the Forest Hills Planned Zoning District (PZD) contains approximately 22 acres. The PZD was approved by the City Council on June 3, 2008 and provided each planning area a specific development timeframe. Planning Area 4 is located within Phase 2, which required that a final plat be obtained within six (6) years of the date of approval of the PZD, which is June 3, 2014. A preliminary plat for this planning area (The Villas at Forest Hills) was approved by the Planning Commission on September 27, 2010 and construction plans were approved by Engineering and Urban Forestry. According to the applicant the project has been delayed due to changing economic conditions. The surrounding zoning and land use is listed in Table 1.
