The property is in the county and contains approximately 40.14 acres. The request is for a residential subdivision with 23 lots ranging in size from 1.02 acres to 2.46 acres. 2. LSP 03-43.00: Lot Split (Hoskins/Brookhaven,pp 214)was submitted by Mel Milholland of Milholland Company Engineering& Surveying on behalf of Tracy Hoskins for property located at Lot 32, Brookhaven Estates. CUP 03-16.00: Conditional Use(Shackelford, pp 558) was submitted by Mel Milholland of Milholland Company on behalf of Tom O. Shackelford for property located at 2921 Old Farmington Road. The property is zoned RSF-4, Residential Single-family, 4 units per acre and contains approximately 0.63 acres. The request is to allow the construction of a single story duplex on Tract B containing 6 bedrooms total with 6 parking spaces planned. Right-of-way being dedicated: ■ Howard Nickell Road(Principal Arterial on the MSP) requires 110 feet of ROW. • Salem Road (Minor Arterial),the north-south road bisecting the property,requires 70 feet of ROW south of Howard Nickell Road. The applicant is requesting to amend the Master Street Plan,vacate the existing right-of-way, and dedicate 90 feet of ROW along Howard Nickel Road through the entire proposed development in a different alignment. Staff is in support of this request. The applicant is indicating 60 feet of right-of-way for West Salem Road to the south, which is compliant with the Master Street Plan. All interior streets will likewise be 28 feet in width. West Salem road is being paved along the length of the property frontage to the south. Background: The preliminary plat for The Estates at Salem Hills was heard at the Technical Plat Review on June 18, 2003 and at Subdivision Committee on July 03, 2003. The Subdivision Committee forwarded the project to full Planning Commission,with an amended condition regarding the County approval of septic systems. Recommendation: Forward to full Planning Commission Conditions to Address/Discuss: 1: Prior to Planning Commission approval of the preliminary plat, a conditional letter of approval for individual septic systems on those lots less than one and one-half acre shall be obtained from the county and submitted to the Planning Division for review. 2. Prior to final plat approval, individual septic system approval shall be obtained from the County for those lots having a gross area of less than one and one-half acre. A permit for individual septic systems must be granted by the Arkansas Department of Health for each proposed lot in this size category. 3. The lot split to create that portion of the property to the west of Howard Nickel Road shall be filed with the county prior to final plat approval. 4. Planning Commission consideration and City Council approval for an amendment to the Master Street Plan must be obtained for the proposed Howard Nickel Road alignment. 5. The request for vacation of right-of-way for the current Howard Nickel Road alignment shall be considered by Planning Commission and approved by City Council. 6. Access to Howard Nickel Road shall be limited to those lots without frontage onto interior streets. A provision for shared access shall be indicated on the final plat for a maximum of five curb cuts onto Howard Nickel Road. 7. Required Right-of-way dedication for Howard Nickel Road(90') and West Salem Road (30'from centerline) shall occur with the final plat. 8. My only other thought was I wished that viv did not have to conic off of Howard Nickel Road for the two lane blacktop but as this is on tite south side of my property and will likelycuttil destroying an asphalt driveway That I have reccruly installed as few as only4 months ago with an expense of well over$5000,00 dollars for this portion of the road. Environmental Health Specialist, Washington County Re: The Estates at Salem Hills(proposed) Location: Part of the NW 1/4 SWI/4, of Section 29 Township 17N, Range 30W; Salem and Howard Nickel Road, Fayetteville Developer: Tomlinson Asphalt Designated Rep: Reba Bailey Date: 10 July 2003 This proposed 24-lot subdivision is to be serviced by public water. Soil pits were observed on each lot to determine the suitability of the available soils for the placement of individual subsurface sewage disposal systems. I have confirmed the findings of Reba Bailey, Designated Representative, that all 24-lots have suitable soils for placement of standard septic systems. This proposed subdivision is hereby approved for development using standard sewage disposal systems with the following comments and conditions: 1. This approval is contingent upon approval of the water lines by the Division of Engineering-ADH. No development may take place on any lot until that approval is granted. 2. The appropriate detailed drawings of water lines; plats, and review fees must be submitted to the Division of Engineering before approval of the subdivision. These drawings shall include the location and number designation of the soil pits. 3. Each lot owner will be required to obtain an individual sewage disposal permit from the Washington County Health Department before construction of any kind is initiated on the lot. 4. The disposal system for each lot must be located in the area of July 14,2003 Planning Commission PPL 03-11.00(Salem Hills) Page 1.6 the observed and approved soil pit. Any relocation of the system will require further investigation by the Department. 5. The areas of the proposed primary and secondary disposal fields must be protected during the construction of all structures and roads and the placement of service lines so as not to disturb the natural properties of the soils. 6. This approval is for Lots 1- 24. No lot maybe further subdivided without prior approval from the Department. Any further subdivision will require prior approval from the Arkansas Department of Health. 7. Preliminary Permits for construction, for Lots 21 and 22 have been submitted to the Washington County Health Department Office and will be approved for construction once approval for the subdivision as a whole has been granted. Act 402 of 1977, prohibits a property owner from obtaining approval of an individual septic system permit before final approval of said subdivision has been granted. 8. This approval is based upon information provided by the Designated Representative and the Local County Environmental Health Specialist. If any of that information is found to be inaccurate, the approval may be revoked. This request must be considered by the Board of Sign Appeals, since it is a variance from the Sign Ordinance. 12. Sidewalk construction in accordance with current standards to include a minimum six foot sidewalk and ten foot greenspace along Highway 112 for 120 linear feet as indicated: 13. Plat Review and Subdivision comments (to include written staff comments provided to the applicant or his representative, and all comments from utility representatives - AR Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications) 14. Staff approval of final detailed plans, specifications and calculations (where applicable)for grading, drainage,water, sewer, fire protection, streets (public and private), sidewalks,parking lot(s) and tree preservation. The information submitted for the plat review process was reviewed for general concept only. All public improvements are subject to additional review and approval. All improvements shall comply with City's current requirements. 15. Large scale development shall be valid for one calendar year. 16. Prior to the issuance of a building permit the following is required: a. Grading and drainage permits b. Separate easement plat for this project that shall include the tree preservation area. C. Project Disk with all final revisions d. Completion of all required improvements or the placement of a surety with the City(letter of credit,bond, escrow) as required by §158.01 "Guarantees in Lieu of Installed Improvements"to guarantee all incomplete improvements. Further, all improvements necessary to serve the site and protect public safety must be completed, not just guaranteed, prior to the issuance of a Certificate of Occupancy 17.
