Proposed topics include: Agenda Items Requiring Committee Approval 1. City of Fayetteville Sanitary Sewer Rehabilitation Program contract extension with Insituform Technologies for$330,000.00. This will be the 2nd year of a 5-year renewable contract with Insituform. Under this contract extension, we will rehabilitate approximately 6,700' of 6", 8", 10", 12", 15" and 18" sanitary sewer main line pipe using the cured in place pipe method. This work is an integral part of the City's ongoing program to maintain its sewer system in the most long-term yet cost effective fashion, with cured-in-place linings being by far the lowest cost strategy for applications where it is appropriate. The City opened three bids on November 7, 2012. Solid Waste and Recycling Master Site and Facilities Plan Executive Summary is attached. The Solid Waste Division has contracted with McGoodwin, Williams, and Yates (MWY) of Fayetteville to develop a master plan and conceptual design for expansion and improvements to their office building and the surrounding site. The master plan and associated cost estimate is complete, and staff is negotiating with MWY for detailed design and construction management of the first phase of improvements, to include approximately 5200 square feet of new office space, new parking lots, and a new entrance drive on Armstrong Avenue. The estimated cost of this phase is approximately $3.5 million including design and other fees, and the design and construction can be completed within 24 months of the beginning of design. ISO Rating: On January 29, 2014, it was announced that the Insurance Services Office (ISO) has given the City of Fayetteville a much improved Public Protection Classification (PPC) rating. Due to the recent analysis of the structural fire suppression delivery system, Fayetteville has jumped from a Class 4 ISO rating to a Class 2 rating. This rating can affect the cost of homeowners' insurance, with a lower rating often meaning lower premiums. The City of Fayetteville was evaluated according to a uniform set of criteria, incorporating nationally recognized standards developed by the National Fire Protection Association and the American Water Works Association. A community's rating is dependent of the ratings of needed fire flows, emergency communications, the fire department, and the water supply. The ISO is a leading source of information about insurance risk that gauges the fire protection capability of local fire departments to respond to structure fires. A rating is assigned from 1 to 10, with Class 1 representing the best public protection and Class 10 indicating no recognized protection. Besides the potential effect on insurance premiums, PPC data are useful in strategic planning, budgeting and justifying fire protection improvements. 4. Prescribed Burn specifications for Lake Fayetteville Dam, and Lake Fayetteville Prairie Area have been distributed and a low bid has been accepted from Choeta Fire, LLC. For $6,432.00. Part of approved optimized vegetation management, the controlled burns are for vegetation management, specifically to keep undesirable plants from going to seed. The burns are expected to commence as weather permits sometime between mid- March to mid-April. 5. Arkansas Oklahoma joint stressor-response study committee met on January 6, 2014 to review and discuss proposals received from 7 companies/individuals to conduct the stressor-response study. The committee narrowed the field of 7 down to 3. They requested that these three candidates (Geosyntec, Ryan King of Baylor University, and Walther Dodds of Kansas State University) make a formal presentation to the committee on February 5th. After hearing these three presentations, the committee selected Ryan King to perform the study. Mr. King indicated that he would be able to perform the study for no more than the $600,000 budget adopted by the committee. (Fayetteville has already contributed to this effort)The schedule below remains current: - February 5, RFQ finalist presentations and consultant selection. - March 6, accept and approve consultant contract. - April 1, water sampling should begin. b. Illinois River Phosphorus EPA Total Maximum Daily Load (TMDL)process is still moving. The NWA IWG has been working together to develop a series of recommendations and comments to send to ADEQ Director Teresa Marks regarding the potential modeling scenarios to be followed by the EPA and their consultant during the modeling process. This letter has not yet been finalized as the IWG has requested comment and input from legal counsel before submitting to ADEQ. White River Use Attainability Analysis report was presented to the Arkansas Pollution Control and Ecology Commission(APCEC)for consideration on October 25th. The Commission approved the request be put on the table, which starts the 6-9 month process required for Commission and, if the Commission approves the change, EPA approval. In coordination with ADEQ,we scheduled the required public hearing to be held at the Fayetteville Public Library on February 13, 2014. . ADEQ has submitted a revised version of Regulation #2 (the Regulation to Establish Water Quality Standards for Surface Waters in the State of AR) to the AR State Legislature for consideration. The proposed version addresses a number of areas of concern to the State in general, including how minerals levels are addressed and defined. The US EPA has indicated to ADEQ that they would require up to several hundred additional stream segments within the State to be listed as `impaired' for minerals if the current language in Regulation#2 is not modified. ADEQ published a draft version of the impaired waterways list(the 303d list)based on the assumption that the two legislative committees that must consider this revised regulation would approve forwarding the regulation to the Arkansas Pollution Control and Ecology Commission(APCEC) for consideration and passage. Fayetteville has joined with a number of other cities throughout the State to provide support for this initiative via letters, emails, and