THE PLANNING COMMISSION
A meeting of the Fayetteville Planning Commission will be held Tuesday, May 27, 2003 at 5:30
p.m. in the City Administration Building, 113 West Mountain Street, Room 219, Fayetteville,
Arkansas.

1. CUP 03-13.00: Conditional Use (Sequoyah United Methodist Church,pp 369)was
submitted by Millholland Company Engineering & Surveying on behalf of the Sequoyah
United Methodist Church for property located at 1910 Old Wire Road. The property is
zoned R-1, Low Density Residential and contains approximately 7.64 acres. The request
is for a 1080 s.f. District Superintendent Office and an additional 22 parking spaces.

2. LSP 03-38.00: Lot Split(Kulish,pp 565) was submitted by Kurt Kalish for property
located at 2008 E. Huntsville Road at the corner of E. Huntsville and Dockery Lane. The
property is zoned R-1, Low Density Residential and contains approximately 0.54 acres.
The request is to split the property into two tracts containing 0.27 acres and 0.27 acres.
3. ADM 03-07.00: Administrative Item(University Square,pp 558)was submitted by
Bob Hill of the Nickle Hill Group for property located at the northwest corner of 6th
Street and Shiloh Drive, within the boundaries of the Overlay District. The request is to
allow four(4) wall signs in the Design Overlay District.
4. ADM 03-09.00: Administrative Item (Lowe's C-PZD signage, pp 557/596)was
submitted by Mark Millis on behalf of Lowe's Home Centers for property located at the
southwest corner of Finger Road and Hwy 62W(6`h Street). The request is for
clarification of the signage requirement for the Lowe's lot within this PZD as determined
by the Planning Commission under commercial design standards guidelines.
5. CUP 03-12.00: Conditional Use (Butterfield Trail Village,pp 175) was submitted by
Kevin Yates of CEI Engineering Assoc., Inc. for property located at 1923 Joyce Blvd.
The property is zoned R-2,Medium Density Residential and contains approximately
45.75 acres. The request is for a nursing home/convalescent home in the R-2 zoning
district(use unit 4) for the addition of a 22,347 square foot Alzheimer's care unit.

6. LSD 03-15.00: Large Scale Development (Butterfield Trail Village, pp 175) was
submitted by Kevin Yates of CEI Engineering Associates, Inc. on behalf of Butterfield
Trail Village for property located at 1923 Joyce Boulevard. The property is zoned R-2,
Medium Density Residential and contains approximately 45.75 acres. The request is for
the addition of a new 22,347 square foot Alzheimer's care unit with 34 additional parking
spaces proposed.
7. LSD 03-13.00: Large Scale Development(Duncan Avenue Apartments, 561)was
submitted by Mandy Bunch on behalf of James Mathias of Mathias Rentals for property
located west of Duncan Avenue and north of 12th Street. The property is zoned R-2,
Medium Density Residential and contains approximately 2.0 acres with 36 units (60
bedrooms) and 66 parking spaces with a 0.466 acre parkland dedication proposed.
8. LSD 02-29.10: Large Scale Development (Sequoyah Commons, pp 485) was
submitted by Mandy Bunch of EB Landworks on behalf of Greg House of Houses
Development for property located between Olive Avenue&Fletcher Avenue, south of
Spring Street. The property is zoned R-2, Medium Density Residential and contains
approximately 2.06 acres with 39 dwelling units proposed(48 bedrooms).
All interested parties may appear and be heard at the public hearings. A copy of the proposed amendments and other
pertinent data are open and available for inspection in the Office of City Planning(575-8267), 125 West Mountain
Street,Fayetteville,Arkansas.

RECOMMENDED MOTION:
Staff recommends approval of the conditional use subject to the following conditions:
1. Planning Commission determination of compatibility of this project with the exiting
development and with surrounding properties. (Color elevations and a material
sample board have been submitted for Planning Commission review.)
2. Prior to the issuance of a building permit,grading and tree preservation plans shall
be reviewed and approved.
3. Installation of a 6' wide sidewalk along Old Wire Road at the location of the Master
Street Plan right of way for this minor arterial (45' from centerline). Coordination
with Engineering staff for locating this sidewalk at the two existing curb cuts will
need to be arranged at the time of development.
4. Installation of trees and shrubs along the front property line between the existing
development and the new sidewalk in accordance with §166.14. (One tree every 30
linear feet and a continuous row of shrubs between any parking areas and the front
property line).
5. Installation of a continuous planting of trees and shrubs (to be approved by Planning
staff to provide a screen between the proposed parking and building addition and
the adjacent residences (to the north).

