VAC 04-06.00: Vacation (Estates at Salem Hills, pp 206) was submitted by Tom Hennelly of
Tomlinson Engineering on behalf of Gerald Tomlinson for property located at The Estates at Salem
Hills subdivision. The property is located in Washington County in the City of Fayetteville Planning
Area. The request is to vacate a portion of the existing right of way located along the west and north
sides of the subject property. Planner: Jeremy Pate
Findings: See the attached maps and legal descriptions for the exact locations of the requested
utility easement vacation.
Background: A 45' right of way exists that extends north of the intersection of West Salem
Road and Rupple Road through this property. A 50' right of way exists that extends west of the
intersection of Howard Nickel Road and Salem Road through this property. The Planning
Commission approved The Estates at Salem Hills preliminary plat on July 14, 2003 with a
condition that the right of way be vacated and that the master street plan alignment be amended.
On August 5, 2003 the City Council considered the amendment to the master street plan
alignment. The City Council passed a resolution for this amendment at this meeting. The right of
way will now need to be vacated in order to comply with the conditions of approval for the
preliminary plat.
Request: The applicant requests to vacate a portion of the existing right of way as described and
depicted in the attached documents.
The applicant has submitted the required notification forms to the utility companies and to the
City. The results are as follows:

DEVELOPMENT IN ` A DIFFERENT ALIGNMENT TO
COMPLETE A CONNECTION WITH THE FUTURE EXTENSION
OF .RUPPLE ROAD NORTH
WHEREAS;the new alignment of Howard Nickell Road and Rupple
Road fulfill the intent of the Master Street Plan;and
WHEREAS,the new alignment of Howard Nickell Road:and Rupple.
Road will be beneficial to the City of Fayetteville's policy of connectivity;and
WHEREAS,this amendment to the Master Street Plan provides
connectivity with less topography constraints.

Findings:
Proposal: The applicant proposes to construct a new two-story office building at the corner of
Van Asche Drive and Steele Boulevard, in Steele Crossing Subdivision. The development is
comprised of 17,747 square feet professional office space, with 42 parking spaces proposed.
Forty-two (42)parking spaces is within the allowable parking ratio (+/- 30%) for professional
office development.

standards, and sidewalks are to be constructed through the drives.

Water/Sewer: Water and sewer lines exist to serve the proposed development.
Tree Preservation: Existing: 27%

Background:
A Large Scale Development application was originally submitted in April 01,but was tabled due
to discussion regarding development within the deed-restricted tree preservation area. The project
was again submitted April 15 and reviewed at the Technical Plat Review of April 28, 2004. The
Subdivision Committee forwarded the project to the full Planning Commission on May 14, with
instructions for the developer to investigate the potential for relocating the dumpster to the Target
lot, off of the service drive. There have been no identified concerns with the development, with
the exception of development within the deed-restricted area and relocation of the dumpster. The
applicant indicates that attempts to gain approval to relocate the trash enclosure off-site to the
Target lot failed, and the developer intends to screen as required.
Recommendation: Staff recommends approval of LSD 04-1052 with the following
conditions:
Conditions of Approval:
L Planning Commission determination of Commercial Design Standards. Stafffinds the
proposed building to meet all Commercial Design Standards.
2. A letter of authorization allowing the applicant to develop the subject property shall
be submitted for the Planning files,prior to final approval.
3. Trash enclosures shall be screened on a minimum of three(3) sides with materials
that are complimentary to and compatible with the proposed building. Access to the
enclosure shall not be visible from the street, pursuant to city ordinance. Staff
recommends the enclosure be gated at its entry with wrought iron or similar, to
ameliorate the impact of view from both Van Asche Drive and Steele Boulevard.
4. Parking lot lighting shall be a maximum 35 feet in height, utilizing full cut-off sodium
fixtures that are shielded and directed downward, away from adjacent properties.
5. Sidewalks shall be constructed through the proposed drive, pursuant to city
ordinances.
6. Any future proposal for landscape development within the deed-restricted tree
preservation easement shall be approved by the Landscape Administrator.

8. Staff approval of final detailed plans, specifications and calculations(where
applicable) for grading, drainage, water, sewer, fire protection, streets (public and
private), sidewalks,parking lot(s) and tree preservation. The information submitted
for the plat review process was reviewed for general concept only. All public
improvements are subject to additional review and approval. All improvements shall
comply with City's current requirements.
9. Large scale development shall be valid for one calendar year.
10. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. Separate easement plat for this project that shall include the tree
preservation area.
C. Project Disk with all final revisions
d. Completion of all required improvements or the placement of a surety with
the City(letter of credit,bond, escrow) as required by§158.01
"Guarantees in Lieu of Installed Improvements" to guarantee all
incomplete improvements. Further, all improvements necessary to serve
the site and protect public safety must be completed,not just guaranteed,
prior to the issuance of a Certificate of Occupancy

ADM 04-1063: Administrative Item(Duncan Ave. Apts) to request an extension of the
expiration date of the Large Scale Development 03-13.00 approved by the Planning Commission.

The current request(ADM 04-1063) is to extend LSD 03-13.00 (Duncan Ave.Apts)large scale
development approval for one year, to expire on May 27, 2005.
Background:
Large scale development approval for this project was granted by the Planning Commission with
an 8-0-0 vote on May 27, 2003 with a condition that the approval would be valid for one calendar
year. The approval is for a multifamily apartment development west of Duncan Avenue, north of
12th Street. The development includes 36 units in three buildings with a total of sixty bedrooms.
Current Status:
A building permit has been requested however issuance of the permit is pending. The applicant
has requested an extension of the Planning Commission approval in order allow permitting of
this development without having to take it back through the development review and approval
process. A letter from the applicant is included. Several conditions of approval, including a
property line adjustment, easement plat, and Board of Adjustment approval for a variance have
been accomplished. Based on the current status of the project,however, the applicant finds it
necessary to request additional time in order to complete required directives.
Recommendation:
Staff recommends approval of an extension until May 27, 2005. After the May 27, 2005
expiration date, the Large Scale Development is required, by ordinance, to be resubmitted in total
for Planning Commission approval, in accordance with all development regulations.