attending the meeting of at least one legislative committee. The second committee met Wednesday, February 5`h, and also voted in favor of approving the proposed language. The APCEC is expected to consider and approve the regulation at their next meeting, which will allow the regulation to be forwarded to EPA for consideration just in time for ADEQ to submit the final 303d list to be considered for approval. One issue of importance regarding the proposed Regulation#2 is the new water quality standard being imposed for chlorophyll A in Beaver Lake. Should the lake be deemed to be impaired for this parameter at any time now or in the future, any point source discharger(such as the City of Fayetteville)would probably be subjected to increased scrutiny pertaining to potential contributions that such discharge might have to the impairment. Woolsev Wet Prairie Expansion. The Corps has confirmed that we can use of wetlands credits as mitigation for City projects, but that we will have to submit a formal prospectus for any bank, wetlands expansion, or for using credits from buffer zones. With the resolution of intent passed, we are proceeding with the next step-begin the selection process to select the consultant to develop preliminary plans for the potential future wetlands expansion and 2014 maintenance to the existing wetlands. 9. Water/Sewer Ordinance Updates are being developed by staff. The modifications will be chapter-wide, including numerous housekeeping updates, and bringing the ordinance into compliance with updated state and Federal codes. Our NPDES permits require the City to update and submit Discharge and Pretreatment Regulations (Article III of the Water/Sewer ordinance)to ADEQ by February 28, 2014. The revised Article III is being reviewed by the City Attorney office prior to submission to ADEQ. The new Water/Sewer ordinance will also include a new section on fats, oils and grease (FOG). 10. West Fork Sewer Connection plans and the draft contract are being developed. We have received a preliminary report from RJN, who is developing our Wastewater Master Plan, regarding West Fork's flows. Staff is working to reconcile the flow data to identify design requirements for the West Fork lines and impacts on Fayetteville's system. Jona Tucker, Preserve Manager The Nature Conservancy (TNC) (580) 777-2224 itucker@tnc.org Since 2011, we have completed approximately 4,000 acres of burning for TNC at Pontotoc Ridge Preserve. This includes reentry burns in the difficult Arbuckle Mountains region of Oklahoma which has a long history of catastrophic wildfires occurring and very little prescribed fire application due to the extreme nature of the fuels and topography. Without incident Chloeta Fire has provided services statewide for TNC. In the upcoming year, approximately another 4,000 acres are scheduled to be burned for the non-profit by Chloeta Fire at numerous preserves across Oklahoma in fuel types very similar to those found at Gavin's Point (FM3 tall grass, FM1 short grass and FM9 Hardwood Leaf Litter). Specifically, the burn will be located on a 50-acre tract that borders the west side of Broyles Road, is east of 54th Avenue, and south of Persimmon Street. The purpose of the controlled burn is for vegetation management of the wetland plant community within the City's mitigation site, as is required to comply with the Corps of Engineers requirements for site maintenance. The prescribed burn is expected to commence as weather permits some time early to mid- day Tuesday March 13, 2012, and will take several hours to complete. Chloeta Fire, LLC, an experienced and trained burn contractor will conduct the burn under supervision of the City's environmental consultant, Bruce Shackleford, of ECO Inc. City of Fayetteville and City of Farmington Fire Departments will be notified, and will be on standby status to assist if needed. Subsequent to completion of the prescribed burn, the burn crew will assure that all sparks and embers have been fully extinguished. The intended final result of these vegetation management activities is the continued effort to restore and maintain a remnant wetland prairie that is composed of native plant species. This will provide a unique natural resource that few neighborhoods have the opportunity to enjoy. This burn is part of the ongoing maintenance that has seen vegetation at this site flourish. In 2005, there were 47 identified plant species at the site. Today, there are 385 species, seven of which are tracked as elements of conservation concern (rare species) by the Arkansas Natural Heritage Commission. A containment line has been established to maintain the fire within the designated burn area. The public is welcome to attend the prescribed burn, however, bystanders will be required to stay behind the containment line. It's all part of a what's called a"prescribed burn"in which a designated area is purposefully set on fire in order to prevent bigger,more intense flames in the future.And it's exactly what took place Friday afternoon on roughly 11 acres around Lake Fayetteville. "It's protecting from a threat of a wildfire occurring but at the same time it's also changing the composition of the plants out here to a more natural you know more native prairie site,"added Masters. So there you go. It's good for us and good for nature. However to get the job done,according to Masters,it takes quite a bit of patience. "Right now the humidity and winds are really in our favor but later on this afternoon they're not going to be,"said Masters, adding,"so that's why we're sort of trying to hurry up and you know get on down the flanks and get things taken care of-it's all weather based." Now something you might not know is this whole process happens every 2 to 4 years.The reason?Believe it or not,to coincide with nature's history. "Years ago,there were historic low intensity fires that came through here and kind of kept the forest healthy,kept the grass lines clean and with all the elements we have now and fire suppression we get a really unnatural build up fuel,"said Masters.