BACKGROUND:
Property description: The subject property is the site of the Sequoyah United Methodist Church.
The property is currently zoned R-1, Low density residential. In 1966, the property was rezoned
from R-IA, Single family residential to P-lA, Special church district to allow the original
development of the property. In 1981, Planning Commission approved a conditional use permit
to allow the addition of two 20'x20' classrooms to the structure. Further additions have also
been made to the structure resulting in a 19,800 s.f church facility. A child day care, Sequoyah
Children's Garden, also operates from this facility.
At the May 12,2003 meeting of the Fayetteville Planning Commission,this request was tabled in
order to allow the church and neighbors to further discuss the impact of the proposed
development on the neighborhood. Additional information regarding existing trees, the need for
additional parking, the location of the proposed addition and materials and elevations for the new
structure was requested in order for the item to be heard by the Planning Commission at the May
27, 2003 meeting.
Since the May 12`h meeting, the applicant had the opportunity to meet with neighbors and to
amend the project in several ways. The stall depth on the north side of the new parking area was
reduced to allow a 2' overhang(as permitted by §172.01) and to leave additional greenspace
along the northern property line. An enlarged tree island was provided to accommodate one
large, existing tree. The building was relocated to meet the 50' setback requirement(the request
for a setback reduction is no longer necessary). Additional information regarding the use areas of
the church and the occupancy have eliminated the need for conditional use approval of excess
parking. And material sample board and color elevation information has been provided for
Planning Commission review.

Proposal: At this time,the applicant proposes to add a new structure to the site. An office
building containing 1,080 s.f is proposed which serve as an office for the district superintendent
and house two employees. Hours of operation for the office will be Monday through Friday from
8:00 a.m. —5:00 p.m. with an average of 6 patrons anticipated daily. Outdoor lighting will be
minimal and only enough to provide security for the office building (at the porch/entry and a
small wall light a the back door). With this project, the applicant is also requesting 22 additional
parking spaces to serve the new building and to supplement the parking provided for the existing
facility. There are currently 157 parking spaces located on the site to serve the church.
New information from the church(provided after the May 12, 2003 Planning Commission
meeting) indicates that the additional spaces will not require additional approvals. The proposed
parking will bring the total number of spaces on the site to 179. The maximum number of
parking spaces permitted for the church and proposed office on this site is 186. Parking
requirements and existing and proposed parking calculations are shown in the following table:

1. Hear and decide only such special exemptions as it is specifically
authorized to pass on by the terms of this chapter.
2. Decide such questions as are involved in determining whether a
conditional use should be granted; and;
3. Grant a conditional use with such conditions and safeguards as are
- appropriate under this chapter; or
4. Deny a conditional use when not in harmony with the purpose and intent
of this chapter.
C. A conditional use shall not be granted by the Planning Commission unless and
until:
1. A written application for a conditional use is submitted indicating the
section of this chapter under which the conditional use is sought and
stating the grounds on which it is requested.
Finding: The applicant has submitted a written application requesting approval of a
conditional use permit for a 1,080 s.£ office building and 22 additional
parking spaces for the United Methodist Church.
2. The applicant shall pay a filing fee as required under Chapter 159 to cover
the cost of expenses incurred in connection with processing such
application.
Finding: The applicant has paid the required filing fee.
3. The Planning Commission shall make the following written findings before
a conditional use shall be issued:
(a.) That it is empowered under the section of this chapter described in
the application to grant the conditional use; and
Finding: The Planning Commission is empowered under §161.04 to grant the
requested conditional use permit.
(b.) That the granting of the conditional use will not adversely affect
the public interest.
Finding: Granting the conditional use with recommended conditions will not
adversely affect the public interest. The proposal is for an expansion of an
existing use of this property which has been operating as a religious facility