166.20 Expiration Of Approved Plans And Permits
(A) Applicability. The provisions of this section apply to all of the following plans and permits:
(1) Preliminary plats;
(2) Planned zoning district developments;
(3) Conditional uses;
(4) e
(5) Lot splits;
(6) Physical alteration of land permits;
(7) Storm water, drainage, and erosion control permits;
(8) Tree preservation plans;
(9) Sign permits; and,
(10)Floodplain development permits.
(B) One-year time limit.
(1) Tasks to be completed. All of the above-enumerated plans and permits are conditioned upon the
applicant accomplishing the following tasks within one(1)year from the date of approval:
(a) f c: irenovation or . tr and/or,
(b) For a lot split, record a deed or survey at the Washington County Circuit Clerk's Office,
stamped for recordation by the City Planning Division; and/or,
(c) Receive a Certificate of Zoning Compliance; and/or,
(d) Receive all permits and approvals required by City, State, and Federal regulations to start
construction of the development or project.
Expiration. If the required task(s)are not completed within one(1)year from the date of approval or
during an allowed extension period,all of the above-enumerated plans and permits shall be rendered
null and void.

Dear Mr. Pate:
Please accept this correspondence as the request for an extension on the Large Scale
Development approval for the above referenced project. The LSD was approved by the Planning
Commission at their May 27, 2003 meeting. The following is an update:
1)'' We Pave-obtained our wetlands permit and approval of the mitigation plan.
2) We have obtained approval from Engineering on the construction drawings.
3) We have obtained approval on the utility lines from the Arkansas Health Department.
4) ' A'submittal has been made to the Inspections Department for a building permit_
This project has several extenuating issues that have delayed us from finalizing approvals
within the allotted time frame. We have off-site sanitary sewer work that will be done by a
pipe-bursting method, and had additional time associated with the wetlands permitting and the
approval of the mitigation plan. The owner was also contacted by the City Tree and Trails Task
Force Committee late in 2003 to discuss a possible purchase of the land. This consideration
terminated in February of this year.
We plan to submit the additional information requested by the Inspections department to
obtain the building permit, record the property line adjustment, and prepare the park deed to -
finalize the project within the next month to start construction this summer. Please call if you
need additional information or data for your consideration.

under review for Nationwide 404 permit approval. (See attached letter.)
Background-
At the Subdivision Committee meeting of April 03, 2003,the applicant proposed 48 units(80
bedrooms), with 87 parking spaces on 2.46 acres (a density of+/- 19.5 DU/acre). The item was
tabled pending the provision of further information. The current proposal is for 36 units(60
bedrooms)with 66 parking spaces on 2.0 acres (a density of+/-18 DU/acre). A parkland
dedication of 0.466 acres is included with the current proposal. This proposal was heard by the
Subdivision Committee on May 15,2003.
The Subdivision Committee forwarded the Large Scale Development to the full Planning
Commission subject to all staff comments. Public comment and Subdivision Committee
discussion included drainage,density and a privacy fence.
RECOMMENDED MOTION:
Staff recommends approval of the large scale development with the following conditions:
Conditions of Approval-
A. Planning Commission determination of offsite sanitary sewer improvements. Staff is
recommending that the existing sanitary sewer line be replaced for approximately 650'
with a new 8"PVC line to provide sufficient capacity to serve this development.All
existing service lines shall be connected to the new 8"sewer line at the cost of the
developer.

2. Dedication of ROW 25' from centerline along Duncan Avenue per MSP requirements for
an historic collector street shall be required prior to filing.
3. Duncan Avenue shall be improved by the developer a minimum of 14' from centerline,
with curb and gutter, storm drains, and a 6' sidewalk along the west side of Duncan
Avenue in accordance with the Master Street Plan and Chapter 171 of the Unified
Development Ordinance.
14, The Board of Adjustment must approve a variance of the required frontage for the
01-14.00 project. Lot width minimum for multifamily development is 90 feet(§161.06). The
%0p variance request is for+/-46.49 feet of frontage for the lot which will remain after the
parkland is split off to be dedicated to the City.
5. . A Lot Line Adjustment to create the 0.466 acre parkland tract shall be approved prior to
the issuance of a building permit.
6_ All overhead electric lines less than 12 kv shall be placed underground.
7. An 8 foot privacy fence shall be constructed along the south property line.
Standard Conditions of Approval:

9. Staff approval of final detailed plans, specifications and calculations (where applicable)
for grading, drainage,water, sewer,fire protection, streets(public and private), sidewalks,
parking lot(s)and tree preservation. The information submitted for the plat review
process was reviewed for general concept only. All public improvements are subject to
additional review and approval- All improvements shall comply with City's current
requirements.
10. The PRAB has determined that 0.466 acres shall be dedicated for parkland;with payment
of$2266.25 for the balance to meet City requirements.
11. Sidewalk construction in accordance with current standards to include a minimum 6'
wide sidewalk along Duncan Avenue.
12. Large scale development shall be valid for one calendar year.
13. Prior to the issuance of a building permit the following is required:
a. Grading and drainage permits
b. Separate easement plat for this project that shall include the tree preservation area.

A. Completion of all required improvements or the placement of a surety with the
