VAC 04-1134: Vacation (Sang/Hollywood Shake's, pp 559) was submitted by the City of
Fayetteville for property located at 1050 W. 6a`Street. The property is located at the intersection of
Sang and 6a'Street and is the location of the old Shake's building. The request is to vacate aportion
of the existing right of way located along the north side of the property. Planner: Jeremy Pate
Findings: See the attached maps and legal descriptions for the exact locations of the requested
utility easement vacation.
Background.• In 2003, the City of Fayetteville purchased this property in order to construct the
intersection improvements to Hollywood/Sang/6th Street. Sang Ave. was realigned to the east of
its previous location to line up with Hollywood on the South side of 6t' street. With the new
alignment of Sang Avenue, Old Farmington Road was reconfigured to intersect with Sang north
of the previous intersection. This realignment of Old Farmington Road left a portion of right-of-
way on the north side of this property that was not needed for City purposes. This portion of
right-of-way is now being requested to be vacated prior to the sale of the property.
Request: The applicant requests to vacate a portion of the existing right of way as described and
depicted in the attached documents.
The applicant has submitted the required notification forms to the utility companies and to the
City. The results are as follows:

Vacation of Right-of-Way
Please find attached a drawing of the Shakes property that was purchased by the City in
conjunction with the Sang/Hollywood Intersection Improvements. A portion of the Old
Farmington Road right-of-way is no longer required for the maintenance of this road due to the
relocation of the street in that area. It is in the best interest of the City to vacate this portion of
the right-of-way and combine that area with the old Shakes property for resell. A condition of
the right-of-way vacation should be the dedication of a utility easement to replace the right-of-
way area. A legal description is shown on the drawing for the area requested to be vacated.
Please let me know if our Division can provide any assistance in order to have this item placed
on the Planning Commission Agenda.

PETITION TO VACATE A RIGHT-OF-WAY LOCATED IN PART OF BLOCK

The Fayetteville City Council
We, the undersigned, being all the owners of the real estate abutting the right-of-way
hereinafter sought to be abandoned and vacated, lying in block 2 of the Westwood
Addition, City of Fayetteville,Arkansas, a municipal corporation,petition to vacate a
right-of-way which is described as follows:
SEE ATTACHED
That the abutting real estate affected by said abandonment of the right-of-way are 765-
12164-000, 765-14860-000, 765-14592-000 and 765-07549-000 City of Fayetteville used
by the public for a period of many years, and that the public interest and welfare would
not be adversely affected by the abandonment of the portion of the above described right-
of--way.
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the
above described real estate, subject, however,to the existing utility easements and sewer
easements as required, and that the above described real estate be used for their
respective benefit and purpose as now approved by law.
The petitioners further pray that the above described real estate be vested in the abutting
property owners as provided by law.

CCP 04-1132: Concurrent Plat(MACERICH, 135): Submitted by STEVE POWELL
for property located at MALL AVENUE AND GEORGETOWN SQUARE DRIVE. The
property is zoned C-2, THOROUGHFARE COMMERCIAL, and contains approximately
107.55 acres. The request is to approve the concurrent plat of the subject property with 4
commercial lots proposed.

Findings:
Proposal: The applicant requests approval of a concurrent plat for a 4-lot commercial
subdivision on the Northwest Arkansas Mall property owned by Macerich in anticipation
of future commercial development. The subject property is zoned C-2, Thoroughfare
Commercial. It contains approximately 107.55 acres and is located north of Mall Avenue
and west of College Avenue. The original Mall tract contained 122.09 acres. The
property has been split three times for which the preliminary and final plat requirement
had been waived. These subdivisions include two Dillard's tracts of 6.50 and 6.26 acres
and a 1.78-acre tract for Brandon Mall, which was approved on October 18, 2003.
The Concurrent Plat process may be utilized if no public improvements or right-of-way
dedications are required with the requested subdivision of land. The proposed tracts are
larger than one acre and will require Planning Commission approval at the time of
development. Dedications and public improvements will be evaluated at the time of
development.
The following description of a Concurrent Plat is from Ch. 166 of the Unified
Development Code:
166.01 Subdivision Approval
(C) Concurrent plat. When a property owner wishes to transfer one or more parcels,
each of which contains more than five (5) acres, or wishes to transfer parts of

Recommendation: Staff recommends CCP 04-1132 be approved subject to the following

Background: The University of Arkansas is in the process of constructing a new street, Harmon
Avenue, to service adjoining streets in the area as well as a new multi-level parking facility in the
southern portion of campus. The street will connect California Blvd/Center Street to Dickson
Street and will incorporate the southern portion of"existing"Harmon Avenue as well as the
northern portion of"existing"Buchanan Avenue. The University proposes construction of two
or more new buildings over the existing alignment of Buchanan Avenue in the near future.
Request: The applicant requests to vacate approximately 637 LF of William Street between
Duncan Avenue and Buchanan Avenue, 823 LF of Buchanan Avenue between Fairview Street
and Dickson Street, and two 15 ft. wide alleys within the old platted Shreve's Addition, of 305
LF and 358 LF respectively.

STREET AND ALLEY VACATION REQUEST

FAYETTEVILLE, ARKANSAS
The University of.Arkansas is in the process of constructing a new street, Harmon Avenue to
service adjoining streets in the area as well as a new multi-level parking facility in the southern
portion of the campus. The street will conned California Blvd/Center Street to Dickson Street
and will incorporate the southern portion of"existing" Harmon Avenue as well as the northern
portion of "existing7' Buchanan Avenue. It will also conned to the west end of William Street
that currently intersects with Buchanan Avenue. The University proposes construction of two or
more new buildings over the existing alignment of Buchanan Avenue in the near future.
To enable construction of the parking deck, approval has already been granted for vacating a 356
LF portion of Harmon Avenue immediately south of William Street, and also two unused alleys
within the old platted Shreve's Addition and Block 3 ofMcIlroy's Subdivision.
The University is requesting street vacations as follows:
L William Street(637 LF), between Duncan Avenue and Buchanan Avenue.
2. Buchanan Avenue(823 LF),between Fairview Street and Dickson Street.
The University is also requesting vacation of two (2) 15 ft wide alleys within the old platted
Shreve's Addition, of 305 LF and 358 LF respectively.
The University intends to complete construction of Hannon Avenue by April 2005. It will
extend from Fairview Street to Dickson Street and, the northern most section (300 LF approx)
will be on the same alignment as the existing Buchanan Avenue. The southern section (500 LF
approx)of Buchanan Avenue is to be vacated to make way for future development.
The University currently owns all of the property on both sides of Buchanan Avenue and
William Street that it is proposed be vacated.
There are not any property owners adjoining the proposed street vacation areas that need to be
notified regarding the vacation of these portions of street or alleys.
The existing utilities within William Street will remain undisturbed. The existing water and
sanitary sewer utilities within Buchanan Avenue will be abandoned, all overhead utilities will be
rerouted. A new 12" water line will be constructed along Harmon Avenue to improve water
distribution in the area. A new 8" sanitary sewer will be constructed along a section of Harmon
Avenue to service future University buildings in the area.
Based on the above the University is requesting street and alley vacations as shown on the
attached Vacation Plat.