since 1966. Staff is recommending conditions to ensure that the addition is
an attractive and appropriate structure with screening to buffer the use from
nearby residences.
(c.) The Planning Commission shall certify:
(1.) Compliance with the specific rules governing individual
conditional uses; and
Finding: The applicant has complied with specific rules governing this individual
conditional use request.
(2.) That satisfactory provisions and arrangements have been
made concerning the following, where applicable:
(a.) Ingress and egress to property and proposed
structures thereon with particular reference to
automotive and pedestrian safety and convenience,
traffic flow and control and access in case of fire or
catastrophe;
Finding: No changes are proposed to the ingress and egress patterns on the site.
There are currently two access points from Old Wire Road serving the
facility which will remain.
(b.) Off-street parking and loading areas where required,
with particular attention to ingress and egress,
economic, noise, glare, or odor effects of the special
exception on adjoining properties and properties
generally in the district;
Finding: Screening along the north property line between proposed parking and
adjoining residential property will mitigate the impact of lights and noise
caused by vehicles on this site.
(c.) Refuse and service areas, with particular reference
to ingress and egress, and off-street parking and
loading,
Finding: No changes are proposed with regard to solid waste disposal for this
property.
(d) Utilities, with reference to locations, availability,
and compatibility;

Finding: Utilities currently exist to serve this site. Underground extensions will be
made to accommodate the new development.

dimensions, and character;
Finding: Screening between the proposed parking and office building and the
adjoining residential property to the north is required.

Dear Dawn:
The following responses and attachments are provided to comments of Conditions of Approval
and requests from the Planning Commission made at its May 12, 2003, meeting.
1. Planning Commission determination of compliance with Commercial Design
Standards. Staff recommends that the brick chosen for the proposed addition
match the existing facility in order to tie the two buildings together visually for a
unified development on this site. (Color elevations will be required at the time of
building permit application; black and white elevations are included with this
staff report for initial review).
The architect for this project,Michael Johnson, Architecture Plus, Inc., is providing
attached herewith color elevations and a building materials sample color board for review
and approval by the Planning Commission. Apology is made to Planning Commissioner,
Mr. Estes. Had it been evident that these were required, the architect could have made
these available at that time.. MCO miss understood the direction received for approval of
Conditional Use.
2. Planning Commission approval of parking in excess of that permitted by code.
Attached herewith is a letter of justification for parking from Sequoyah United Methodist
Church. MCO believes the Church indeed needs its present number of parking spaces and
is supportive of its rationalization for additional parking area.
3. A grading plan shall be required prior to a building permit being issued.
Acknowledged. A preliminary grading plan has been prepared and will be submitted to
City Engineering for review and approval supplemental 4o receiving Conditional Use
approval from the Planning Commission.

4. A Tree Preservation Plan is to be reviewed prior to a building permit being
issued.
Acknowledged. Preliminary data has been gathered in preparation of a Tree Preservation '
Plan and will be submitted to the City Landscape Administrator for review and approval
supplemental to receiving Conditional Use approval from the Planning Commission.
To assist the Planning Commission in its review of this proposed project,the attached
photographs with explanation is provided. Also a sketch of the project structures,
specifically the north edge of proposed parking, and correspondence to existing tree
locations is provided for review by the Planning Commission.
In cooperation with the adjoining neighbors, their understanding of the proposed project
structure locations, etc., a site meeting was conducted on Wednesday,May I e. Prior to
the meeting, the exact location of the north edge of the parking area and that of the office
building were field staked. The staking reviewed with the neighbors is indicated in the
accompanying photographs.
Attached is a letter of Concurrence, and comments from the neighboring property owners.
In response, the parking spaces on the north side have been shorten to 17-feet from 19-
feet; and an additional parking space has been removed to provide an additional measure
of undisturbed surface in protection of a singled out desirable tree.
5. Installation of a 6' wide sidewalk along Old Wire Road at the location of the
Master Street Plan right of way for this minor arterial (45' from centerline).
Coordination with Engineering staff for locating this sidewalk at the two existing
curb cuts will need to be arranged at the time of development.
Acknowledged. This condition is agreed to and will be incorporated with construction
drawings presented to City Engineering at application for a Building Permit. This
condition was also previously agreed to in a`Bill of Assurance'attached to the property.
6. Increased setback from the north property line to accommodate§163.23 which
requires a 50' setback between non-residential uses (which are enclosed and fully
air conditioned) and adjacent residential properly.
The build has been adjusted to meet the 50-foot setback.

7. Installation of a 6' tall wood board privacy fence or a continuous planting of
trees and shrubs (to be approved by Planning staf)to provide a screen between
the proposed parking and building addition and the adjacent residences (to the
north).
The existing tree canopy will in essence remain. The adjoining neighbors have expressed
their desire for no wood board privacy fence, see attachment letter form adjacent
property owners. They have also expressed desire for the removal, clearing, of the
existing under brush. The Church is in agreement to remove the dense undergrowth
screening and install the additional planned tree planting.
MCO believes these responses and attachments adequately addresses the concerns expressed by
Staff and the Planning Commission, and meet the requests made. The Owner is confident that all
issues have been resolved and hopeful that the Planning Commission finds the proposed
development satisfactory to approve. MCO will be present Tuesday, May 27 , at the Planning
Commission's scheduled, 5:30 evening meeting for additional explanation, if necessary.

Dear Commissioners:
The following photographs are presented in explanation and to demonstrate the proposed project
parking area's corresponding location with that of existing trees, and tree canopy. Noteworthy
photos are 4 and 10.
There are no significant trees, by Ordinance definition, found in this grouping. However, effort is
made to save all the trees that do exist. It is MCO's professional opinion, Thomas Jefcoat,
Registered Landscape Architect,that the placement of a parking surface at the location shown by
plan, should not be a determent to the continued normal or expected life cycle of the indicated,
existing trees.
The trees are mostly Ehns, Cherry, and Hackberry and generally of only fair health. There is
truck damage to several. However,there are several nice trees and all can be greatly helped
(health wise)by removing the vines, allowing light to reach the trunk (removing moisture and
insect infestation). Attached is a layout map indicating the tree locations, sizes, species, etc. for
your referencing. Also indicated is the distance to each tree trunk from the edge of shifted back
of curbing.
Should there be additional questions or need of data interpretation, I will be available at the
Planning Commission meeting,May 27, 2003.

Dear Planning Commission:
Thank you for again considering our application for building and the extension of our
parking lot. There were two criteria that you requested be addressed:
L Meeting with the neighbors over their concerns. This was happily done and they
have submitted a letter.
2. Need for additional parking for the church.
a. The seating capacity for our sanctuary was incorrectly reported. The
comfortable number is 290. However,we can and have squeezed in 320.
b. We currently, have occasional combined worship services in the fellowship
hall which has a seating capacity of 550. Our worship team is in the planning
stages of moving our Contemporary service into the fellowship hall
permanently. This move could not be considered without additional parking.
c. Due to our location,there is no overflow parking area.
Sequoyah United Methodist is a growing church in a growing community. This church
has a long-standing commitment to open its facilities to community groups, ranging,from
Boy and Girl Scouts,Al-Anon, Alzheimers Support Group,to a city polling facility.
We are requesting that you allow for the growth of an organization seeking nothing more
than to add value and dignity to the life of our community here in Fayetteville.

Re:Sequoyah United Methodist Church/Neighborhood Concerns
Dear Commissioners:
I would like to take this opportunity to thank you for hearing our concerns re:the R-1 Low Density Conditional
Use request submitted by Millholland Engineers / Sequoyah United Methodist Church. We have met with all
parties involved and the following is a list of agreements made:
OBJECTIVE: Preservation of the 15 trees north of the property line:
• New parking located north of the property will be changed to compact parking spaces,extending the
previous line 24" from the previous planned curb site. An additional 2 feet should ensure the root
system remains unharmed from any additional parking spaces.
• One parking space,the fust space northeast of the current area,will be changed into a landscaped
area in an effort to preserve one of the oldest trees having the largest root system
OPEN ISSUES:
• Neighbors have agreed that we do not want a 6' fence or retaining wall built.However,adding trees
and landscaping will allow both to enjoy more environmental/serene surroundings
• Line of brush between the new parking and tree line removed and replaced with landscaping
We,by no means,are objecting to the growth of the Church. Additional parking will allow the Church to increase
its positive presence in the Community allowing more individuals and families to have parking prior to services on
Sunday. Currently,unlike other Churches in Fayetteville, no overflow parking exists b/c the Church sits on Old
Wire Road.
In closing,we wanted to reiterate our appreciation of all involved for listening to our concerns. We do feel that
this could have been resolved beforehand had we received the notification prior to one week before the meeting.
